1968-08-29A special meeting of the Town of Wappinger Zoning Board of **AW Appeals was called to order on Thursday, August 29th, 1968, at 7:30 p.m., at the Town Hall, Mill Street, Wappingers Falls, New York. Members Present: Thomas 1. Graham, Sr. Joseph Incoronato Gordon A. Hirt Richard E. Jacobson Members Absent: H. Frederick Koehler (Resigned) others Present: Joseph E. Ludewig, Building inspector & Zoning Administeator In the absence of the Secretary, Mr. Incoronato acted as recording secretary. This meeting was called for the purpose of acting on Appeal # 76, which was requested by Vincent B. & Mary E. Lopez. Said appeal had been referred to the Dutchess County Planning Board in accordance with Sections 239-L and 239-M of the General Municipal Law, for recommendation. The County Planning Board's recommendation was received, said recommendation being that the decision in this case be based upon the Zoning Board of Appeals' own study of the facts. Mr. and Mrs. Lopez were present for their appeal and presented the Board with copies of the following letter: August 15. 1968 Mr. Vincent Lopez Dorothy Heights Wappingers Falls, N.Y. Dear Mr. Lopez: This is to inform you that at a meeting of the Village Board of Trueettes held on Aug. 7, 1968, your request to hook up to Village sewer on Ingall Street was discussed. The Board approved the above request, provided installation is made at your own expense. This service will also be subject to an out of Village rental it a fee of $35.00 per year: I have been informed by the Water Department that permission to hook up to Village water Ix" also been granted, provided you comply with their regulations. Zoning Board of Appeals -2- August 29, 1968 Special Meeting Minutes The Board reviewed the facts in this matter, which are as follows "Vincent and Mary Lopez of Dorothy Heights, Wappingers Fails, New York, applied to the Town of Wappinger Building Inspector for a Building Permit to erect a one -family residence on a parcel of four combined lots shown on a filed map as lots # 42, 44, 46, and 48, and fronting on a street designated as Ingalls Street. The Building Permit application was rejected by the Building Inspector because said Ingalls Street has not been improved to the satisfaction of the Town Board as required by Section 280A of the New York State Town Law. Therefore, Mr. and Mrs. Vincent Lopez have requested relief from the Zoning Board of Appeals because of hardship in being denied the use of their land. A public hearing was held on August 130 1968, at the Town Hall* Mill Street, Wappingers Falls, New York, at 8:00 p.m., at which time all interested parties were heard, and the decision was reserved until such time as the Dutchess County Planning Board's recommendation was received. Said recommendation was received, and a special meeting was called for Thursday, August 29, 1968, at 7:30 p.m., at same Town Hall." A motion was made by Mr. Incoronato, seconded by Mr. WOMW Jacobson, to grant appeal # 76, requested by Vincent & Mary Lopez, and reverse the decision of the Building Inspector, with the Appellants' agreement to maintain their own access and egress road on Ingalls Street, and with the Appellants' under- standing that the Town of Wappinger will not be responsible for the maintenance of Ingalls Street at any time. Motion Unanimously Carried The minutes of the previous meeting of August 13th, 1968, were not available due to the absence of the Secretary.
