1968-06-11The regular meeting of the Town of Wappinger Zoning Board of Appeals was called to order on Tuesday, June 11, 1968, at 8:05 p.m., at the Town Hall, Mill Street, Wappingers Falls, New York. Members Presents Thomas I. Graham# Sr. Joseph Incoronato Members Absent: H. Frederick Koehler Gordon A. Hirt Richard E. Jacobson Others Present: Susan J. Pike, Secretary Joseph E. Ludewig, Building Inspector and Zoning Administrator Chairman Graham welcomed Mr. Incoronato as a member of the Board. PUBLIC HEARING, APPEAL #75 - Pursuant to Section 544 of the Town of Wappinger Zoning Ordinance, at the request of John and Christine Brickwedel, seeking a variance to permit the construction of a garage addition to their residence located on All Angels Hill Road, in the Town of N'appinger, within 10 ft. 6 in. of their property line, being a variance of the sideyard setback regulations. Affidavit of Publication had been received from the Wappinger and Southern Dutchess News, attesting that notice of this hearing was published in the June 6th edition of said newspaper. written notice of this hearing had been sent to the abutting property owners, said property owners being William and Eileen Prevatel, Joseph and Linda Polhill, and Chris J. Simonetty, Mr. Briekwedel, being present for the appeal, came before the Board and discussed the plans with them. He explained that the existing garage in the basement will be closed off and converted Zoning Board Minutes -2- June li, 1968 to a playroom and storage space. Referring to his plans, he noted that, due to the location of his septic tank and leaching field, there is no alternatives for location of this garage. Mr. Simonetty and Mr. Polhill, abutting propertycwners, were present and, upon viewing the plans, indicated that they have no objections to granting this variance. No one else was present to speak in favor or or against the appeal at this time. The hair declared the hearing closed at 8:25 p.m., at which time the Board went into an executive session. The meeting reconvened at 8:56 p.m. Mr. and Mrs. Prevatel, abutting property owners, were now present and indicated that they have no objections to granting this variance. Chairman Graham explained that because the Brickwedel property is located within 500 fto of a County Highway (All Angels hill Road), this appeal must be submitted to the Dutchess County Planning Board for a recommendation, as required by Sections 239-L and 239-m of the General Municipal Laws therefore, the Zoning Board of Appeals could not act at this time. However, Chairman Graham indicated that as soon as the County's report is received* the Zoning Board would be willing to call a special meeting for action. The Secretary was instructed to make this referral. The minutes of the regular meeting of April 9, 1968, were read by the Secretary. Zoning Burd Minutes -3- June 11, 1968 A motion was made by Mr. Hirt, seccmded by Mr. Jacobson, to approve the minutes of the regular meeting of April 9, 1968 as read. Motion Unanimously Carried The Board received a copy of a letter, dated May 16, 1968, addressed to Joseph Incosonato, from Blaine H. Snowden, Town Clerk, notifying him of his appointment as a member of the Zoning Board of Appeals. Said letter was filed as information. The Board also received a copy of the decision handed ddwn by Supreme Court Justice Joseph F. Hawkins, dated May 14, 19$8, in the matter of that application of Highway Displays, Inc., Petitioner, against the Zoning Board of Appeals of the Town of Wappi4ger, Dutahess County, New York, Respondent.
