1967-03-14The regular meeting of the Town of Wappinger Zoning Board of Appeals was called to order on Tuesday, March 14, 1967, beginning at 8:00 p.m., at the Town Hall, Mill Street, Wappingers Falls, New York. Members Presents Thomas I. Graham, Sr. Richard E. Jacobson James Mills, Jr. Members Absents none Others Present: Gordon A. Hirt H. Frederick Koehler Joseph E. Ludewig, Building Inspector & Zoning Administrator Susan J. Pike, Secretary Mr. Koehler wished to note, for the record, that the Board is very glad to welcome Mr. James Mills as a new member, and hopes for a good relationship on the Board. The Secretary read the minutes of the regular meeting of December 13, 1966. A motion was made by Richard Jacobson, seconded by Frederick Koehler, to approve the minutes of the December 13, 1966 meeting, as read. Mr. Mills abstained. Motion Unanimously Carried The Public Hearing was opened on Appeal # 54, requested by Mrs. Katherine Knapp to permit the construction of a one -car residence garage on her property located on a privately -owned right of way known as Plaza Road, in the Town of Wappinger. Mrs. Knapp was present for her appeal, and explained that her reason for wanting to construct the garage is her tenant has expressed the desire to have a garage to protect his automobile. Mr. Jacobson asked Mr. Ludewig why the building permit was denied. Mr. Ludewig explained that Section 280a of the Town Law prohibits the Building Inspector from issuing a building permit for a structure on property which does not front on a Town, County, or State highway. The Board reviewed and discussed the plot plan with Mrs. Knapp. Mr. Hirt asked whether the proposed garage would meet all setback requirements if it were erected as proposed and Plaza Road was taken over by the Town. Mr. Ludewig stated that it would meet the setback requirements. Mr. William Ohlerking, an abutting owner, was present and asked how far away from the house the garage will be. ' +zoning Board of Appeals -2- March 14, 1967 I%W Mr. Graham replied the garage will be 16 ft. away from the house and 20 ft. away from the side property line. Mr. Ohlerking noted that although the owner has kept the property clean, he feels that since the house is so small, it would not be an attractive sight to have another small structure next to it. Mr. Claude Knapp, the Appellant's husband, was present and spoke in behalf of the request. Mrs. Knapp stated that just before winter this year, she had some of the holes in the road filled in. She further stated that she pays for snow -plowing service and garbage pick-up service on Plaza Road. She also noted that the school buses travel over this road. No one else was present to be heard. Chairman Graham declared the hearing closed at 8:22 p.m., at which time the meeting was recessed and the Board went into an executive session. The meeting was reconvened at 8:33 p.m. A motion was made by James Mills, seconded by Richard Jacobson, to grant Appeal # 54, as requested by Mrs. Katherine Knapp, permitting the construction of a one -car residence garage on her property located on a privately -owned right of way known as Plaza Road, in the Town of wappinger. Motion Unanimously Carried It was noted that the zoning Board of Appeals Seminar, which was held at the Central Hudson Auditorium, South Road, Poughkeepsie, on March 7, 1967, was attended by Mr. Graham, Mr. Mills, and Mr. Ludewig, and the afternoon session was also attended by Miss Pike. A motion was made by Frederick Koehler, seconded by Gordon Hirt, to adjourn the meeting.
