1966-05-10The regular Board of Appeals r beginning at 8:00 Wappingers Falls, Members Present: meeting of the Town of Wappinger Zoning was held on Tuesday, May 10, 1966, P.M. at the Town Hall, Mill Street, New York David N. Koffsky Gordon Hirt Absent: Frederick Koehler Others Present: Richard Jacobson Thomas Graham Joseph E. Ludewig, Zoning Administrator Susan J. Pike, Secretary The minutes of the April 26, 1966 meeting were read. A motion was made by Thomas Graham, seconded by Richard Jacobson, to approve the minutes of the April 26, 1966 meeting as read. Motion Unanimously Carried 8:00 P.M. - Appeal # 49 - At the request of I.C.B.M. Homes, Inc. for a 24 ft. rear lot line variance and a 5 -ft. front yard variance for a portion of the lot to permit construction of retail stores on their parcel of land located on the west side of Route 9D in Hughsonville, New York. Mr. Stephen Puzio was present for the application. He came before the Board and reviewed with them the conditions set forth by the Planning Board in its preliminary approval of the project. Mr. Puzio explained the proposed layout and pointed out the revisions which were made on the plans. The Board called a 5 -minute recess to give those present an opportunity to view the plans. The Chairman asked if anyone wished to be heard. Mr. J. Forrester, resident of Wheeler Hill Road, asked questions in reference to the sewage disposal system, proposed water supply, and storm drainage. He objected to the project because of the traffic situation which would be created. He felt that the developer is trying to put too much into too small an area. Mrs. George Relyea, an abutting owner to the property, stated that Mr. Puzio is a good man and has never done anything to her. Mr. Puzio stated that the land coverage of the proposed project is under the maximum square footage allowed. The hearing was terminated. The Board had before them a letter which they drafted to send to the Town Board stating their opinion in the matter of the amendment to the Zoning Ordinance, which is proposed by the Planning Board. A copy of the letter is herewith attached. 4 W Zoning Board Minutes -2- A motion was made by Thomas Gordon Hirt, to submit the letter written. Motion May 10, 1966 Graham, seconded by to the Town Board as Unanimously Carried A motion was made by Gordon Hirt, seconded by Richard Jacobson, to grant the requested variance to I.C.B.M. Homes, Inc. for a 24 -ft. rear lot line variance and a 5 -ft. front yard variance for a portion of the lot to permit construction of retail stores on their parcel of land located on the west side of Route 9D in Hughsonville, New York, on the grounds that: 1. A practical difficulty exists because of the unusual shape of the lot in that the depth of the portion of the lot where the approval has been granted is insufficient to allow reasonable sized stores to be placed thereon. 2. The land is zoned commercial and site plan approval for the submitted plan has been previously obtained from the Planning Board. 3. The provision of a 6 -ft. alleyway does provide sufficient access and/or egress to and from these stores to allow for refuse disposal, public safety, and fire protection.
