1964-06-09The regular meeting of the Town of Wappinger Zoning Board of
Appeals was called to order on June 9, 1964.
Motion #20, dated 5-25-64.
Motion made by David Koffsky that the variance be granted based
on the following reasons:
The property could not yeild a reasonable return since the area
is zoned for residential purposes and owner could not use
property for intended use,
The Hardship is not necessarily shared by all properties within
the vicinity because the foundation was erected prior to the
adoption of the State Building Oode, thereby, no building
permit was issued. The building now can be completed on existinj
foundation.
The variance would not change the character of district because
the street is dead end with a good surface and building would
conform to standards required by ordinance.
Motion seconded by Thomas Graham. All members voted in favor
of motion.
Appeal #219 dated 5.26-64.
Motion made by Robert L'Archevesque that no action be taken on
the request because application requested a blanket variance for
a number of lots. It was verbally pointed out to Yx. Schwarzbart
some lots located on Sucich Place and Loses Road were contiguous
and, therefore, must adhere to Section 411.09 of the ordinance.
Also, it was pointed out each appeal must be submitted on a
separate basis to determine if such a variance is warranted.
Second by John Zwynenberg. All members voted in favor of motion.
Appeal X22, dated May 27, 1964.
Motion made by David Koffsky no final action to be taken, but
the Jackson application to to forwarded to the Dutchess County
Planning Board for their review as required by General Muncipal
Law, Section 239.1+ and and 239,M since a portion of said property
is located within the Town of Pishkill. Second by Tomas Graham.
All members voted in favor of motion.
Appeal #189 dated May 1, 1964r Walter Hanzi.
Motion by Tomas Graham that the requested variance be granted since
Mr. Hanzi complied with conditions set by the Board and forwarded
to Mr. Hanzi in a letter dated May 15, 1964. Mr. Hanzi's letter
of May 20 stated these conditions were agreable with Mr. and Mrs
Olson and Waiter Hanzi. Second by David Koffsky. .All members
voted in favor of motion.
Motions read by Chairman in open meeting immediately after executive
session.
