1963-04-02f A meeting of the Town of Wappinger Zoning Board of Appeals was called to order on Tuesday, April 2, 19639 at 7:30 p.m, at the Toro. Ha 11, Mill Street, Wappingers Falls, N.Y. The %; purpose of the meeting was a hearing for Appeal #1, Mrs. Henrietta Osten. Members present were: Kermit Booker Wilmer Ifill John Zwynenburg Others present were: Joseph Ludewig Judson Williams Robert L'Archevesque Thomas Graham Madeline Evans The ixt minutes of the last meeting were read. Motion to accept the minutes was made by iSx.Mr. Ifill and seconded by Mr. L'Archevesque. Motion passed. A report was given by Mr. L'Arohevesque, Chairman of the Public Relations Committee who is planning to have a column in the Wappingers and Southern Dutohess News each week on zoning. A public hearing was held for Mrs. Henrietta S. Osten, 99 South Avenue, Wappingers Falls. She asked permission to put a trailer on one of her lots on Osborne Hill Road (an RD 20 area). This would be a variance to the Zoning Ordinanoe, Section 421.2is �Ilkw lot size 1s 100 z 400. Against was John Ecklund who questioned if the lot referred to has a block building on it. Mr. ft Osten said no. Mr. Eoklund feels that a j= precedent will be not tonight if a favorable decision is given. Mr. Osten stated that a variance is gequested on the basis of sale - if a variance is granted, the land will be sold. Most of the land around has been sold to put trailers on. Mr. Becker asked if there is anything unusual as far as the lay of the land. Mr. Osten said there is nothing. The adjoining land is owned by Thownsend on one side, Hensler behind (trailer park) and Henrietta Osten on the other side. Mr. L'Archevesque asked if the lot size is sufficient to build a residence. Mr. Osten said, yes, if someone would buy it. Mr. Ecklund asked if this reasoning is because of trailers already there and Mr. Osten answered yes. Mr. Becker asked how many lots Mrs. Osten wwns and was answered 3 lots, each 1001frontage. Mr. L'Arohevesque asked if the one Who is buying the lot ever expects to build. Mr. Osten said probably, most everyone feels they will some day. Mr. Ferrante asked what happens to the value of the surrounding land if this lot is sold for a trailer. This, of course, cannot be answered. Mr. Ferrante feels that if we give a variance, We will have to do the same if someone else comes for one. Mr. Osten stated that his mother is 75 and needs to sehl the land to live. He stated that she cannot sell this land for anything but a trailer. Mr. Zwynenburg asked What action has been taken to sell the land for a residence. Mr. Osten answered that he advertised in the paper over the last few years. Mr. Ecklund said that he contemplates his own future and the impact that trailers would have on his land. He feels that a precedent will be hard to change in the futurge. Before an executive session was called it was stated that there should be an acting chairman in case of the absence of Ohairman Booker, Mr. L'Archevesque nominated Wilmer Ifill and it was seconded by Mr. Graham. A vote was taken and the motion was carried. Mr. Ferrante was present to discuss the fourth apartment in Fleetwood Manor. He felt that a letter was sufficient and that he did not need a formal appeal. He will now make a formal appeal. Mr. Williams stated that the Town Building Inspector has the power to aok on the Fleetwood Manor apartment building. Mr. Ludewig will study a few more things and then announce his decision. Then followed an executive session and discussion. Upon motion of Mr. L'Archevesque, seconded by ire Mr. Zwynenburg, the following resolution was proposed: RESOLVED that Appeal #19 Mrs. Henrietta Osten, for a variance in the zoning ordinance to put a trailer on a lot belonging to her on Osborne Hill Road be denied. All members that were present were in favor of the denial. This motion was made in executive session but read at the public meeting.
