1963-04-16A The regular meeting of the Town of Wappinger Zoning Board of Appeals was called to order on Tuesday, April 16, 19639 at the Town Hall, dill Street, Wappingers Falls, at 8:00 p.m. Minutes of the previous meeting were read. A note will be added to the effect that the last motion was made in Executive Session but added to the minutes. Motion made by Mr. Graham and seconded by Mr. L'Archevesque that the minutes be accepted as corrected. Motion passed. Members present were: Wilmer Ifill John Zwynenburg Thomas Graham Robert L'Archevesque Others present were: Madeline Evans The first hearing was on Appeal #2, Donald L. Savary, who wishes to extend his house on his property. There was a question of whether there is a road next to his property or just a right-of-way. A_petition was presented by N*= Mr. Savary signed by members of his neighborhood stating that they are not against this variance. The second hearing was on Appeal #3, Henrietta Osten, who wishes to sell one lot for the purpose of putting a trailer on it. The lot already has a building on it which was originally a candy factory. Mr. Oharles Fornsel wants to buy the lot to put a trailer on it and probably will tear down the building. He feels that the lot would not be good to build a home on. Against this was Mr. Eoklund who quoted from Section 416.034 - if a non -conforming building is not used for at least one year, it cannot be resumed. A petition was submitted by Mr. Eoklund stating that a trailer park is not desirable. The neat hearing was on Appeal ,#4, Mrs. Rose Orlowski, who wants to operate a beauty parlor in her home. A petition of names of neighbors was submitted who do not object. She started this before zoning but could not finish before zoning due to sickness. She has already spent a little over #600 *rior to zoning. The Zoning Board of Appeals requested statements from carpenter, plumber, etc., saying that work was started before zoning was in operation. Next, doe Almena questioned the 4th apartment building at Fleetwood Manor. Stated that Mr. Gallo, the owner, has not done any work within the 30 -day limit. Hearing for this will be on May 219 1963. Mr. Almena requested that we put a stop -order on Mr. Gallo and that the permit be pulled until a decision is made. After the executive session a motion was made by Mr. Zwynenburg and seconded by Mr. L'Archevesque that we table Appeal #4 until Mrs. Orlowski forwards further information on construction. Motion passed unanimously. Zoning Board of Appeals - April 16, 1963 - Page 2 On Appeal #2, Savary, a motion was made by Mr. Graham and seconded by Mr. L'Archevesque that this variance be granted. Motion passed unanimously. On Appeal #3, Mrs. Osten, a motion was made by Mr. Graham and seconded by Mr. L'Archevesque that this appeal be denied. Motion passed unanimously. Those present were: Kermit Becker Wilmer Ifill Thomas Graham Robert L'Archevesque John Zwynenburg. Also present was Joseph Ludewig. An informal discussion of articles of the zoning ordinance was held. Based on a letter dated April 99 1963, from Joseph Ludewig to Mr. P. Ferrante relative to the Fleetwood apartments, Mr. Ferrante requested the Board of Appeals an interpretation of the Zoning Ordinance from Section 416.020. Motion was made by Mr. Iffll and seconded by Mr. Graham to clarify Ordinance Section 416.020 vs. Town of Wappinger Ordinance for Administering and Enforcing the State Building Construction Code.
