2. Public Comment
Joe Ennesser explained that he had spoken to Town Attorney Al Roberts about the process of
getting the porch repaired on the administrative building at the Carnwath Farms Property. He
said that he had received three bids but that they should get looked at in greater detail. Joseph
Cavaccini stated that he and Joe Ennesser were looking for the Board to move 20,000 from the
Friends of Carnwath account to have the porch repaired. He explained that the building would be
used a visitors and historical center for the Town. Attorney to the Town, Al Roberts, said that
this discussion should be delayed until the bids are reviewed again.

VII. Discussions
A. Royal Carting Hours of Operation
Jim Constantino explained that he was there as a continuation of the discussion about the
noise ordinance. He said that he proposes a change to allow garbage trucks to pick up without
causing additional traffic congestion. He explained that at the conclusion of a discussion with
Supervisor Gutzler, they had recommended a modification of the exception related to refuse pick
up. It is currently in effect from 6AM to l OPM. Royal carting is requesting that commercial pick
up begin at SAM. They also requested that refuse in residential areas be picked up at 5AM and
recyclables not until 5:30AM. Councilman Beale said he doesn't have a problem with 5AM in
commercial areas, but has a problem with it in residential areas. He said that possibly all pick up
no earlier than 5:30AM on weekdays and 6AM on weekends and holidays. He explained that it
could be 5AM Monday through Friday in commercial areas. He asked Mr. Constantino if that
was acceptable. Mr. Constantino said that he was wondering about schools which are in
residential areas. They could be picked up at 5:00 but the surrounding areas not until 5:30. He
also described multi dwelling complexes as commercial. Councilman Beale said he had no
problem with them being considered commercial. He said that they often use dumpsters.
Councilwoman Czarniecki asked if even though schools are in residential areas; the school could
be considered commercial. Councilman Beale said that the schools would be considered
commercial. The schools could be picked up at 5:25AM and the neighborhoods at 5:30.
Councilman Beale said that if that is acceptable he would sponsor an amendment. Mr.
Constantino asked to consult with Al Roberts about the language of the amendments.
B. Palmateer Memorial Park Check Presentation- Councilman Beale
Councilman Beale stated that the coming Wednesday was September 11th and that at 8:30AM
there would be a memorial at the future site of the Mark Palmateer Park. He said that soon, it
wouldn't have to be called the future site because the planning board approved the conceptual.
He stated that the flag poles have been ordered but they did not arrive in time. He introduced
Mary Maybaum and Lisa Turner from the Mark C. Palmateer Foundation. Councilman Beale
said that they run the Mark Palmateer tournament which has raised $10,000 for the park. He said
that the money from this year's tournament along with money raised in the past would fund the
park. Supervisor Gutzler said the September 11'h Memorial time was posted on the Town's
website. She also thanked Councilman Beale and the members of the foundation for their hard
work.

2. Motion To: suspend the public hearing
Councilman Beale requested that the public hearing be suspended until after the executive
session. Councilman Beale moved the motion. Councilwoman Czarniecki seconded it. The
motion was unanimously carried. Gary Lindstrom requested that the Supervisor explain what the
ublic hearing was for.

IX. Items for Special Consideration
1. Supervisor Gutzler
Supervisor Gutzler explained that some things had come in that did not make the deadline. She
then read a letter from a resident that commended Michele Gale, Susan Dao, Jessica Fulton, and
the employees down at the Recycle Center. Supervisor Gutzler also thanked Susan Rose who
volunteered to come in and run the cameras for the meeting.
2. Councilman Beale
Councilman Beale said that he saw that some Towns are holding informational sessions on how
to re -apply for the STAR Exemption. Councilman Beale requested that the Town of Wappinger
try to set one up as well. He then explained that there was a problem with the Town's cable
channel. He said that he has been trying to contact the appropriate person and also have a
training session set up to show a Town Employee how to use the Cablevision system.
Councilman Beale said he had been watching other Town's meetings on Verizon and would like
to try to get the Town set up on Verizon as well. He then said that there was a legislative issue
with the parking at Mark Palmateer Park. There is currently a no -parking zone by the park, but
has no signs posted. He would like to have the legislation changed to make that parking available
to people who would like to visit the park.
3. Councilman Bettina
Councilman Bettina asked if Councilman Beale could look into Al-Jazeera now being on local
television. He explained that some people have been calling him about it. He said that he would.
Councilman Beale said that our cable channel is currently just colored bars, but Mark Price,
Recreation Director, does a great job with the channel.
4. Councilwoman Czarniecki
Councilwoman Czamiecki said she would like to sponsor a resolution concerning a grant for the
greenway trail. Joe Ennesser explained that the grant would provide funds to update maps for the
Greenway Trail and allow them to create walk -books for the trail. Councilwoman Czamiecki
moved the resolution. Councilman Beale seconded it. The motion was unanimously carried.
RESOLUTION: 2013-201
Resolution Authorizing Greenway Conservancy for the Hudson River Valley 2013 Trail
Grant Application
WHEREAS, the Town of Wappinger is applying to the Hudson River Valley Greenway
for a grant under the 2013 Greenway Conservancy Small Grant Program for a project entitled
Develop & Update Informational Trail Materials (Maps & Brochures) to be located in the Town
of Wappinger; and

WHEREAS, the grant application requires the applicant municipality to obtain the
approval/endorsement of the governing body of the municipality or municipalities in which the
project will be located.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger hereby does approve and endorse the
application for a grant under the 2013 Greenway Conservancy Small Grant
Program, for a project known as Develop & Update Informational Trail Materials
(Maps & Brochures) and located within this community.

6. Councilman Kuzmicz
Councilman Kuzmicz moved a resolution transferring funds. Councilman Beale seconded it. The
motion was unanimously carried.
Councilman Kuzmicz moved a resolution appointing Michael J. Leonard to the vacant position
of Town Clerk. Councilman Beale seconded the motion. The motion was unanimously carried.
Mr. Leonard thanked the Board for their consideration and for their votes. Councilman Kuzmicz
thanked Deputy Town Clerk, Jessica Fulton, for her service and hoped that she could continue
that work into the future. Supervisor Gutzler said that the Deputy Town Clerk has been most
gracious, kind, and lights up Town Hall. Councilman Bettina said that he is glad that Mr.
Leonard is a notary.

RESOLUTION: 2013-203
Resolution Appointing Town Clerk
WHEREAS, a vacancy exists in the Office of the Town Clerk of the Town of
Wappinger, Dutchess County, New York, by virtue of the resignation of Christine Fulton, who
resigned as Town Clerk effective August 9, 2013; and
WHEREAS, pursuant to Town Law § 64(5), the Town Board, or the majority Members
thereof, are authorized to fill such vacancy for the remainder of the unexpired term of the Office
of the Town Clerk.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. Pursuant to the authority vested in the Town Board pursuant to Town Law §
64(5), Michael J. Leonard of and residing at 15 Peter Drive, Wappingers Falls, NY 12590 a duly
qualified resident of the Town of Wappinger, is hereby appointed to fill the vacancy existing in
the Office of the Town Clerk of the Town of Wappinger.
3. The Town Board hereby appoints Michael J. Leonard as Town Clerk of the Town
of Wappinger, Dutchess County, New York, to fill the unexpired term of Christine Fulton,
effective immediately and shall continue through December 31, 2013
4. Upon appointment and taking oath of office for the position of Town Clerk,
Michael J. Leonard shall be paid the salary approved for the Office of the Town Clerk for
calendar year 2013, prorated from the date of appointment through December 31, 2013.
5. Those Council Members voting in favor of such appointment shall hereby execute
the Certification of Appointment in the form attached hereto.

9. Supervisor Gutzler
Supervisor Gutzler explained that Briar_ James, the property manager at the Church of the Sacred
Mirrors, has offered to hire Deputy Sherriff s to work at their events, due to past complaints from
neighbors. Councilman Beale asked if they were required to have an assembly permit for events
that draw between 500-1000 people. He said that emergency services should be aware when
these full moon events go on. Attorney Al Roberts, said that should be reffered to the Zoning
Administrator. Robert Gray, Engineer to the Town, said that Fire Inspector Mark Lieberman is
aware of each event that goes on up there. Councilman Beale requested that the Church of the
Sacred Mirrors give the Town Board a heads up when they have these events.

Local Law_ 2013 Which Would Amend Chapter 240 Zoning, of the Town Code with
Respect to a Variety of Planning and Zoning Matters
Attorney Al Roberts, stated that he has found that it is inappropriate to regulate signs that
promote campaigns. Town Planner, David Stolman explained that on Page 3 from the word sign
all the way through paragraph E should be struck out. Councilman Beale made a motion to adopt
the law as amended striking out the section pertaining to signs all the way through paragraph E.
Councilman Kuzmicz seconded the motion and it was unanimously carried.

RESOLUTION: 2013-187
Adopting Local Law —of 2013 Which Would Amend Chapter 240, Zoning, of the Town
Code with Respect to a Variety of Planning and Zoning Matters
WHEREAS, the Town Board is considering the adoption of Local Law —of 2013 which
would amend Chapter 240, Zoning, of the Town Code with respect to a variety of planning and
zoning matters; and
WHEREAS, the Town Board has determined that the Proposed Action is a Type I action
pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known
as "SEQRA") and pursuant to Chapter 117 of the Town Code (the Town's Environmental Quality
Review Law which establishes locally designated Type I actions); and
WHEREAS, the Town Board has determined that the proposed Local Law is an action for
which there are no other Involved Agencies and that the Town Board is therefore, by default, the
Lead Agency for this action.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board of the Town of Wappinger hereby adopts Local Law —of 2013;
except as specifically modified by the amendments contained therein, the Town
Code, as originally adopted and amended from time to time thereafter is to remain in
full force and effect.
