commended the progress that has been made since he began. Supervisor Gutzler and the rest of
the Board then offered their congratulations to Councilman Beale who recently became engaged.

2. Public Comment
Resident Mary Schmalz showed the Board different programs and documents that she
had put together for the annual "ramble." She pointed out that there were segments on Carnwath.
She showed the Board pictures of signs that were up at other sites. Those signs have spots to
store documents and maps. She said that it would be very easy to convert the signs at Carnwath
to include the map holders. Ms. Schmalz said that the Ramble would be this upcoming weekend
in the Village of Wappingers Falls beginning at the Mesier homestead. Next, Ms. Schmalz asked
about what Councilman Bettina had said at a previous meeting about bringing water lines to
Chelsea. Supervisor Gutzler said that Phase 2 of the DEP project would bring water to parts of
Chelsea. Councilman Bettina said that they are still in the process of boring and blasting.
Supervisor Gutzler said that the blasting will only be at the DEP site. Engineer to the Town said
that blasting occurs at the DEP site once every three days.

1. Community Day Thanks
Supervisor Gutzler thanked everyone who was involved in Community Day. She said
that it was the best in years. There was a return to the community flavor, having local vendors
and food services. She continued that in a stroke of brilliance the Recreation department was able
to have fireworks and still offer rides to the public at no cost. Many residents came to the
Supervisor to express how thankful they were for that. She then thanked Councilman Kuzmicz,
liaison to the recreation committee. Councilman Kuzmicz thanked, Ralph Holt, Mark Price, and
Donna Lenhardt of the Recreation department.
2. Tennis Courts
Engineer to the Town Bob Gray, offered an update on the tennis court construction. He
said that there was a letter from him on the dais. He explained that on the practice court, there

was a wall that was going to come down and be put back up. However, when the wall was taken
down, it was discovered to be rotten, and needed to be replaced. Councilman Kuzmicz explained
that the money to replace the wall could come out of the parkland trust fund.

4. Alternates on ZBA
Councilman Beale said that they had received a letter about using alternates on the
Zoning Board of Appeals. He asked if to do this the Town would need a new Local Law.
Attorney to the Town, Al Roberts said that yes it would. Mr. Roberts said that a methodology for
their appointment and whether they would have to attend all meetings would have to be written
up. Councilman Bettina asked if the alternates would have to be paid. Mr. Roberts said that they
would be. Supervisor Gutzler said that she would be looking at the attendance records for the
Zoning Board and said that it is disturbing that members of the Zoning Board have been missing
so many meetings. Councilman Beale pointed out that there had been an attendance policy put in
place in the past. He then asked if putting alternates on the Zoning Board of Appeals meant that
alternates would have to be put on the Planning Board as well. Mr. Roberts said that the Town
Board might want to consider that as well. Councilman Beale said that rather than rush through
this the Board should wait until the reorganization for 2013. Councilman Bettina said that there
would be an additional cost to train the new members.
X. Resolutions
RESOLUTION: 2013-205
Resolution Introducing Local Law _ of 2013 Which Would Amend Chapter 240, Zoning
of the Town Code with Respect to Boardinghouses and Rooming Houses
WHEREAS, the Town Board is considering the adoption of Local Law _ of 2013
which would amend Chapter 240, Zoning, of the Town Code with respect to
boardinghouses and rooming houses; and
WHEREAS, for the purpose of Article 8 of the Environmental Conservation Law,
Part 617 NYCRR (commonly known as "SEQRA") and pursuant to Chapter 117 of the
Town Code (the Wappinger Environmental Quality Review Law (WEQR) which
establishes locally designated Type I actions), the Proposed Action is the adoption of the
proposed Local Law as well as Special Permit and Site Plan Approvals of an existing
boardinghouse; and
WHEREAS, the Town Board has determined that the Proposed Action is a Type I
action pursuant to SEQRA and WEQR; and
WHEREAS, after performing a designation of Lead Agency procedure in
accordance with SEQRA, the Planning Board became the Lead Agency for this Proposed
Action; and
WHEREAS, after considering the potential environmental impacts with respect to
the Proposed Action, the Planning Board, as Lead Agency, issued a Negative Declaration,
thereby finding that the Proposed Action will have no significant adverse impacts upon the
environment, and thereby ending the SEQRA process with respect to this matter.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board of the Town of Wappinger hereby introduces for consideration of
its adoption proposed Local Law _ of 2013 in the form annexed hereto; except as
specifically modified by the amendments contained therein, the Town Code as
originally adopted and amended from time to time thereafter is to remain in full force
and effect and is otherwise ratified, readopted and confirmed.
3. The Town Board hereby schedules a public hearing regarding the adoption of the
annexed proposed Local Law _ of 2013 for PM on the day of ,

2013 and the Town Clerk is hereby directed to publish notice thereof in the Town's
official newspapers not less than ten (10) days prior to said public hearing date.

a. To serve a copy of this resolution, the annexed proposed Local Law, and the
public hearing notice to the municipal clerk of each abutting municipality not
less than ten (10) days prior to said public hearing;
b. To serve a copy of this resolution, the annexed proposed Local Law, and the
public hearing notice to the Dutchess County Department of Planning and
Development for advisory review in accordance with Section 239 of the
General Municipal Law; and
c. To distribute a copy of this resolution, the annexed proposed Local Law, and
the public hearing notice to the Town of Wappinger Planning Board for its
review and recommendation pursuant to Section 240-112 of the Zoning Law
prior to said public hearing

Imperial Improvements, LLC
WHEREAS, there is now pending in the Dutchess County Supreme Court a tax
certiorari proceeding commenced in 2012 by Imperial Improvements, LLC regarding real
property located at New Hackensack Road, Grid No. 6158-15-589264-0000, 18 New
Hackensack Road, Grid No. 6158-15-589264-0001 and 1527 Route 9, Grid No. 6158-19-
575182-0000 seeking a reduction in the 2012 tax assessments for the 2012/2013 tax rolls; and
WHEREAS, the owners of the above mentioned parcel have agreed to withdraw the
petition requesting a reduction for said tax roll; and
WHEREAS, the Town Assessor and Special Counsel have recommended a settlement of
this tax review proceeding; now, therefore be it

RESOLUTION: 2013-209
Resolution Scheduling Town Board Meetings to Adopt Budgets for Fiscal Year 2014
WHEREAS, the Town Supervisor, as Budget Officer, pursuant to § 106 of the Town
Law, has prepared the Tentative Budget for delivery the Town Board for review, examination
and possible revision; and
WHEREAS, said Tentative Budget will be submitted to the Town Clerk on September
30, 2013, as required by law; and
WHEREAS, a Special Town Board meeting will be scheduled for Thursday, October 3,
2012 at 7:30 pm for the purpose of having the Town Clerk deliver the Tentative Budget to the
Town Board in accordance with Town Law § 106; and
WHEREAS, New York State Town Law § 108 requires that the Town Board must hold
a public hearing on the Preliminary Budget on or before the Thursday immediately following the
general election in November; and
WHEREAS, Town Law requires the adoption of a Final Budget on or before November
20, 2013; and
WHEREAS, in order to accomplish the Budget Adoption Schedule set forth in Article 8
of the Town Law, the Town Board hereby establishes the following tentative schedule of Town
Board Meetings set forth below, reserving unto itself the right to change the scheduled meetings
if circumstances require.
NOW, THEREFORE, BE IT RESOLVED, as follows:

RESOLUTION: 2013-210
Resolution Awarding Contract for Robinson Lane Baseball Field Mobile ADA Restroom
WHEREAS, the Town of Wappinger was granted a Community Development Block
Grant (CDBG) for the construction and installation of handicapped accessible improvements at
the Challenger Fields at the Robinson Lane Sports Complex; and
WHEREAS, one of the improvements include the installation of a Mobile ADA
Restroom at the Robinson Lane Baseball Field; and
WHEREAS, the base bid solicitation for the installation of a Mobile ADA Restroom
includes providing and delivering a Mobile ADA Restroom and providing a solar panel system
to power D/C items; Alternate 1 provides for the installation of high efficiency air conditioning
(without heat strip); Alternate 2 provides for installation of forced air heat (hard wired and for
main area only); and
WHEREAS, by letter dated September 16, 2013, Greg W. Bolner, P.E. of Clark
Patterson Lee Design Professionals, reports that $50,000.00 of Community Development Block
Grant funds are available for this project; and
WHEREAS, advertisements for bids were duly published and advertised and only one
bid was received as follows:

WHEREAS, by letter dated September 16, 2013, Greg W. Bolner, P.E. of Clark
Patterson Lee Design Professionals reports that based on the amount of funds available and the
bids submitted that the Town Board should award the contract for the base contract plus
Alternative 1 and Alternative 2; and
WHEREAS, Greg W. Bolner, P.E. of Clark Patterson Lee Design Professionals reports
that Comforts of Home Services, Inc. has complied with the bid specifications and was the only
bidder for the project with the Base Bid and Alternate land Alternate 2 in the amount of
$25,400.00.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger determines that the contract for the
project described above should be awarded for the base project plus Alternate 1
and Alternate.
3. The Town of Wappinger hereby awards the contract for the installation of a
Mobile ADA Restroom at the Robinson Lane Baseball Field to Comforts of
Home Services, Inc. in the amount of $25,400.00 and directs the use of the
Community Development Block Grant funds to be applied towards the costs of
this improvement.
4. The Town Board hereby authorizes the Supervisor to execute the contract
documents as prepared by Clark Patterson Lee, and to issue the Notice of Award
and Notice to Proceed to Comforts of Home Services, Inc. after the Attorney to
the Town has confirmed that Comforts of Home Services, Inc. has signed the
contract documents and has supplied the necessary Performance Bond, Payment
Bond and insurance certificates as required by the bid specifications.

Resolution Authorizing Refund of Unused Escrow for Chelsea Yacht Club Awning
(Account 13-3272)
WHEREAS, on or about April 8, 2013, Serge Cryoff, a Trustee of Chelsea Yacht Club
(hereinafter the "Applicant") filed an application for Site Plan Approval under Application
Number 13-3272; and
WHEREAS, on or about May 1, 2013, the Applicant deposited One Thousand Five
Hundred Dollars ($1,500.00) into an escrow account with the Town of Wappinger for payment
of the fees of the Town's professionals to review the application; and
WHEREAS, the application was approved and the Resolution of Site Plan Approval was
signed by the Planning Board Chairman on June 27, 2013; and
WHEREAS, no fees were incurred during the review of the application and a balance
of One Thousand Five Hundred Dollars ($1,500.00) remains in escrow account number 13-
3272 and Applicant has requested a refund of said unused escrow balances; and
WHEREAS, the Town Accountant has audited the escrow account and has
verified the amount due to the Applicant.

Supervisor Gutzler explained that she had received a letter from Justices Wolfson and
Kitchen of the Town Court. They are requesting a transfer of $21,002.17 to cover the salary of an
armed court officer. Councilman Kuzmicz moved. Councilwoman Czarniecki seconded. The
motion was unanimously passed.
Supervisor Gutzler welcomed back Highway Superintendent Graham Foster. She asked
Mr. Foster for an update on the Wildwood Work. Mr. Foster explained that the pipe is on order
and that hopefully the work will begin in a couple of weeks.
