Resolution Authorizing Home Rule Request to Authorize Consolidation of Certain Water
Districts and Water Improvement Areas in the Town of Wappinger
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on June 5,
2006.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:
PRESENT: Supervisor - Joseph Ruggiero
Councilmembers - Robert L. Valdati
Vincent F. Bettina
Joseph P. Paoloni
ABSENT: Maureen McCarthy
The following Resolution was introduced by Councilman Bettina and seconded by
Councilman Valdati.
WHEREAS, by Resolution No.2005-176, the Town Board of the Town of Wappinger
has requested the State Legislature (New York State Senate and New York State Assembly) to
authorize the consolidation of certain Water Districts and Water Improvement Areas in the Town
of Wappinger which areas are hydraulically connected, to be converted into one large Water
District with all of the powers authorized by Article 12 and 14 A of the Town Law applicable to
Water Districts, as well as the authority to apportion costs pursuant to Article 12C of the Town
Law; and
WHEREAS, the request has been forwarded to the New York State Senate and New
York State Assembly; and
WHEREAS, pursuant to Senate bill No.S7988 and Assembly bill No.A11556, proposed
Legislation has been submitted to the New York State Legislature for the purposes of adopting
the enabling legislation to permit the consolidation of certain Water Districts and Water
Improvement Areas in the Town of Wappinger
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger hereby issues this Home Rule
Request Message for Senate bill No.S7988 and Assembly bill No.A11556, to authorize the Town
of Wappinger to consolidate certain Water Districts and Water Improvement Areas in the Town
of Wappinger, in accordance with the Draft Legislation, a copy of which is affixed hereto.
BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to forward a
certified copy of this Home Rule Request Message to the New York State Legislature of the
State of New York requesting the introduction and adoption of the aforementioned bills.
