Little League Fences and Backstop Replacement 1. Motion To: Authorize the Town Engineer to put together Bids and Specs for Improvements needed for 2014 for the Little League fields at Robinson Lane Specifically Backstops R1 & R2, small or premade backstops for I1 & I2, New Fencing for F2 &R1, and fence caps for the rest of the complex Chris Schoen from Little League and Recreation Chairman Ralph Holt came to the floor to discuss Little League fences and backstop repair at Robinson Lane fields. Chris indicated that there are some serious safety issues at the field that need to get fixed in order to be safe. The 8,000 feet of chain link fencing had a 10-15 year rust and corrosion warranty with an estimated 25-30 life. 70% of the fencing is over 30 years old with some over 40 years old. Without help from the town, some fields will have to be closed. Chris expressed gratitude for the periodic improvements each year. He detailed the improvements as follows: new backstops were put in on fields SL 1, R3 and 172; replaced fencing on field SL 1, installed new gates on F1, F2, R1 and R2; installed 40 feet of fencing on the -1 base side for field SL3, installed 40 feet of fencing on the 1 st base side for field SL2; started the new challenger field. He further pointed out that Little league added new fencing on field R3; a 3-phase project on batting cages; and, added additional bay in the garage for storage. In 2002, the town improved fields and added lights. He warned that some backstops are starting to lean and all the backstops need to be replaced. He added that there are 760 feet of fencing that needs to be replaced. Total costs for all repairs would be as high as $500,000; but, recognized that the more serious and immediate items should take priority. Those items were the need to fix 2 backstops on R1 and R2 that are starting to lean; fence caps; portable pre -made backstops; and, replacement of the fencing on fields F2 and R1. Chris added that a benchmark quote from a local manufacturer came in at $112,000 and could be on the high side to be potentially brought down through the bidding process. Councilman Kuzmicz confirmed. Councilman Beale asked about annual inspections. Chris confirmed that there were annual inspections. Additionally, Councilman Beale asked how repairs were done in the past. Attorney -to -the -town replied that it has always been the responsibility of the town. Councilman Beale suggested that capital improvements should be done on an annual basis rather Town of 11'appinger Page 3 Printed 4 24'2014 Regular Meeting Minutes April 14, 2014 B. than all at once. Councilman Kuzmicz added that the committee did discuss a five year plan. Councilman Beale agreed that it should be the town's responsibility, yet there needs to be a more definitive line between town and little league responsibility. Councilman Bettina asked about the insurance review with regard to the players and the equipment. Chris affirmed that we are insured. Supervisor Gutzler reminded the board of the recent safety inspection that was done. Councilman Bettina asked for a copy of the report. Councilman Czarnecki asked for the insurance carrier go out and audit the location. Supervisor Gutzler asked for a motion to start the formal bidding process to have the Engineer -to -the -town to put together bid specs. Councilman Kuzmicz restated the motion to ask the Engineer -to -the -town to put together the bid specs for improvements needed for backstops at fields R1 and R2, small pre -made backstops for fields I1 and I2, new fencing for fields F2 and R1, and fence caps for the rest of the complex. Beale, Councilman AYES: Gutzler, Beale, Bettina, Czarniecki, Kuzmicz Amendment to the Comprehensive Plan/ Farley Supervisor Gutzler introduced Richard Mann who represents the party interested in a rezone at 26 Myers Corners Road from residential to commercial. Al Roberts pointed out the town's comprehensive plan has to be amended first because it reflects that property as residential, not commercial. Supervisor Gutzler reminded the board that there is a resolution on the agenda to amend the comprehensive plan and introduce a local law to change from residential to Conservation Commercial. Resolutions RESOLUTION: 2014-111 Resolution Adopting "Local Law No. Of The Year 2014, Amending Chapter 68, Dog Control" WHEREAS, a Resolution was duly adopted by the Town Board of the Town of Wappinger introducing proposed "Local Law No. of the Year 2014, Amending Chapter 68, Dog Control"; and WHEREAS, the Public Hearing was duly advertised in the Poughkeepsie Journal and the Southern Dutchess News, the official newspapers of the Town; and WHEREAS, the Public Hearing was held on April 14, 2014, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof, and WHEREAS, the Town Board determined that the proposed Local Law was not subject to Environmental Review; and WHEREAS, the Town Board of the Town of Wappinger after due deliberation finds that it is in the best interest of the Town to adopt said Local Law; and WHEREAS, said Local Law has been on the desks of the members of the Town Board of the Town of Wappinger for at least seven (7) days exclusive of Sunday prior to the adoption of this Resolution. RESOLUTION: 2014-112 Resolution Authorizing Execution Of Dog Control Housing Agreement With Dutchess County Spca WHEREAS, the Town of Wappinger Dog Control Officer, hereinafter referred to as the "DCO", is empowered to seize dogs pursuant to the provisions of Agriculture and Markets Law Article 7, § 117; and WHEREAS, pursuant to Agriculture and Markets Law Article 7, § 117, dogs seized by the DCO are required to be properly fed and watered during the applicable redemption period; and WHEREAS, the Dutchess County Society for the Prevention of Cruelty to Animals, hereinafter "DCSPCA", maintains a kennel for boarding of dogs and other animals at its office located at 636 Violet Avenue, Hyde Park, New York 12538; and WHEREAS, the Town has previously contracted with DCSPCA to provide shelter for dogs seized by the DCO, which Agreement has expired; and WHEREAS, the Town Board wishes to re -new the Dog Control Housing Agreement with DCSPCA to shelter, water, feed and provide necessary veterinary services for dogs and other animals seized by the Town; and WHEREAS, DCSPCA has presented to the Town a Dog Control Housing Agreement, a copy of which is annexed hereto; and WHEREAS, the Town was required to amend Chapter 68 of the Town Code to change the hold periods for dogs to be consistent with the hold periods required by the DCSPCA; and Town of 11'appinger Page 5 Printed 4 24'2014 Regular Meeting Minutes April 14, 2014 WHEREAS, the DCO was required to provide shelter for dogs seized and the Supervisor, in anticipation of the amendment to the Code, executed the Dog Control Housing Agreement so that seized dogs could be properly sheltered, as required by law; and WHEREAS, the Town determines that it is in the best interest of the Town to enter into said Dog Control Housing Agreement as above described and to ratify the Supervisor's execution of the Dog Control Housing Agreement. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if frilly set forth and adopted herein. 2. The Town Board hereby approves the Dog Control Housing Agreement, in the form annexed hereto, and hereby ratifies the Supervisor's execution of the Agreement by and on behalf of the Town of Wappinger, retroactive to January 1, 2014. 3. RESOLUTION: 2014-128 Resolution Introducing Amendments To The Town's Comprehensive Plan In Connection With Rezoning A Property To The Conservation Commercial (CC) District WHEREAS, the Town Board is considering the adoption of Local Law No. of 2014 which would amend the Town's Zoning Map for the purpose of rezoning a property to the Conservation Commercial (CC) zoning district; and WHEREAS, the subject property is located at 26 Myers Corners Road and is designated 6157-02-787923 on the Town tax maps (the "Subject Property"); and WHEREAS, the Town Board is also considering the following analogous amendments to the Town's Comprehensive Plan: 1. The Town of Wappinger 2010 Comprehensive Plan Recommended Land Use map is proposed to be amended so as to change the designation of the Subject Property from the Medium Density Residential designation to the Conservation Commercial designation. 2. The Town of Wappinger Comprehensive Plan is proposed to be amended so as to add the following paragraph after paragraph 419 in the Recommendations section Town of 11'appinger Page 6 Printed 4 24'2014 Regular Meeting Minutes April 14, 2014 of the Land Use chapter (p. 99): "20. This Plan recommends the extension of a Conservation Commercial (CC) zoning district along the southerly side of Myers Corners Road to the east so as to encompass the Farley property at 26 Myers Corners Road into this CC District for the purpose of making appropriate use of this long-time vacant parcel." (the "Comprehensive Plan Amendments"); and WHEREAS, for the purpose of Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA") and pursuant to Chapter 117 of the Town Code (the Wappinger Environmental Quality Review Law (WEQR) which establishes locally designated Type I actions), the Proposed Action is the adoption of the proposed Local Law, the adoption of a Resolution amending the Town's Comprehensive Plan, and Site Plan Approval of a proposed office use; and WHEREAS, the Town Board has determined that the Proposed Action is an Unlisted Action pursuant to SEQRA and WEQR; and WHEREAS, after performing a designation of Lead Agency procedure in accordance with SEQRA, the Planning Board became the Lead Agency for this Proposed Action; and WHEREAS, after considering the potential environmental impacts with respect to the Proposed Action, the Planning Board, as Lead Agency, issued a Negative Declaration, thereby fmding that the Proposed Action will have no significant adverse impacts upon the environment, and thereby ending the SEQRA process with respect to this matter. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Town Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein. 2. The Town Board of the Town of Wappinger hereby introduces for consideration the Comprehensive Plan Amendments specified above. 3. RESOLUTION: 2014-115 A Resolution Authorizing, Subject To Permissive Referendum, The Purchase Of Highway Equipment, In And For The Town Of Wappinger, Dutchess County, New York, At A Maximum Estimated Cost Of $230,000, And Authorizing The Issuance Of $230,000 Bonds Of Said Town To Pay The Cost Thereof. WHEREAS, all conditions precedent to the financing of the capital project hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act as a Type II Action, have been performed; and Town of 11'appinger Page 10 Printed 4 24'2014 Regular Meeting Minutes April 14, 2014 WHEREAS, it is now desired to authorize such capital project and its financing; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. The purchase of highway equipment, for the Town of Wappinger, Dutchess County, New York, each item of which costs $30,000 or over, including incidental equipment and expenses in connection therewith, is hereby authorized, subject to permissive referendum, at a maximum estimated cost of $230,000. Section 2. The plan for the financing of the aforesaid maximum estimated cost is by the issuance of $230,000 bonds of said Town, hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law. Section 3. Motion To: Unanimous Consent RESULT: ADOPTED [UNANIMOUS] MOVER: Michael Kuzmicz, Councilman SECONDER: Vincent Bettina, Councilman AYES: Gutzler, Beale, Bettina, Czarniecki, Kuzmicz RESOLUTION: 2014-129 Resolution Endorsing New York Senate Bill No. 5408-A And Assembly Bill No. 8315 To Designate Wappinger Creek As An Inland Waterway WHEREAS, the Wappinger Creek is one of five major tributaries to the lower Hudson River and drains a watershed of approximately 211 square miles (134,871 acres) of land traversing 11 towns and 2 villages within Dutchess County. Originating in wetlands and lakes in the Town of Pine Plains, the watershed spans thirty eight miles and enters the Hudson River at the border of the Towns of Poughkeepsie and Wappinger. WHEREAS, Wappinger Creek nuns through Town of Wappinger and is critical to the local economic and environmental future. WHEREAS, Wappinger Creek plays a central role in our local ecosystem impacting groundwater quality, biodiversity, and recreation. WHEREAS, past disturbances to the creek such as dredging, road and railroad crossings and low density residential development have caused a decline in water quality and habitat diversity. WHEREAS, upstream development and pollutants introduced in the upper creek have led to contamination of the public water supply wells in the lower watershed, and has led to the Wappinger Lake being listed on the New York State Department of Environmental Conservation's Priority Waterbody List as it no longer meets it's intended uses due to pollution. WHEREAS, the state legislature has introduced legislation in the form of S. 5408-A by Senator Terry Gipson and Assembly Bill A.8315 by Assemblywoman Didi Barrett that proposes to designate Wappinger Creek as an inland waterway. WHEREAS, this legislation would allow many communities in Dutchess County to take advantage of federal fiends to protect this body of water and would increase eligibility for technical assistance under the Local Waterfront Revitalization Program (LWRP), administered by the Division of Coastal Resources under the New York Department of State. WHEREAS, designating the Wappinger Creek watershed as an inland waterway would make all of the aforementioned communities eligible for the grant funding necessary for planning, design, feasibility studies, and constriction projects as well as implementation of local LWRPs.
