Resolution Authorizing Refund Of Unused Escrow For Estate Of Elma Kahara Subdivision

At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New
York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on January 12, 2015.
The meeting was called to order by Barbara Gutzler, Supervisor, and upon roll being called,
the following was recorded:

The following Resolution was introduced by Councilman Kuzmicz and seconded by
Councilman Czarnecki.
WHEREAS, on or about February 5, 2007, Irma Farfaro, Executrix for the Estate of Elma
Kahara (hereinafter the "Applicant") filed an application for Subdivision Approval under
Application Number 07-5125; and
WHEREAS, total escrow deposits in the amount of Eight Thousand Eight Hundred Fifty-
Eight 75/100 Dollars ($8,858.75) were received from the Applicant for payment of the fees of the
Town's professionals to review the application; and
WHEREAS, all professional fees incurred during the review of the application have been
paid and there remains a balance of Two Thousand Nine Hundred Eighty-Five 50/100 Dollars
($2,985.50) in escrow account number 07-5125 and Applicant has requested a refund and the
Town Accountant has audited the escrow account and reviewed the amount due.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby authorizes a refund to Irma Farfaro, Executrix of the Estate of Elma
Kahara, in the amount of Two Thousand Nine Hundred Eighty-Five 50/100 Dollars ($2,985.50)
from escrow account number 07-5125,representing the unused escrow balance for the above
project.
The foregoing was put to a vote which resulted as follows:
