Please be advised that the above referenced proceeding is a tax certiorari
matter for the years 2012, 2013 and 2014. This involves a single parcel of
Joan F.Garrett* improved property located at 1629 Route 376. It is an assisted living facility
Kevin T.McDermott known as the Avalon. As such value is determined based upon a variation of
the traditional capitalization of income and expense. The assessment for all 3
James P.Horan*** years was $3,783,850. We have agreed upon a reduction to $2,500,000 for
Marina V.O'Neill all 3 years. With the current equalization rate at 100%this settlement reflects

fair market value. We have also agreed to a reduction for 2015 to
$2,000,000,with a mutual freeze for 4 years thereafter.
