Resolution Authorizing Refund Of Benefit Assessments Paid By Property Owner Of 308
Myers Corners Road
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls,New York, on
September 29, 2015.

The following Resolution was introduced by Councilman Kuzmicz and seconded by
Councilman Ciccarelli.
WHEREAS,pursuant to Legislation adopted by the New York State Legislator, the
Town was authorized to consolidate a number of interconnected Water Districts and Water
Improvements Areas; and
WHEREAS, a routine review of the original maps identifying the boundaries of the
consolidated Districts and Improvement Areas indicated that the property known as 308 Myers
Corners Road was included in the District consolidation; and
WHEREAS, it has been subsequently determined that the District did not extend to 308
Myers Corners Road; and
WHEREAS,the owners of 308 Myers Corners Road received benefit assessments for
the United Wappinger Water District; and
WHEREAS,the Assessor confirmed that 308 Myers Corners Road should not have
received the benefit assessment.
NOW,THEREFORE,BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board determines that 308 Myers Corners Road is not within the
boundaries of United Wappinger Water District.
The Town Board directs a refund of any benefit assessments paid by the property owners of 308
Myers Corners Road as determined by the Town's Accountant in consultation with the Town's
Tax Assessor.
The foregoing was put to a vote which resulted as follows:
