WHEREAS, Chapter 97 of the Laws of 2011 established a tax levy limit on all local governments in New York State, effective January 1, 2012; WHEREAS, this law requires that local governments maintain any property tax increase to no more than 2 percent or the rate of inflation, whichever is less; WHEREAS, the law does provide exemptions for certain specific costs and allows the governing board to override the tax levy limit with a supermajority vote; WHEREAS, the Town Board of the Town of Wappinger has earnestly complied with this law and its specific regulations each fiscal year since the inception; WHEREAS, the Town Board of the Town of Wappinger will supersede the requirements of this law in Fiscal Year 2017; WHEREAS, this action by the Town Board of the Town of Wappinger will result in a reduction of effective property tax rates for residential and commercial parcels within the Town of Wappinger, both inside and outside the Village of Wappingers Falls; WHEREAS, the Town of Wappinger has an accumulated unrestricted fund balance; NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger direct the Town Supervisor to earmark $400,000 in unrestricted fund balance as a Taxpayer Protection Fund for the purpose of ensuring that the Town of Wappinger will comply with Chapter 97 of the Laws of 2011 during Fiscal Years 2018, 2019.
