2016-238 2016-238 Resolution Authorizing Refund Of Unused Escrow For Ketchum Knolls Subdivision (ACCOUNT 14- 5169/15-6044PP) At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on September 12, 2016. The meeting was called to order by Lori A. WHEREAS, on or about March 24, 2014, David Stenger, a Member of LMD Property Holdings, LLC (hereinafter the "Applicant") filed an application for Subdivision Approval under Application Numbers 14-5169/15- 6044PP; and WHEREAS, total escrow deposits in the amount of Thirty Two Thousand One Hundred Sixty-Eight 75/100 Dollars ($32,168.75) were received by the Town from the Applicant for payment of the fees of the Town's professionals to review the application; and WHEREAS, all professional fees incurred during the review of the application have been paid and there remains an unused balance of Nine Thousand Three Hundred Seventy-Five 45/100 Dollars ($9,375.45) in escrow account numbers 14-5169/15-6044PP; and WHEREAS,the Applicant has requested a refund; and WHEREAS, the Town Accountant has audited the escrow account and confirmed the amount due the Applicant. NOW, THEREFORE,BE IT RESOLVED: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby authorizes a refund to LMD Property Holdings, LLC, in the amount of Nine Thousand Three Hundred Seventy-Five 45/100 Dollars ($9,375.45), representing the unused escrow balance for the above project.
