Resolution Awarding Bid For Pavement Repairs In Connection With All Angels Hill Road
Sewer Line Repa
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on June 27,
2016.
The meeting was called to order by Lori A. Jiava, Town Supervisor, and upon roll being
called, the following was recorded:

The following Resolution was introduced by Councilman Kuzmicz and seconded by
Councilman Ciccarelli.
WHEREAS, by Resolution 2016-78, adopted by the Town Board on February 8, 2016,
the Town Board ratified and confirmed the action of Supervisor Lori A. Jiava in issuing an
Executive Order which authorized the emergency facilitation of repair work for the sewer line
failure in the shoulder of All Angels Hill Road between Cider Mill Loop and Edge Hill Drive, as
well as awarded a contract to Sun Up Enterprises, Inc. in the amount of$140,248.25 for such
repair work; and
WHEREAS, there still remains portions of the job which repair paving; and
WHEREAS, Engineers to the Town, Morris Associates Engineering & Surveying
Consultants, PLLC, attempted to procure written proposals from three separate contractors
pursuant to a"Proposal Request for the Town of Wappinger Pavement Repair" dated June 2016,
a copy of which is affixed hereto; and
WHEREAS, the Engineers only received two responses to the RFP as follows:

Sun Up Enterprises, Inc., Wappingers Falls, NY $15,300.00
Clove Excavators, Inc., Poughkeepsie, NY $31,900.00
WHEREAS, inasmuch as the lowest bid was only $300.00 over the threshold in the
Procurement Policy, and only two contractors responded, as well as in interest of timeliness and
public safety, the Town Board suspends the Procurement Policy for this project; and
WHEREAS, by email dated June 21, 2016 from Morris Associates Engineering &
Surveying Consultants, PLLC, by Mark Long, P.E., it has been determined that the lowest
responsible proposal was from Sun Up Enterprises, Inc., Wappingers Falls, NY with a written
proposal in the amount of$15,300.00.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby awards the bid for the pavement repair in connection
with the All Angels Hill Road sewer line repair between Cider Mill Loop and Edgehill Drive to
Sun Up Enterprises, Inc., Wappingers Falls, NY in the amount of$15,300.00 in accordance with
the email of Mark Long, P.E. dated June 21, 2016, a copy of which is affixed hereto.
In accordance with the specifications in the above-described Proposal Request, the Town Board
hereby authorizes the Supervisor to execute any contract documents, including the Notice of
Award and Notice to Proceed and forward a copy to Sun Up Enterprises, Inc., after the Attorney
to the Town has confirmed that Sun Up Enterprises, Inc. has duly executed the required contract
documents and has supplied the necessary insurance certificates
The foregoing was put to a vote which resulted as follows:
