Resolution Awarding Bid For Sewer Line And Water Line Replacement In The Shoulder
Of All Angels Hill Road Between Cider Mill Loop And Edgehill Drive (Alternate 2)
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on January
11, 2016.
The meeting was called to order by Lori A. Jiava, Town Supervisor, and upon roll being
called, the following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by
Councilman Kuzmicz.
WHEREAS,by Executive Order No. 1 of 2015, Declaration of Emergency Regarding Public
Works Project, dated December 4, 2015, the Supervisor of the Town of Wappinger, Barbara A. Gutzler,
declared an emergency and authorized the immediate repair work in connection with the sewer line
failure under All Angels Hill Road; and
WHEREAS, during the repair work, another sewer line in imminent failure was discovered in the
shoulder of All Angels Hill Road between Cider Mill Loop and Edgehill Drive; and
WHEREAS,the current Supervisor, Lori Jiava, directed the Engineer to the Town, Robert J.
Gray,P.E. of Morris Associates Engineering & Surveying Consultants, PLLC, to prepare a Request for
Proposal(RFP) for such repair work in accordance with plans and specifications prepared by the Engineer
to the Town and approved by Dutchess County Department of Public Works;
WHEREAS,plans and specifications were prepared by Morris Associates Engineering &
Surveying Consultants, PLLC, and an RFP was issued for the work required to repair the sewer line in the
shoulder of All Angels Hill Road between Cider Mill Loop and Edgehill Drive (Alternate 1) as well as
the work required to replace the sewer line and water line at Cider Mill Loop to Edgehill Drive and All
Angels Hill Road(Alternate 2); and
WHEREAS,based on the recommendation of Engineer to the Town, Robert J. Gray,P.E., and
Michael Tremper of Camo Pollution Control, the Town Board determines that the work must be done on
an expedited basis and hereby declares a public emergency and directs that this repair work be undertaken
as soon as circumstances permit; and
WHEREAS,proposals were duly solicited for the work to be done and the following proposals
were received on January 8, 2016 as follows:

WHEREAS,by letter dated January 11, 2016 from Morris Associates Engineering & Surveying
Consultants, PLLC,by Robert J. Gray, P.E.. Engineer to the Town, it has been determined that the lowest
responsible proposal is: Sun Up Enterprises, Inc., Wappingers Falls,NY, with a proposal price of
$101,385.00 for Alternate 1 and a proposal price of$112,600.00 for Alternate 2; and
WHEREAS, the Town Board wishes to award the contract to Sun Up Enterprises, Inc.,
Wappingers Falls,NY, in the proposed amount of$112,600.00 as stated under Alternate 2 in the
proposal.
NOW, THEREFORE,BE IT RESOLVED,as follows:
I. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby declares an emergency and authorizes the repair work to the
sewer line in the shoulder of All Angels Hill Road between Cider Mill Loop and Edgehill Drive and
directs that such work be done as expeditiously as possible and in accordance with the above-referenced
RFP.
3. Because the above-referenced sewer line is in imminent danger of collapse, the Town
Board suspends the requirement of the Town's Procurement Policy which would otherwise require this
work to be let out under formal competitive bidding requirements.
4. The Town Board confirms that the solicitation of RFPs by the Engineer to the Town were
sufficient for the purposes of this repair work.
5. The Town of Wappinger hereby awards the contract for the sewer line and water line
replacement in the shoulder of All Angels Hill Road between Cider Mill Loop and Edgehill Drive to Sun
Up Enterprises, Inc., Wappingers Falls,NY in the proposed amount of$112,600.00 as stated under
Alternate 2 in the proposal and in accordance with the recommendation of Robert J. Gray,P.E. dated
January 11, 2016.
The Town Board hereby directs Sun Up Enterprises, Inc. to commence the work as set forth in the above-
referenced RFP as soon as Sun Up Enterprises, Inc. has supplied to the Town the Town's minimum
standard for insurance coverage and Workers' Compensation insurance; Contractor shall comply with the
prevailing wage standards and supply a certified payroll prior to request within.
The foregoing was put to a vote which resulted as follows:
