2016-68 2016-68 Resolution Extending Temporary Town-Wide Moratorium On The Installation Of Freestanding Or Ground-Mounted Solar Energy Systems For One Additional Three Month Term At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on January 25, 2016. The meeting was called to order by Lori A. WHEREAS, on November 9, 2015, by Resolution 2015-232, the Town Board adopted Local Law 2 of 2015 which established a Temporary Town-Wide Moratorium on the Installation of Freestanding or Ground-Mounted Solar Energy Systems in the Town of Wappinger; and WHEREAS, Section XI of Local Law 2 of 2015 provided for a moratorium term of three months from its effective date, subject to review and renewal by the Town Board of the Town of Wappinger for two (2) additional three (3) month extensions by Town Board Resolution; and WHEREAS, Local Law 2 of 2015 became effective on December 3, 2015 upon filing with the Secretary of State, and therefore it shall expire on March 3, 2016 unless it is extended; and WHEREAS, the purpose of the Temporary Town-Wide Moratorium on the Installation of Freestanding or Ground-Mounted Solar Energy Systems is to preserve the status quo in the Town of Wappinger pending the completion and adoption of the Town's new zoning regulations with respect to solar energy systems; and WHEREAS, the new zoning resolutions are being drafted and reviewed, and it is anticipated that the revisions will be adopted by June 3, 2016; and WHEREAS, the Town Board has determined an extension of the moratorium term is warranted and it is in the best interest of the residents and property owners of the Town of Wappinger to extend the provisions of Local Law 2 of 2015 for an additional three month term by resolution pursuant to Section XI thereof, and WHEREAS, The Town Board may terminate the Moratorium earlier than three months provided that the new zoning law is adopted and the appropriate revision to the land use regulations have been made. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. The Town Board hereby extends the Temporary Town-Wide Moratorium on Residential Development established by Local Law 2 of 2015 for an additional three month term commencing on March 3, 2015 and ending on June 3, 2015 pursuant to Section XI of the Local Law.
