RESOLUTION: 2016-59 Resolution Authorizing Release Of Performance Bond For Landscape Improvements Secured By A Bond In Connection With Prestige Mini Of Wappinger Site Plan WHEREAS, the Town Board had previously accepted a Performance Bond for Landscape Improvements dated September 29, 2015,posted by MWF, LLC (developer), secured by a Bond issued by The Service Insurance Company, Inc. in the sum of Fifty Thousand Dollars ($50,000.00), bearing Bond No. 6664N3, in the favor of the Town of Wappinger, to secure the developer's obligations to guarantee the completion of landscaping improvements; and WHEREAS,Engineer to the Town, Robert J. Gray, P.E. of Morris Associates Engineering & Surveying Consultants, PLLC, and Zoning Administrator, Barbara Roberti, by email dated January 4, 2016, have inspected the landscaping improvements and find that they have been completed as required by the Resolution of Site Plan Approval and therefore authorize the release of the Performance Bond securing said obligations. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. Gray, P.E. and Zoning Administrator, Barbara Roberti, and that their inspection revealed that the landscaping improvements were completed in accordance with the Resolution of Site Plan Approval and that there were no deficiencies in the improvements thereof, and recommends that the Performance Bond for Landscape Improvements together with the Bond be released. Based on the foregoing, Town Clerk, Joseph P. Paoloni, is hereby authorized to return to the developer the Bond issued by The Service Insurance Company, Inc. in the sum of Fifty Thousand Dollars ($50,000.00), bearing Bond No. 6664N3, in favor of the Town of Wappinger. Items for Special Consideration/New Business Engineer Gray rose to speak about a sewer failure at Cider Mill Loop and All Angels Hill Road. He added that Supervisor Gutzler gave an emergency order allowing them to move forward and get that pipe repaired. The pipe crossed diagonally across All Angels Hill Road about 100 feet of pipe. In doing the repair work they discovered there was further damage along the right shoulder going down towards Edgehill Drive. He added that there are two ways to repair this. One was to realign the pipe with a method called'Pipe First'. The second method was to remove the pipe and replace it with SDR 35, a plastic pipe that they use in the industry today. However, there is an adjacent water pipe which distributes water from the cider mill tank to residents. Engineer Gray discussed two bids. Water and Sewer Professional Mike Tremper discussed the two options. Engineer Gray recommended the second option which was replaced both pipes which wouldn't be that much more replacing than the first alternative. Water and sewer professional Mike Tremper estimated 380 feet of pipe. He added that the neighbors would need to be notified because there will be a disruption in service. Councilman Fenton asked for a time frame. Mr. Tremper said approximately 13 working days. Councilman Beale asked what the split would be between water and sewer District engineer Gray said about 50-50 Councilman Beale moved to accept the second option awarding the bid to Sun-Up enterprises with contingency of 15% total at $129,400 to be split between the two special districts. The local law was filed on May 18,2015. The original application, filed by Stewart's Shops Corp and R.J.A. II1d. Inc. was filed on December 23, 2014. The original application consisted of the existing Stewart's Shop as the primary use, and proposed to add gas dispensers and a canopy on the R.J.A.Md.Inc.parcel as uses accessory to the Stewart's Shop. The parcels were to be merged into one lot. The November 2015 proposed revisions to the application now include the construction of a new convenience store on the property of R.J.A. Hld. Inc., with the previously proposed gas dispensers and canopy accessory to the new convenience store. While Stewart Shops Corp. has assigned its right, title and interest in the original application over to R.J.A. Hld., Inc., the Stewart's Shop parcel has been completely removed from the application. This has necessitated two new entrances to be proposed onto Route 9D, as previously the existing entrance onto the Stewart's lot was to remain with only one additional entrance from the R.J.A.Hld.Inc.parcel onto Route 9D. You have proposed,by your letter,that the relevant question is"If there was no change in the local law or the applicant, and the applicant simply requested to reduce the scope of the project from its original Packet Pg. 23 5.1.a approximately 6.5 acres to 5 acres...." However, I have concerns with your proposed description of the application as a"reduc[tion] in scope." The addition of a new convenience store and new entrance onto Route 9D is, in my opinion, an increase in the scope and impact of the potential project. Further,the new building will necessitate additional parking which was not previously proposed. While you reference that the Town has historically permitted a wide latitude of amendments to pending site plans without requiring the withdrawal of the original application and submission of a new one, I have no personal knowledge of any comparable situation in my 15 years experience with the Town of Wappinger. I believe the relevant question to be as follows: If there was no change in the local law or the applicant, and the applicant proposed to amend its application to: (1)remove one of the two lots from the proposed site plan, and that lot had contained the already existing primary use of the site plan with existing street entrance and(2) construct a new primary use on the lot which remains in the application with additional impacts including a new street entrance and additional parking, would I require the applicant to withdraw the pending application and submit a new one,with the attendant filing fees, notifications and escrow, or would I permit the. application to CL continue as an amended site plan application. 0 Under the facts of this application, given the revised proposal to construct a new primary use on the lot which remains part of this application, and the additional impacts from that new primary use such as a new building, a new street entrance and increased parking, I would require the applicant to withdraw the pending application and submit a new one,with the attendant filing fees,notifications and escrow. M CO In conclusion, it is my opinion that the November 2015 revisions proposed to the project by R.J.A. Md. Inc. would be considered a new site plan application. As a new site plan it would not be grandfathered pursuant to Section 5 of Local Law#1 of 2015 and would be subject to currently zoning regulations. The proposed project would entail replacement of the existing bridge deck, support structure repairs, painting the structure, and abutment modifications to accommodate the new deck. The site is located in the Hudson,River watershed, in the Town of Wappinger, Dutchess County, New York. co UJ A submittal entitled "-Dutchess County DPW Bridge PO-15X: BIN 3343630" prepared by Modjeski and Masters, PC, dated October 8, 2015, and a supplemental information submittal, dated November 19, 2015, indicate that the proposed bridge rehabilitation work would include above water work such as the replacement of the existing 9,100 square foot 0 concrete bridge deck with a 2.5-foot wider 9,900 square foot deck, modifications to the abutments to accommodate the new deck, adjustments to the road approaches to the bridge, structural steel repairs, replacement of bearings, and painting of the entire structure. Also, approximately 278 square feet of concrete spall repairs would be made above and along the water line. This work would not result in any permanent loss of waters. To accommodate the bridge rehabilitation and protect Wappinger Creek, cofferdams made of sandbags and timber would be placed around each of.the two existing support piers of the bridge, resulting in approximately 3,950 square feet of temporary impacts to Wappinger Creek. Adjacent to the cofferdams, approximately 510 linear feet of turbidity curtains would be placed within the Creek to further protect the water from project activities. Silt fences would be placed at the toes of the upland slopes in the area of construction along both road approaches to the bridge to prevent erosion and sedimentation from reaching Wappinger Creek. Temporary shielding would be used on the bridge during the deck replacement work to prevent debris from falling into the waterway. After construction is completed, all temporary water and erosion control devices would be removed. Based on the information submitted to this office, our review of the project indicates that an individual permit is not required. The nationwide permits are prescribed as a Reissuance of Nationwide Permits in the Federal Register dated February 21, 2012 (77 FR 10184). The work may performed without further authorization from this office provided the activity complies with the permit conditions listed in Section B, No. 3, Section C, any applicable New York District regional conditions, the following special conditions, and any applicable regional conditions added by the State of New York, copies enclosed. Special Conditions (A) The permittee shall undertake the authorized filling activities in a manner aimed at reducing impacts upon the general environment. In addition, the permittee shall not stockpile fill or other materials in a manner conducive to erosion, or in areas likely to cause high turbidity-runoff during storm events. All exposed soils shall be re-vegetated in a timely manner to further reduce potential effects. The permittee shall also fence off all wetlands and other sensitive ecological areas during construction periods to prevent equipment and personnel from entering. those areas. (B) The permittee shall not conduct in-water work between January 15th and June 30th.
