Motion To: Public Hearing On The Intended Use Of Dutchess County Community Development Block Grant Funds And The Submission Of The Grant Application For Fiscal Year 2017 Supervisor Jiava summarized the program to get grant from the CDBG. She explained the region covered by the grant by addressing the maps. Bob Gray explained that there are 3 phases. He explained the restroom facility to make it ADA compliant. He further explained the picnic area and the parking lot. Phase 3 would be the hiking trail. He said the total cost would be $500,000 and to build it at no cost to the town. RESOLUTION: 2016-260 In the Matter of The Increase and Improvement of Facilities of the United Wappinger Sewer District in the Town of Wappinger, Dutchess County, New York WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, has duly caused to be prepared a map, plan and report including an estimate of cost, pursuant to Section 202-b of the Town Law, relating to the increase and improvement of the facilities of the United Wappinger Sewer District, in the Town of Wappinger, Dutchess County, New York (the "Sewer District"), being the Sewer District's share of the cost of the replacement and relining of sections of the trunk sewer line and installation of access roads along the sewer line right of way located in the Town of Poughkeepsie, New York, and operated by the Tri-Municipal Sewer Commission, for the benefit of the Town of Poughkeepsie, Village of Wappingers Falls and the United Wappinger Sewer District, including appurtenances and incidental improvements and expenses in connection therewith, at a maximum estimated cost of$217,104.00; and WHEREAS, said capital project has been determined to be a Type II Action pursuant to the regulations promulgated pursuant to the State Environmental Quality Review Act ("SEQRA") and Chapter 117 of the Code of the Town of Wappinger ("WEQRA") as to which it has been determined that this capital project will not result in a significant environmental effect and as to which SEQRA and WEQRA compliance materials are on file in the office of the Town Clerk, where they may be inspected during regular office hours; and Town of Wappinger Page 6 Printed 1012012016 Regular Meeting Minutes October 11, 2016 WHEREAS, at a meeting of said Town Board duly called and held on September 12, 2016, an Order was duly adopted by it and entered in the minutes specifying the said Town Board would meet to consider the increase and improvement of facilities of the United Wappinger Sewer District in said Town at a maximum estimated cost of $217,104.00, and to hear all persons interested in the subject thereof concerning the same at the Town Hall, in Wappingers Falls, New York, in said Town, on October 11, 2016, at 7:30 P.M., Prevailing Time; and WHEREAS, said Order duly certified by the Town Clerk was duly published and posted as required by law; and WHEREAS, a public hearing was duly held at the time and place set forth in said notice, at which all persons desiring to be heard were duly heard;NOW, THEREFORE, BE IT ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. RESOLUTION: 2016-262 Resolution Authorizing Engineer To Solicit Bids For Emergency Services Building Roof Replacement Project WHEREAS, the Supervisor of Buildings and Grounds and the Engineer to the Town has advised the Town Board that the roof on the Emergency Services Building is in disrepair and requires replacement; and WHEREAS, the Town Board has determined that it is in the best interest of the Town to undertake the necessary work required to replace the roof on the Emergency Services Building; and WHEREAS, the cost of the roof replacement is in excess of $30,000 and therefore requires competitive bidding; and WHEREAS, pursuant to Municipal Law § 103, contract documents and bid specifications must be prepared for the purpose of competitive bidding. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board has determined that the replacement of the roof on the Emergency Services Building is a Type 11 Action pursuant to 6 NYCRR § 617.5(c)(1) and § 617.5(c)(6) and is exempt from environmental review pursuant to the New York State Environmental Quality Review Act (SEQRA) and Local Law No. 6 of 1992. 3. The Engineer to the Town and the Attorney to the Town are directed to prepare bid specifications and contract documents and to promptly advertise the same for competitive bidding pursuant to General Municipal Law § 103, and the codes, rules and regulations of the Town of Wappinger, and to report to the Town Board the results of such bidding. RESOLUTION: 2016-263 Resolution Accepting First Reduction In The Security Posted With The Performance Agreement In Connection With Hilltop Village At Wappinger (The Regency At Wappinger) WHEREAS, Toll Brothers, Inc. (the "Applicant")on behalf of Contrail, LLC(the "Owner")had made application to the Town of Wappinger Planning Board to approve a subdivision of lands more particularly described in Subdivision Plans entitled "Hilltop Village at Wappinger"prepared by Povall Engineering, PLLC and survey by Rovert V. Oswald, Jr. Land Surveying, LLC, dated May 28,2013, last revised July 18, 2013; and WHEREAS,the Town of Wappinger Planning Board granted Final Conditional Subdivision Approval to Toll Brothers, Inc. as Applicant and Contrail, LLC as Owner pursuant to Resolution dated March 18, 2013, subject to certain public improvements being made and constructed within said subdivision as set forth in the construction documents prepared and submitted in connection therewith, and further subject to completion of and/or the compliance with the requirements set forth in the Town of Wappinger Subdivision Regulations, Highway Specifications, Zoning Code (including compliance with escrow deposits), Municipal Stormwater Management Law, and Rules and Regulations of the Town of Wappinger; and WHEREAS, Contrail, LLC conveyed its rights and interest in said subdivision to Toll Land V, Limited Partnership; and WHEREAS, Town Law §277 requires that the developer of a proposed subdivision to guarantee the construction,installation, and dedication of the required public improvements by the Resolution of Subdivision Approval,prior to issuance of any building permits; and WHEREAS,the Town of Wappinger required Toll Land V, Limited Partnership,to make, construct and complete the concrete sidewalks, site lighting and street trees,in accordance with any relevant standards maintained by the Town of Wappinger Highway Department and at the direction of the Town of Wappinger; and Town of Wappinger Page 9 Printed 1012012016 Regular Meeting Minutes October 11, 2016 WHEREAS,to secure the obligation to guarantee the construction and installation of the required improvements and obligations, and compliance with required escrow deposits, James Fitzpatrick, as Division President of Toll Land V, Limited Partnership, and individually as guarantor, executed a Performance Agreement dated May 19, 2015 secured by a Performance Bond issued by Arch Insurance Company,bearing Bond No. SUI 133194 and issued in favor of the Town of Wappinger in the sum of Three Hundred Seventy Seven Thousand Eight Hundred Dollars ($377,800.00)posted with the Town of Wappinger, securing the obligations set forth in the Performance Agreement; and WHEREAS, Toll Brothers, Inc.has completed a substantial amount of the required improvements; and WHEREAS,by letter dated October 5, 2016, Engineers to the Town,Morris Associates Engineering & Surveying Consultants,PLLC, confirmed that some of the required improvements have been completed and determined that the construction value of the work remaining to be completed was Two Hundred Fifty-Seven Thousand Three Hundred Thirty Dollars ($257,330.00); and WHEREAS,the Town Board hereby agrees to and authorizes a reduction in the security posted with the Performance Agreement, and hereby agrees to accept a reduced Surety Bond in the sum of Two Hundred Fifty-Seven Thousand Three Hundred Thirty Dollars ($257,330.00) as security to guarantee completion of the remaining work. Discussion RESOLUTION: 2016-264 Resolution Authorizing Professional Services In Connection With An Extension Of The United Wappinger Water District(Uwwd) To The Tall Trees Subdivision WHEREAS, the Tall Trees Subdivision, located off of Wheeler Hill Road in the Town of Wappinger is provided water through the Tall Trees Water Improvement Area; and WHEREAS, the wells servicing the Tall Trees Water Improvement Area have been unable to provide sufficient quantity of water to supply the needs of the inhabitants of the Tall Trees Subdivision; and WHEREAS, the Town, through the United Wappinger Water District(UWWD), constructed a water main along Old Hopewell Road, through New Hamburg Road, through Wheeler Hill Road, through Carnwath Farms and eventually to River Road, to supply the New York City DEP Chelsea site, as well as the inhabitants of Chelsea with water; and WHEREAS, the Town had received permission to construct an emergency interconnection between the water facility at the Tall Trees Water Improvement Area and the water main constructed along Wheeler Hill Road; and WHEREAS,the emergency interconnection was constructed above-ground and the Dutchess County Health Department has directed the Town to construct a permanent underground interconnection from the water main on Wheeler Hill Road and the Tall Trees water facilities on an emergency basis; and WHEREAS,the Town Board has determined it is in the best interest of the residents of the Tall Trees Subdivision to make a permanent underground interconnection between the Tall Trees Water Improvement Area facilities and the UWWD waterline along Wheeler Hill Road on an expedited basis, in contemplation of a formal extension of UWWD to serve the residents of the Tall Trees Subdivision. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board has determined that the above-ground interim water connection between the Tall Trees Water Improvement Area and the UWWD water main is in danger of freezing as winter months' approach, and declares that an emergency exists for the purposes of installing a permanent underground water connection as authorized by the Dutchess County Health Department. 3. The Town Board further authorizes the Engineer to the Town, the Attorney to the Town, and the Town's Bond Counsel, to undertake all necessary work needed to construct an underground emergency permanent water connection from the UWWD waterline on Wheeler Hill Road to the Tall Trees Water Improvement Area facilities as approved by the Dutchess County Health Department and in accordance with the Dutchess County Health Department's rules and regulations and the rules and regulations of the New York State Department of Environmental Conservation. 4. The Town Board authorizes the construction of this underground waterline to be done on an emergency and expedited basis and that the funds necessary therefore shall be paid from the fund balance presently existing in UWWD, with the intention that the same shall be Town of Wappinger Page 20 Printed 1012012016 Regular Meeting Minutes October 11, 2016 reimbursed to UWWD at such time as Town Serial Bonds are issued to pay for the costs of the formal extension of UWWD to the Tall Trees Subdivision. 5. The Town Board, because of the emergency situation, suspends the Town's Procurement Policy and the provisions of General Municipal Law § 103.4 for the construction work necessary to complete the permanent underground interconnection and directs the Engineer to the Town to solicit at least three bids from qualified contractors to undertake the construction work required for the underground emergency interconnection upon plans prepared by the Engineer to the Town and approved by the Dutchess County Health Department. 6. The Town Board directs the Engineer to the Town to prepare a Map, Plan and Report in contemplation of an extension of UWWD to the Tall Trees Subdivision. 7. The Town Board further directs that the Town's Bond Counsel, Douglas Goodfriend of Orrick, prepare the necessary Resolutions indicating the Town's intent to Bond the funds necessary to pay for the construction costs of the emergency interconnection to Tall Trees Water Improvement facilities, indicating the Town's intent to reimburse the costs back to UWWD for any borrowings from the UWWD fund balance. 8. The Town Board also directs that a public informational meeting be scheduled for the residents of the Tall Trees Subdivision to apprise them of the steps being taken to connect them to UWWD. The Town Supervisor is further authorized and directed to execute any documents, contracts or other instruments necessary to implement the provisions of this Resolution. XI. Budget Discussions The discussions were primarily fact finding sessions. 1. Code Enforcement Zoning Administrator Barbara Roberti appeared before the board to discus the Fire, Building, and Zoning budgets. A general discussion of line items ensued along with an explanation of operations for not only the departments but also the planning and zoning boards.. 2. Buildings and Grounds Town of Wappinger Page 21 Printed 1012012016 Regular Meeting Minutes October 11, 2016 Building and Grounds Director Steve Frazier appeared before the board. Line A7110.100 was discussed regarding a math error, but no details we discussed. A position for skilled laborer was discussed as line number A2510.. Councilman Beale suggested $41,000 as the starting salary for 35 hours which is upgraded from laborer to skilled worker. A discussion ensued on the positions. The $28,000 position is moving into a part time position. The new hire will be position number three. Supervisor Jiava is going to have the accountant make the necessary changes. A discussion of line items ensued. 3. Parks A discussion ensued on park equipment for line item A7110.201 and A7110.212. Mr. Frazier discussed the need for personal tools for the new employee. Supervisor Jiava asked to put line A7110.408 (Montfort Road Park) and A7110.411 back to what was requested in the departmental budget. The board agreed to increase the Schlathaus line item A7110.424 to $5,000. The boat ramp was discussed along with the maintenance required to make it fully operational. A discussion of the Greenway Trail Warden and their supervision. XII. Items for Special Consideration/New Business 1. Buildings and Grounds Steve Frazier addressed a large pine tree that fell against a field light tower which needs repair. He asked the board to approve an extra $300 to inspect all the towers. The location was not disclosed. He added that the auction for the surplus equipment went very well with acquiring $16,300 for the three vehicles. The board agreed for Mr. Frazier to look into a Schlathaus LED bulletin board LED. He also addressed the wells at Schlathaus. 2. Outstanding Invoices Supervisor Jiava addressed outstanding road payments invoices for that are 28 days late and owed to Tilcon for $309,985; and, Avello Brothers for $107,094. She asked for direction to either reach out to the Highway Superintendent or she will prepare the vouchers for payment. Councilman Fenton said that the Highway Superintendent is over his re-surfacing budget line by $16,625. Supervisor Jiava stated that the overall re-surfacing budget is $808,970 which is currently at $826,625. Councilman Beale said that paying invoices is the Highway Superintendent's responsibility that can verify and approve the charges for accuracy and due diligence. XIII. Executive Session 1. As we discussed, the Tall Trees wells were in very pour shape for years and recently were taken off-line, 4T 0 An approval for an emergency interconnection between Tall Trees and UWWD was obtainedfrom the Health Department in January 2015. This would allow for water to temporarily be supplied from UWVVD 'to Tall Trees through a single connection gaff Amherst Crane. The estimated construction casts for the emergency Interconnection was approximately $120,000 and a copy of the construction cost estimate for the emergency interconnection is included with this correspondence. e While the emergency interconnection was never installed, Tail Trees has continued to have water quantity issues and letters were sent to the Dutchess County co Health_ Department ( CIS H) in July 2016, noting that an above .ground emergency interconnection using water from hydrants was being made between the systems, along with a regr.rest to confirm the requirements for a permanent interconnection between the systems. A permanent interconnection would require an extension of the UVVWD to serve Tall Trees and a copy of the total estimated capital costs (construction and non- Ln construction costs) of approximately $564,000 is included with this correspondence, This includes the work for the emergency interconnection, along with meter' installations, deccarrrrnissioning of the Tall Trees Mater System, and bray in costs e The most recent letter from the DCDOH as attached noted that the above ground hydrant emergency interconnection system would not be suitable for winter conditions, and that the DCDOH considers this to be an emergency condition.
