The document was filed with the assessor's office, March 10th, long before the grievance process and was missed. Adjourn Public Heariing To Nov. 2, 2016 4. Motion To: Open Public Hearing on Budgets, O&M Charges, Water and Sewer Rates For Special Improvement Areas and Districts Camo representative Michael Tremper presented to the board. He said that the O&M rates would remain the same in the United Wappinger Sewer District(UWSD). The smaller Fleetwood Sewer District rate would go up 1.4%. The smaller Mid-Point Park Sewer District rate would go up 1.6%. He stressed the need to get away from the smaller sewer districts pending the risk that the DEC would change the effluent limits which would bear a considerable cost to the resident in a smaller populous of people in these districts. He specifically cited the Mid-Point Park, Fleetwood and Wildwood sewer districts. He said that the DEC did address the 1957 built Wildwood Sewer District which would need ammonia removal, a stricter BOD removal limit, and a need for dissolved oxygen which caused the O&M costs to go up 7%. He went on to explain Water. The O&M rates will remain the same despite having the new filtration system in operation for the first full year. 80 Filters with cost of$400 each are being changed regularly at a cost of$32,000 per change. The Fleetwood Manor Water District is up 0.7%. The Tall trees O&M will remain the same until they join the United Wappinger Water District(UWWD) and would then go down while the capital costs would go up. The Watch Hill district O&M rates will remain the same. There will be a meeting with residents from the Tall Trees water district on November 3rd. Joe Incorronato addressed the drought and the need to notify residents to conserve. Mr. Tremper explained that he has been monitoring our wells twice a week since the DEC issued an alert in March. He added that the well fields have held up very well and to artificially notify people is not a good thing. Councilman Beale noted that we are in a drought'Watch' not a'Warning'. Supervisor Jiava added that Fleetwood District will go up $1.22. Watch Hill will go up $0.76. There will be no change in Tall Trees and UWWD. Watch Hill will go up $1.34. Mid-Point Sewer will go up $4.90. Fleetwood Sewer will go up $1.60. Wildwood Sewer will go up $8.90. RESOLUTION: 2016-269 Town of Wappinger Page 6 Printed 111312016 Regular Meeting Minutes October 24, 2016 Resolution Approving Preliminary Budget For Fiscal Year 2017 And Directing A Public Hearing Thereon WHEREAS, the Town Supervisor, as Budget Officer, pursuant to Section 106 of the Town Law has presented the Tentative Budget to the Town Board for review, examination and possible revision; and WHEREAS, the Tentative Budget for calendar year 2017 has been submitted to the Town Board in accordance with Town Law § 106; and WHEREAS, New York State Town Law § 108 requires that the Town Board must hold a public hearing on the Preliminary Budget on or before the Thursday immediately following the general election in November; and WHEREAS, Town Law § 109 requires the adoption of a Final Budget on or before November 20, 2016; and WHEREAS, the Town Board has reviewed the Tentative Budget and has made changes thereto deemed reasonable and appropriate and intends to adopt the Preliminary Budget herewith. RESOLUTION: 2016-273 Resolution Introducing Local Law No. 7 Of The Year 2016, Designating A Three-Way Stop At Intersection Of Carroll Drive And Davies Drive WHEREAS,in response to concerns raised by Town residents regarding speeding on Carroll Drive, and based on observations made at the intersection, the Engineer to the Town, in consultation with the Town Supervisor and the Town Highway Superintendent, has recommended that a"three-way stop" at the intersection of Carroll Drive and Davies Drive would have a calming effect on traffic. WHEREAS, the Town of Wappinger, Dutchess County, New York(the "Town"), has the power and authority to issue general obligation bonds of the Town for the purpose of, among other things, paying the cost of the emergency interconnection of the Tall Trees Water District to the United Wappinger Water District, prior to extension thereto to include the facilities of the Tall Trees Water District, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, pursuant to the provisions of the Town Law and the Local Finance Law of the State of New York (together, the"Act"); and Town of Wappinger Page 11 Printed 111312016 Regular Meeting Minutes October 24, 2016 WHEREAS, the Town Board is considering proceeding under the provisions of the Act to authorize, sell and issue its general obligation bonds and/or notes in anticipation thereof, to pay the cost of said specific object or purpose relating to such emergency work, subject to the terms and conditions to be set forth in one or more bond resolutions in an aggregate principal new money amount expected at this time not to exceed $120,000 to be adopted thereafter in accordance with requirements of the Act; and WHEREAS, the Internal Revenue Code of 1986, as amended, and the United States Treasury Department regulations promulgated there under (together, the "Code") require that an issuer who intends to reimburse itself for monies to be advanced and expended for a capital project from the proceeds of a debt obligation of the issuer, adopt a declaration of official intent to so reimburse not later than sixty days after the payment of any such original expenditures paid with such advanced monies; and WHEREAS, the Code provides that such declaration may be made in the form of a resolution of the issuer; NOW, THEREFORE, BE IT RESOLVED, by the Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. The Town Board of the Town hereby finds and determines: (a) By virtue of the Act, the Town has been vested with all powers necessary and convenient to carry out and effectuate the purposes and provisions of the Act and to exercise all powers granted to it under the Act. (b) It is the intent of the Town to authorize, sell and issue its general obligation bonds and/or notes in the aggregate new money principal amount presented not to exceed $120,000 (the "Bonds" and the "Notes") for the purpose of paying the cost of the emergency interconnection of the Tall Trees Water District to the United Wappinger Water District prior to the extension thereof to include the facilities of the Tall Trees Water District, in anticipation of said establishment of an extension to the UWWD to include Tall Trees Water District therein, as described herein (the"Project"), pursuant to the provisions of the Act. (c) It is expected that under Section 149(e) of the Code, interest on the Bonds and/or Notes will not be includable in gross income for federal income tax purposes. (d) In anticipation of the issuance of the Bonds and/or Notes, the Town hereby states its intention to reimburse general fund monies of the Town heretofore and hereafter expended in an amount not to exceed $120,000 in connection with the Project through the issuance of the Bonds and/or Notes, such reimbursement allocations to be made not later than eighteen months after the date the original expenditure is paid or such later date as may be permissible under the provision of the Code and such expenditure of general fund monies is hereby authorized pursuant to resolutions of this Town Board authorizing said Project. RESOLUTION: 2016-278 In The Matter Of The Establishment of Mid-Point Park Sewer District in the Town of Wappinger, Dutchess County, New York WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York(the "Town"), has duly caused to be prepared a map showing the boundaries of a proposed sewer district in said Town, to be known as Mid-Point Park Sewer District in the Town of Wappinger (hereinafter, the "Mid-Point Park Sewer District" or simply, the "District") a general plan to serve said District, and a report of the proposed method of operation thereof including capital improvements therefor and an estimate of cost thereof, and WHEREAS, said Map, Plan and Report, including an estimate of the cost, dated February 23, 2016, were prepared by Morris Associates Engineering Consultants, PLLC (the "February 2016 Report"), competent engineers duly licensed by the State of New York, and have been filed in the office of the Town Clerk of said Town, where the same have been available during regular office hours for examination by any persons interested in the subject matter thereof, including estimate of cost; and WHEREAS, on April 25, 2016, a public hearing was duly held to consider establishment of said District; and WHEREAS, it has since been determined that the proposed boundaries of said District as presented in said Map,Plan and Report included a parcel of land that was not connected to the Mid- Point Park Sewer System, said parcel being 1415 Route 376 in the Town of Wappinger, Tax ID No. 135689-6259-04-921040, it having been the intention of the Town Board that the boundaries of the proposed District only include parcels actually connected to the Mid-Point Park Sewer System; and WHEREAS, said parcel is prohibited from connecting to the Mid-Point Park Sewer System because of New York State Department of Environmental Conservation (NYS DEC) permit limitations and is therefore not benefitted by the proposed Mid-Point Park Sewer District; the Blue Fin parcel is described as tax grid parcel no. 6259-04-907028; and WHEREAS, the improvements proposed for said District consist of slip lining or relining of gravity sewer mains along Gabriella Drive in the vicinity of the boundary of the existing Mid-Point Park Wastewater Treatment Plant and related reconstruction work (which facilities were made an improvement of the Mid-Point Park Sewer Improvement Area in the Town of Wappinger held by the Town for the benefit of the properties therein by Order of the Town Board dated and duly adopted on June 10, 1974 pursuant to Article 12-C of the Town Law, an area conterminous with that of the District but for the addition of one parcel), including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, all as more fully described in the map, plan and report, as revised as hereinbefore described; and WHEREAS, the maximum estimated cost of said improvements is $280,000; and WHEREAS, said improvements are required pursuant to an Order on Consent between the Town and the State of New York Department of Environmental Conservation (Case No. R3- 20150210-16); and WHEREAS, the proposed method of financing the cost of said improvements consists of the issuance of not to exceed $280,000 serial bonds of said Town maturing in annual installments over a period not exceeding forty years, which will be payable in the first instance from an annual assessment upon the several lots or parcels of land in said District which the Town Board shall determine and specify to be specially benefitted thereby in proportion to the benefit derived therefrom, in the manner provided by law, in an amount sufficient to pay the principal and interest on said bonds as the same become due,but if not paid from such source, all the taxable real property in said Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds as the same shall become due and payable; and WHEREAS, the estimated cost of hook-up fees to the typical property in said District being a single family house is $0; and WHEREAS, the estimated cost of said District to the typical property, including capital charges and O&M costs, being a single family home therein, is $894 in the first year in which operation, maintenance, debt service and other charges and expenses are to be paid; and WHEREAS, a detailed explanation of the manner by which were computed said estimated costs of hook-up fees and first-year costs to typical property has been filed in the office of the Town Clerk at the Town Hall in Wappingers Falls,New York where the same are available during regular office hours for examination by any person interested in the subject manner thereof, and WHEREAS, said capital project has been determined to be a Type 11 Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act ("SEQRA") including 6 NYCRR Part 617.5(c)(2), (c)(5) and (c)(29), and , the implementation of which as proposed, the Town as Lead Agency has determined will not result in a significant environmental effect and SEQRA compliance materials are on file in the office of the Commission where they may be inspected during normal office hours, and the establishment of said District is likewise a Type 11 Action; and WHEREAS, it is now desired to call an additional public hearing upon the question of the establishment of said District and the improvements proposed therefor, all pursuant to Section 209-d and Section 209-e(2)(b) of the Town Law; Items for Special Consideration/New Business Superintendent Jiava presented the Town's long awaited Certificate of Occupancy for town hall. Councilman Beale recognized Joseph Cavaccini, a future recipient of the Franklin Roosevelt award to be presented on Thursday November 17th at the 2016 annual awards dinner of the Dutchess County Historical Society. XI. Budget Discussions 1. Highway Supervisor Jiava explained that lines A5110.407, A5110.408, and A5130.401 were changed. The board will consider his request for a stipend for his deputy. Highway Superintendent Bettina introduced his Deputy Highway Superintendent Frank Greggo. Frank served in Vietnam as a Marine, was a project manager with IBM, he ran construction management for Montrose and Castlepoint VA Hospitals, and he ran for the Highway Superintendent office in 2012. He added that he is buying road salt through a consortium with the county. He added that the Town will get an extra$44,000 from 'PAVE New York', a state program and should have $84,000 left over. Councilman Beale asked about CHIPS funding from the state specifically line item D135112.400 with year-to-date amount $241,000. Town Accountant Awino said this was 'PAVE NY' money.
