Local Law # 7 - Stop Signs on Carroll and Davies Resident Bill Dengler asked why there has to be a three way stop sign. Councilman Fenton replied that there could be a potential accident coming from Davies Drive. Mr. Dengler pointed out that most of the problem is cause by Carroll drive and people cutting trough to bypass the light at Hopewell and All Angels. Councilman Fenton re-addressed the need for the signs on Carroll Drive. Supervisor Jiava pointed out that it was the recommendation of the Engineer-To- The-Town and the Highway Superintendent. Mrs. Johnson from Rockingham questioned the enforceability of stop signs. Supervisor Jiava said that with a stop sign there it could then be enforceable and the town could post policeman at their pleasure. Supervisor Jiava promised patrol at the Rockingham stop signs for targetable enforcement. 3. Preliminary Budget Councilman Kuzmicz read a letter from resident Lou Di Cocco from the Edgehill development regarding Schlathaus Park and a capital plan. Letter Attached. Dear Town of Wappingers Board, My name is Louis DiCocco. I have lived in the Town for more than 50 years and I am here to speak on behalf of the residents of Edgehill Manor and the Town as a whole. For more than 3 years, I have been a volunteer member of the Town's Recreation Committee. In that regard, I have been assigned to make regular visits and reports related to all of the facilities associated with Martz Field and Schlathaus Park about the safety, aesthetics,perceived needs and suggestions for betterment. As a result of several meetings with the Supervisor, Ralph Holt, Chairperson of the Recreation Committee and Councilman, Mike Kuzmicz, and as requested by the Supervisor, I have submitted a list of priorities culled from the 2014 - 2016 reports. This includes an accumulation of long standing tasks,jobs etc. that need to be completed at Schlathaus Park. FOR THE FIRST TIME IN THE PAST 3 YEARS, I AM OPTIMISTIC VIA THE BOARD'S APPARENT COMMITMENT TO IMPROVING ALL ASPECTS OF SCHLATHAUS PARK WITH A CAPITAL PLAN THAT THE BOARD DISCUSSED IN OCT. 2016. Due to past experiences,please understand my reservations and cautious optimism regarding the actual finalization and implementation of the'PLAN'. However, based upon what I have recently perceived, there appears to be a clear unity of purpose with Board members working as a team to address the concerns identified. Please be aware that the community has the expectation that the 'PLAN' -long overdue, will be put into action at the earliest date and the chairperson will be kept informed and aware of possible concerns and progress with an on-going commitment to restore Schlathaus so that this historical park can be upgraded to an exemplary condition. This should be the direction we take so the Town can be proud of ALL Wappingers facilities. Please advise me if I can be of any further assistance toward the goals of revitalization and beautification of our community. Resolutions RESOLUTION: 2016-281 Resolution Adopting Local Law No. 7 Of The Year 2016, Designating A Three-Way Stop At Intersection Of Carroll Drive And Davies Drive WHEREAS, a Resolution was duly adopted by the Town Board of the Town of Wappinger introducing a proposed Local Law entitled "Local Law No. 7 of the Year 2016, Designating a Three-Way Stop at the Intersection of Carroll Drive and Davies Drive" for consideration of adoption by the Town Board; and WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News and the Poughkeepsie Journal, the official newspapers of the Town; and WHEREAS, a Public Hearing was held on November 9th, 2016 and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof, and WHEREAS,the Town Board determined that the proposed Local Law was not subject to environmental review; and WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds that it is in the best interest of the Town to adopt said Local Law; and WHEREAS, said Local Law has been on the desks of the members of the Town Board of the Town of Wappinger for at least seven (7) days, exclusive of Sunday, prior to the adoption of this Resolution. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board of the Town of Wappinger hereby adopts the Local Law entitled "Local Law No. 7 of the Year 2016, Designating a Three-Way Stop at the Intersection of Carroll Drive and Davies Drive", a copy of which is attached hereto and made a part of this Resolution. 3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting into the Local Law book for the Town of Wappinger and to give due notice of the adoption of said Local Law to the Secretary of State of New York. 4. Highway Superintendent, Vincent F. Bettina, is hereby further directed to place stop signs at the appropriate locations in accordance with this Local Law and to take any other necessary actions to implement the above mentioned stop intersections as required in accordance with the spirit and intent of this Local Law. VII. New Consideration Councilman Fenton brought up a drainage issue on Route 9 in front of the new Dunkin Doughnuts. Supervisor Jiava said it is a State issue and they are taking care of it. 1. Motion To: Approve Purchase of New Parking Lot Lights for Town Hall and the EMS Building Steve Frazier passed out bids for lighting at the town parking lot. Nothing was given to the town clerk. He said there is a 10% discount on items that would provide stronger lights and install them himself. To get the discount he would need to order by the afternoon on November 10th. He added there are 19 lights at town hall and 10 at the EMS building. CL Section H: Legislative Intent: 0 In response to concerns raised by Town residents regarding speeding on Carroll Drive, and based on observations made at the intersection, the Engineer to the Town, in consultation with the Town Supervisor 0 as and the Town Highway Superintendent, has recommended that a "three-way stop" at the intersection of 00 Carroll Drive and Davies Drive would have a calming effect on traffic. cm The Town Board, after examination of the facts and circumstances, and the recommendation of Baa Highway Superintendent,Vincent F. Bettina, and Engineer to the Town, Robert J. Gray,has determined that as it is in the best interest of the citizens of the Town of Wappinger to revise the Town's Vehicles and Traffic Code §230-43 "Schedule IX: Stop Intersections" and to designate a three-way stop at the intersection of Carroll Drive and Davies Drive as hereinafter described. Section III: Ston Intersection: 0 The Town of Wappinger Code §230-43 is hereby amended by alphabetically inserting into Schedule e IX the following designated full stop intersection: cm Direction "Stop Sign on of Travel At Intersection of 7@ Carroll Drive Both Davies Drive 0 Davies Drive South Carroll Drive." ams E Packet Pg. 6 6.1.a Section IV: Ston Sign: The Town Board hereby directs the Highway Superintendent to place a stop sign at each intersection as follows: as • On Carroll Drive eastbound, at its northwest intersection with Davies Drive; • On Carroll Drive westbound, at its northeast intersection with Davies Drive; and • On Davies Drive southbound, at its southwest intersection with Carroll Drive. I- 6 Section V: Numbering for Codification: 3 It is the intention of the Town of Wappinger and it is hereby enacted that the provisions of this Local 7@ U Law shall be included in the Code of the Town of Wappinger; that the sections and sub-sections of this Local j pp Law may be re-numbered or re-lettered to accomplish such intention; the Codifier shall make no substantive 0 changes to this Local Law; the word "Local Law" shall be changed to "Chapter", "Section" or other appropriate word as required for codification; and any such rearranging of the numbering and editing shall 0 not effect the validity of this Local Law or the provisions of the Code effected thereby. 00 Section VI: Separability: e The provisions of this Local Law are separable and if any provision, clause, sentence, subsection M co word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or as circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall not affect or impair any of the remaining provisions, clauses, sentences, subsections,words or parts of this local law or > their application to other persons or circumstances. It is hereby declared to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law would have been adopted if such illegal, 0 invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been included M e therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom. 3 Section VI: Effective Date: 7@ U This Local Law shall take effect immediately upon adoption and filing with the Secretary of State 0 as provided by the Municipal Home Rule Law.
