AYF Cheerleading Supervisor Jiava recognized the AYF Cheerleaders in attendance and their accomplishments. She offered 2 proclamations for two divisions. She read that on October 26th, 2016 the Wappingers Falls AYF Cheerleaders competed and had division 10 girls placing 2nd and division 14 girls also placed 2nd and is being declared our local town winners. Motion To: Open Public Portion Dutchess County Legislator Joseph Incoronato addressed the board. He said, "I'm here on behalf of Highway Superintendent Vincent Bettina who had some medical testing done this afternoon and who called me a few hours ago to come before the board on his behalf. What I want to read into the minutes is essentially this challenge of the decision of this board, or the resolution before this board to eliminate two positions in the highway department. I'm just going to give the highlights but I'll leave the full text of the letter to the Clerk to distribute to the Town Board. Mr. Bettina's concern that again, that the town board is preparing to adopt resolutions at the town board meeting tonight this evening. This time interfering with his administration of the mechanic title and budget reduction for the Mechanic Equipment Operator. Mr. Bettina objects to the adoption of these measures because they are unsafe to workers and destructive of his statutory authority to maintain all of the roads under his jurisdiction and the personnel necessary to maintain the equipment essential to his duty to maintain as set forth in the Highway Law section 140. And, then he cites case law, Ballard versus Clarkstown on page 5. This letter is from his attorney by the way, Daniels, Porco and Lusardi. It goes to David Wise the labor attorney to the town board. And, it says Dear Mr. Wise; we respectfully disagree with your view that the collective bargaining unit and the town board are free to set aside statutes that reserve to the Highway Superintendent authority to hire, fire, and discipline highway department employees. And, then again he shows case law decision of the Rockland County Supreme Court in Ballard verses the Town of Clarkstown." Supervisor Jiava interrupted and said, "Mr. Incoronato, I don't want to interrupt you but that letter you're referring to has to do with the MOA and the CSEA, it has nothing to do with these two resolutions. The letter from Brian Morgan says the town of Wappinger Highway Department Memorandum of Agreement was ratified on November third, that's what this letter refers to. The resolutions were budgetary; this has to do with the letter, their'aside' letter of their collective bargaining agreement." Mr. Incoronato said, "You are decimating two people, you are eliminating two people." Supervisor Jiava, interjected, "but that has nothing to do with the Memorandum of Agreement and I'm not saying that, it's just, that's not an agenda item, that's a negotiations and it's confidential, and I really don't want to disclose that." Mr. Incoronato said, "this is coming from the elected highway superintendent and I think has a right to provide...". Supervisor Jiava interjected, "but public comment would be to agenda items and the Memorandum of Agreement is not an agenda item this evening. If you want to speak about the resolutions." Mr. Incoronato added, "I did reference the resolutions, this is my delivery to the Town Board, I'm not asking for you to divulge anything proprietary and we have the authority and permission of Daniels, Porco and Lusardi to present this." Supervisor Jiava asked, "What agenda item does that have to do with?" Mr. Incoronato replied, "The two resolutions. You are reducing the mechanic position to an equipment operator." Supervisor Jiava interjected, "but the Memorandum of Agreement has nothing to do with the changing of the structure." The discussion ended with Mr. Incoronato handing the letter to the Town Clerk who in turn distributed to the Town Board as Mr. Incoronato requested. Supervisor Jiava summarized by saying, "We received this today November 28th at 4:06 PM and this has to do with the ratification of their'aside' letter with the Collective Bargaining Agreement in which the facts, it was changes to certain things in their contract in which he was saying that it wasn't statutory for the highway superintendent and it is protected under the Taylor law, but that's negotiations and were not going to discuss that in public." Motion To: Approve a Recreation Volleyball Program Mr. Ralph Holt approached the board to suggest a new Volleyball program. He found Oak Grove elementary school to hold it. He suggested two sessions from 6-8 PM. The first is for instruction, the second for those who know how to play the game. The fee would be $65 for residents and $80 for non-residents. He said there will be no expense to the town. He said the revenues that would be taken in would be more than enough to cover the program. The discussion covered where and what budget lines would be impacted. Allocation of Tax Bill -Pie Chart The following chart was added to the record to demonstrate the portions of total property taxes to all the many taxing entities. Councilman Beale indicated that the school tax rate is yet to be updated. He also pointed out that the county gets another $45,000 from our tax payers to run their office and thus our tax rate appears a penny or two less. He added that the 'Tax Rate' for Wappinger has a lower'Tax Rate' than neighboring school districts of Arlington and Hyde Park. Resolutions RESOLUTION: 2016-293 Resolution Adopting Certificate Of Base Percentages, Current Percentages, Current Base Proportions And Certificate Of Adjusted Base Proportions From The New York State Office Of Real Property Services WHEREAS, the Town CAP Assessor has prepared a Certificate of Base Percentages, Current Percentages, Current Base Proportions and Certificate of Adjusted Base Proportions for the 2016 Assessment Roll for submission to the New York State Office of Real Property Services (hereinafter"Certificate"); and WHEREAS, the Town CAP Assessor has attested to the accuracy of the aforementioned Certificate which has been prepared pursuant to RPTL Article 19 and shall be used for the levy of taxes on the 2016 Assessment Roll, a copy of said Certificate is attached hereto. RESOLUTION: 2016-295 Abolishing Position Of Automotive Mechanic & Appointing Employee To Motor Equipment Operator WHEREAS, the Town Board has previously created three civil service non-competitive positions of Automotive Mechanic; and WHEREAS, it has been determined that the Town requires the services of only one Mechanic; and WHEREAS, one of the Automotive Mechanic positions is presently vacant; and WHEREAS, the least senior of the two Automotive Mechanics currently employed within the Town Highway Department is John George; and WHEREAS, the Highway Department has one unfilled vacancy for the non-competitive position of Motor Equipment Operator within the Town Highway Department; and WHEREAS, John George is qualified for the position of Motor Equipment Operator; and WHEREAS, the Town requires the services of an additional Motor Equipment Operator; and WHEREAS, the compensation for Motor Equipment Operator is less than that for Automotive Mechanic, pursuant to the terms of the collective bargaining agreement between the Town and CSEA Local 100 ("CSEA collective bargaining agreement"); NOW, THEREFORE, BE IT RESOLVED, as follows: 1. Two positions of Automotive Mechanic are hereby abolished. 2. John George, the least senior of the two Automotive Mechanics employed with the Town Highway Department, is appointed to the position of Motor Equipment Operator. 3. John George shall be compensated as Motor Equipment Operator at the rate of pay for such position as set forth in the CSEA collective bargaining agreement for the same Step as the Step he presently holds as an Automotive Mechanic. 4. Fenton, Councilman AYES: Jiava, Beale, Ciccarelli, Fenton, Kuzmicz RESOLUTION: 2016-299 Resolution Reintroducing A Local Law Which Amends Chapter 240,Zoning, Of The Town Code With Respect To A Variety Of Planning And Zoning Matters WHEREAS, on April 27, 2015, the Town Board by Resolution 2015-115 adopted Local Law 1 of 2015 entitled "A Local Law for the Purpose of Amending Chapter 240, Zoning, of the Town Code with Respect to a Variety of Planning and Zoning Matters"; and WHEREAS, on May 4, 2016, 1336 Route 9, LLC commenced a declaratory judgment action against the Town of Wappinger in the Supreme Court of the State of New York, County of Dutchess under Index Number 2016-50953 that sought to have Local Law 1 of 2015 declared as null and void because the referral to Dutchess County Planning was defective; and WHEREAS, the Town of Wappinger made a motion to dismiss the lawsuit as being barred by the applicable Statute of Limitations and for lack of standing however that motion was denied; and WHEREAS, the Town of Wappinger has determined that it is appropriate to resubmit a full statement of the proposed action to Dutchess County Planning and Development which includes the proposed Local Law together with the completed Environmental Assessment Form as required by General Municipal Law § 239-m which would moot the declaratory judgment against the Town; and WHEREAS, the Town of Board of the Town of Wappinger has determined that Local Law 1 of 2015 should be amended by removing the last sentence of Section 3, Paragraph 5, Town of Wappinger Page 20 Printed 1212212016 Regular Meeting Minutes November 28, 2016 Subparagraph x which adds gasoline filling stations as a special permit use in the SC Zoning District; and WHEREAS, on April 27, 2015 by Resolution 2015-115 the Town Board adopted a negative declaration with respect to Local Law 1 of 2015; and WHEREAS, the noted amendment to the proposed Local Law is at least as protective of the environment as Local Law 1 of 2015; NOW, THEREFORE, BE IT RESOLVED,AS FOLLOWS: 1. The Town Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein. 2. The Town Board hereby determines that the proposed Local Law is as protective of the Local Law as Local Law 1 of 2015 and for purposes of the SEQRA Regulations (6 NYRCRR Part 617) , the re-adoption of the proposed Local Law is part of the same action as the adoption of Local Law 1 of 2015 and the Negative Declaration issued by the Town Board as lead agency on April 27, 2015 is reaffirmed, remains valid and has full force and effect. 3. The Town Board hereby introduces for consideration of its adoption proposed Local Law No. 1 of 2017 in the form annexed hereto. 4. The Town Board hereby schedules a Public Hearing regarding the adoption of the annexed proposed Local Law No. 1 of 2017 for 7:30 PM on the 23rd day of January, 2017 and the Town Clerk is hereby directed to post the notice of the Public Hearing in the form annexed hereto and to publish same in the Southern Dutchess News and the Poughkeepsie Journal not less than ten (10) days prior to said Public Hearing date. 5. The Town Board hereby directs the Town Clerk to act as follows with respect to the proposed Local Law: a. To serve a copy of this resolution, the annexed proposed Local Law, and the public hearing notice to the municipal clerk of each abutting municipality not less than ten (10) days prior to said public hearing; b.
