The applicant will be subject to buy in fees and the water and sewer lines that the applicant has constructed will have the capacity required to handle the expected usage. RESOLUTION: 2016-246 Resolution Authorizing A Public Hearing On The Intended Use Of Dutchess County Community Development Block Grant Funds And The Submission Of The Grant Application For Fiscal Year 2017 WHEREAS,the Dutchess County Department of Planning and Development is soliciting applications for the 2017 Community Development Block Grant Program; and WHEREAS,the Town of Wappinger intends to make application for a Community Development Block Grant pursuant to the Dutchess County Department of Planning and Development's Community Development Block Grant Program for fiscal year 2017; and WHEREAS,the Town of Wappinger is required to hold a Public Hearing to discuss the Town's intended use of Community Development Block Grant Funds prior to and in furtherance of making application for said funds. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. RESOLUTION: 2016-249 Resolution Scheduling Town Board Meetings To Adopt Budgets For Fiscal Year 2017 Town of Wappinger Page 9 Printed 101712016 Regular Meeting Minutes September 26, 2016 WHEREAS, the Town Supervisor, as Budget Officer, pursuant to § 106 of the Town Law, has prepared the Tentative Budget for delivery the Town Board for review, examination and possible revision; and WHEREAS, said Tentative Budget will be submitted to the Town Clerk on or before September 30, 2016, as required by law; and WHEREAS, a Special Town Board meeting will be scheduled for Wednesday, October 5, 2016 at 7:30 p.m. for the purpose of having the Town Clerk deliver the Tentative Budget to the Town Board in accordance with Town Law § 106; and WHEREAS, New York State Town Law § 108 requires that the Town Board must hold a public hearing on the Preliminary Budget on or before the Thursday immediately following the general election in November; and WHEREAS, Town Law requires the adoption of a Final Budget on or before November 20, 2016; and WHEREAS, in order to accomplish the Budget Adoption Schedule set forth in Article 8 of the Town Law, the Town Board hereby establishes the following tentative schedule of Town Board Meetings set forth below, reserving unto itself the right to change the scheduled meetings if circumstances require. X. Items for Special Consideration/New Business Councilman Fenton addressed the speeders on Central Avenue and Kent Road. Councilman Kuzmicz recommended to get together with Sargent Begor to discuss the enforcement of speeders, adding that stop signs without enforcement are in-effective. Resident Terry Clayton of 13 Plaza Road recommended putting speed traps at that location at the opening and closing of the local high school when students are speeding through. Councilman Beale argued that it's the residents in that area that are doing the speeding and should not be given a pass. Councilman Kuzmicz added that the law should be applied to town highway employees driving town vehicles that have been cited running through the stop signs. Councilman Beale objected to tickets being given to highway employees citing safety issues of such large vehicles stopped on the roadside; however,he recommended an email be sent to highway employees to remind them to follow the vehicle policy with a zero tolerance. 1. This agreement represented that the subject property would not need more than 320 gallons per day of water which was based on the use of the property at e that time as a three-bedroom single family residence. The connection was accomplished by the construction of a privately owned water service and co UJI sewer lateral through private easements that were negotiated with adjacent involved properties by the owner of the subject property. The cost of the installation was borne exclusively by the owner of the subject property. The single family residence has since been razed and there is a current application before the Town Planning Board requesting site plan approval for a new building with thirteen one- 0 bedroom apartments, one three-bedroom apartment and a laundromat with four washing machines. e The proposed new use is expected to use no more 1,760 gallons per day for the apartments, based on the Dutchess County Health Department Standard of 110 gallons per day per bedroom. The laundromat is expected to use no more than 400 gallons per day based upon studies indicating a typical laundromat will experience six to eight turns per day per machine, and the manufacturer's information for the water use per turn(11.9 gallons) for the proposed eighteen- pound front load washing machines. The total use is not expected to exceed 2,160 gallons per day. It is our understanding, as asserted by the Town Engineer,that the Town water and sewer systems have sufficient capacity to accommodate the additional 1,840 gallons (2,160 gallons— 320 gallons) of water demand and sewage discharge from this project. The original district extension agreement included provisions that require the owner to pay buy in fees for any Packet Pg.41 5.1.a additional capacity above the original 320 gallons per day. The fee for the proposed residential use would be $1,000 per one bedroom apartment for water and$1,500 per one bedroom apartment for sewer. The proposed three-bedroom apartment fee would be $3,200 for water and $4,800 for sewer, which is the same as the fee that would be paid for a three-bedroom single family residence. The fee for the commercial use would be$10 per gallon for water and$15 per gallon for sewer, totaling$4,000 and$6000 respectively for the commercial use of 400 gallons per day. The total buy in fee is $42,500,based on the numbers above and subtracting the fee for the three-bedroom apartment, which is to be credited for the prior payment for the single family residence. The Planning Board has requested that we submit this information to the Town Board for its review and acknowledgement in writing that the additional water and sewer capacity outlined above will be authorized for the subject property upon payment of the buy in fee. Activities may not begin construction until the environmental review is complete. City of Beacon Annual Allocation -The City of Beacon receives 15% of the annual CDBG allocation after the deduction of the County's administrative expenses. All program guidelines apply to the City's activities with the exception of maximum grant award and number of applications submitted. Public Service Activities— Up to 15% of the annual allocation, after the deduction of the County's administrative expenses, may be set aside for public service activities. If a public service agency is applying 2 for a construction activity, that is considered a municipal activity and must be sponsored by the municipality in which the activity is located. Parties interested in non-construction public service activities should apply directly to the CDBG Public Service or Agency Partner Program using the APG/CDBG Public Service Application. •2 Procurement Requirements-All activities are subject to Federal and County Procurement Policies and Procedures. This generally includes public bidding and prevailing wages. Applications that lack required items or contains a technical error will be notified by email and given ten (10) calendar days to correct the error. Failure to submit the missing items by the deadline will result in ineligibility. The application process is competitive. Applications are reviewed based on the below considerations. A site visit and staff evaluations are conducted. Preliminary staff funding recommendations are presented to the CDAC. The CDAC reviews the staff recommendations and requests additional information if necessary. CDAC funding recommendations are sent to the County Executive for final approval. Review Considerations The staff will begin the evaluation of each activity by asking: 1. Is the proposed activity eligible under HUD CDBG guidelines? 2. Does the activity address a HUD National Objective (Low/Mod Benefit)? If the activity does not meet these first two criteria it is ineligible. Questions 3 through 12 aid in further evaluation and development of funding recommendations. 1. Does the proposed activity meet a priority of the 2013-2017 Consolidated Plan? 2. Does the activity benefit a substantial number of low to moderate income persons? 5. Is the estimated completion time for the activity realistic and allow for completion by the deadline? 6. Does the proposed activity build on previous investments or is it part of a larger development plan? 7. Does the municipality have outstanding CDBG funds? 8.
