IV. Discussion
A. Amending the award bid to Basec Corporation for the Emergency Services Building.
The purpose of this Saturday Morning December 31st meeting was to transfer monies to cover
the additional option 1 for the windows replacement project before the year end.

WHEREAS,the Town Board authorized the Engineer to the Town, Morris Associates
Engineering and Surveying Consultants, PLLC, to solicit bids for the replacement of windows in
Town Hall; and
WHEREAS,bids were duly solicited and the following bids were received on December
19, 2016 as follows:

Basec Corp. $ 95,600 $17,400 $12,740; and
WHEREAS,by email dated December 20, 2016 from Inez Maldonado on behalf of
Supervisor Lori A. Jiava, it was requested that only Option 2 (replacement of the skylight)be
chosen as part of the award; and
WHEREAS,it was determined that the lowest responsible bidder was Basec Corp., with
a base bid in the amount of$95,600 and with a bid in the amount of$12,740 for Option 2; and
WHEREAS, on December 21, 2016, the Town Board, by Resolution No. 2016-313,
awarded the bid for the replacement of windows in Town Hall to Basec Corp., with the base bid
in the amount of$95,600 and an Option 2 bid in the amount of$12,740 for a total bid award of
$108,340; and
WHEREAS, on December 22, 2016, Manny Cauchi of Basec Corp. contacted Engineer
to the Town, Robert J. Gray, indicating that Basec Corp. misunderstood the bid requirements for
Options 1 and 2 and made a substantial error in calculating its bid proposals for Options 1 and 2
and requested that its bid proposal be withdrawn because of that error; and
WHEREAS,the matter was turned over to the Attorney to the Town, Albert P. Roberts,
who contacted Manny Cauchi, who advised that the error was caused by including some of the
costs for the base bid in Option l; and
WHEREAS, said Manny Cauchi indicated that if the Town accepted both Option 1 and
Option 2 that Basec Corp. would withdraw its request to have its bid withdrawn; and
WHEREAS,it is to be noted that the bid submitted by Basec Corp. with a base bid of
$95,600 with an Option 1 bid in the amount of$17,400 and a bid for Option 2 in the amount of
$12,740, totaling $125,740 was less than the base bid for the next lowest bidder; and
WHEREAS, on reflection, the Town Board determines that the lowest responsible
bidder is still Basec Corp., with a base bid amount of$95,600, an Option 1 bid in the amount of
$17,400 and an Option 2 bid in the amount of$12,740.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby amends its award to Basec Corp. for the replacement of
windows in Town Hall to Basec Corp., by awarding Basec Corp. the base bid amount of
$95,600, as well as the Option 1 bid in the amount of$17,400 and the Option 2 bid in the amount
of$12,740 for a total bid award in the amount of$125,740.
3. Except as herein modified, the Town Board reconfirms Resolution No. 2016-313.
4. In accordance with the bid specifications, the Town Board hereby authorizes the
Supervisor to execute the contract documents as prepared by Morris Associates Engineering &
Surveying Consultants, PLLC, including the Notice of Award and Notice to Proceed and forward
a copy to Basec Corp., after the Attorney to the Town has confirmed that Basec Corp., has duly
executed the contract documents, has supplied the necessary Performance Bond, Payment Bond
and insurance certificates all as otherwise specified by the bid specifications.

In order to accommodate the increase in the contract price, the Town Board authorizes $15,000
to be moved from A5132.401 (garage repairs)budget line to A1620.482 (Town Hall Building
Repairs)budget line.
