Public Hearing Resolution Introducing Local Law No. 1 Of 2015 Which Would Amend Chapter 240, Zoning, Of The Town Code With Respect To A Variety Of Planning And Zoning Matters The Public Hearing was open. Attorney Richard Cantor representing resident Wendy Smart of River Road North asked the board to amend page 17 regarding the Application of the new Local Law 41 for 2015 because it would adversely affect her filed application for a sub -division. He asked that the section which exempts applications for site plans that are in progress, include sub- divisions. He asked that the section read, "The zoning amendments herein shall not apply to any property for which an application for site plan or sub -division approval has been properly filed with the Town of Wappinger as of the effective date of this local law." The board agreed to amend the proposed local law when the resolution was to be voted on later in the meeting. Public Portion 1. Motion To: Open Public Portion Resident Schmalz addressed the board to address the $15,000 awarded by the town at the August 11th, 2014 meeting to explore a site to expand the Robinson lane complex northward to include football fields for the Wappinger Indians football organization that now is looking for more money to explore the lands to the south of the complex. She informed them that Pop Warner football, in over 50 years in this town helping kids in football and cheer leading, did not cost the town one cent. She added that not only did they NOT accept any subsidy; they also took care of the fields, built the field house, and took care of it. She asked why the land owner of the lands to the south of the Robinson Lane complex is donating the land and what will thev get in return. Discussions 1. Motion To: Allow Supervisor to sign the Stormwater Management plan presented by Walter Artus Town of Wappinger Page 3 Printed 51712015 Regular Meeting Minutes April 27, 2015 2. 1. Walter Artus came before the board to inform them that this year's storm management report is complete for the period March 10, 2014 through March 9th 2015. He summarized that this year's report is consistent with last year's report. The New York State DEC was to come out with a new MS4 2015 permit that has been delayed one year. They did adopt a new construction permit that would effect the planning board review process. Supervisor Gutzler asked the board for authorization to sign the report. Beale, Councilman SECONDER: Ismay Czarnecki, Councilwoman AYES: Gutzler, Beale, Ciccarelli, Czarnecki, Kuzmicz Wappinger Hazard Mitigation Plan Zoning Administrator Barbara Roberti came to update the board on what the town is doing with regard to the County Hazard Mitigation Plan. She informed the board that the county is doing this plan for the entire county including towns, villages, and cities. The town of Wappinger has done their first submission on time and now they are working on the next submission. She has asked a representative from the Highway department, the Code Enforcement officers, Walter Artus the Storm Water Management representative and anyone who can help fill out these forms. She pointed out that Councilman Beale in his role as Dutchess County Assistant Emergency Response Coordinator for Emergency Management is heading this up for the county. Councilman Beale said that, "From the county perspective, this is federal grant money that was received by Dutchess County, $225,000 to create a Hazard Mitigation plan for the county, but we opted to include each municipality in this process so that each municipality would become an annex to the county plan, which is the proper way to do it. Every town, village and city is involved in this process, the town of Wappinger, I've maintained a little bit of distance since I am the county emergency manager overseeing the whole county plan." He added, "It's going to be beneficial because basically what this does is this allows our town to become eligible for federal mitigation funding. If we did not have a plan we would not be entitled to federal mitigation funding. By participating in this process, that allows us to be entitled to that." Supervisor Gutzler noted that this is an 18 month process condensed to 9 months. Councilman Beale added that this data must be submitted by June 18th to FEMA. He added that. "We will be having a workshop with FEMA in the month of May." He added that the FEMA representatives will be offering their advice in a workshop to correct anything that may not be up to par. He added that hopefully this will be approved in early 2016. Beale, Councilman SECONDER: Michael Kuzmicz, Councilman AYES: Gutzler, Beale, Ciccarelli, Czarnecki, Kuzmicz RESOLUTION: 2015-115 Resolution Adopting Local Law No. 1 Of 2015 Which Would Amend Chapter 240, Zoning, Of The Town Code With Respect To A Variety Of Planning And Zoning Matters WHEREAS, the Town Board is considering the adoption of Local Law No. 1 of 2015 which would amend Chapter 240, Zoning, of the Town Code with respect to a variety of planning and zoning matters; and WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the Southern Dutchess News and the Poughkeepsie Journal as required by law; and WHEREAS, a Public Hearing was held on April 27th, 2015 and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof, and WHEREAS, the Town Board has determined that the Proposed Action is a Type I action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA") and pursuant to Chapter 117 of the Town Code (the Town's Environmental Quality Review (WEQR) Law which establishes locally designated Type I actions); and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action. WHEREAS, in accordance with Section 240-112 of the Town Zoning Law, the Town Board referred the proposed Local Law to the Town Planning Board for its advisory opinion; and WHEREAS, in response to said referral, the Town Planning Board recommended the adoption of the subject Local Law; and WHEREAS, as in accordance with Sections 239-1 and in of the New York State General Municipal Law, the Town Board referred the proposed Local Law to the Dutchess County Department of Planning and Development (DCDPD) for its advisory opinion; and WHEREAS, in response to said referral the DCDPD provided comments to the town board and recommended that the board rely upon its own study of the facts in the Town of Wappinger Page 5 Printed 51712015 Regular Meeting Minutes April 27, 2015 case with due consideration of their comments; and WHEREAS, the Town Board has given due consideration to the comments of the Town Planning Board and the DCDPD; and WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds that it is in the best interest of the Town to adopt said Local Law; and WHEREAS, said Local Law has been on the desks of the members of the Town Board of the Town of Wappinger for at least seven (7) days, exclusive of Sunday, prior to the adoption of this resolution. NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: 1. The Town Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein. 2. Pursuant to the State Environmental Quality Review regulations, the Town Board hereby adopts the attached Negative Declaration for the reasons stated therein, thereby finding that the proposed Local Law will not result in any significant adverse environmental impacts, and consequently finding that a Draft Environmental Impact Statement will not be required and that the SEQRA process is therefore complete. 3. The Town Board, after due deliberation, finds that it is in the best interest of the Town to adopt said Local Law, and the Town Board hereby adopts Local Law No. 1 of 2015, a copy of which is attached hereto and made a part of this Resolution; except as specifically modified by the amendments contained therein, the Town Code, as originally adopted and amended from time to time thereafter, is to remain in full force and effect. 4. The Town Clerk is directed to enter said Local Law in the minutes of this meeting into the Local Law book for the Town of Wappinger and to give due notice of the adoption of said Local Law to the Secretary of State of New York. The Resolution is hereby duly declared Adopted as RESOLUTION: 2015-116 Change of Speed Limit on Baxtertown Road WHEREAS, the Town Board of the Town of Wappinger is concerned about the number of motor vehicle accidents occurring on Baxtertown Road (CR 34); and WHEREAS, the Town Board of the Town of Wappinger would like to see a reduction in the speed limit on a section of Baxtertown Road, Town of Wappinger, Dutchess County, New York or other measure implemented to improve traffic safety; and WHEREAS, the Town Board of the Town of Wappinger believes that maintaining a thirty-five Mile Per Hour speed limit throughout the length of Baxtertown Road that traverses the Towns of Wappinger and Fishkill, thereby reducing the current Fifty-five Mile per hour speed limit will help reduce the accidents that occur on that road; and WHEREAS, said speed limit change is in the best interests of the citizens of the Town of Wappinger, Dutchess County, New York; NOW, THEREFORE BE IT RESOLVED, the Town Board of the Town of Wappinger endorses the reduction of the speed limit on Baxtertown Road (CR 34) to a uniform 35 miles per hour. RESOLUTION: 2015-117 Resolution Authorizing Agreement To Study Property WHEREAS, an owner of a parcel of real property in the Town of Wappinger has expressed a willingness to donate a portion of its property to the Town of Wappinger for recreational purposes; and WHEREAS, in order to evaluate the usefulness of the donation to the Town of Wappinger, a study of the property needs to be conducted by the Town; and WHEREAS, the prospective donor has requested that the Town of Wappinger hold it harmless against any claims that might be incurred as a result of a study of the property; and WHEREAS, the location of the property and the identity of the owner is not disclosed Town of Wappinger Page 7 Printed 51712015 Regular Meeting Minutes April 27, 2015 because public discussion of the proposed acquisition may substantially affect the value of the property and public disclosure is not required by the Open Meetings Law (Public Officers Law § 105(1)(h)). NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby authorizes the Engineer to the Town, the Attorney to the Town and any other necessary Town Officers, or its agents, to study the property offered for donation to determine its suitability for use by the Town. 3. The Town Board agrees to indemnify and hold harmless the potential donor from any claims that result from the agents of the Town entering onto the property and conducting the study. 4. The Town Board authorizes the Attorney to the Town to finalize the letter agreement with the potential donor which grants the Town the right to enter onto the property to conduct a study and in return the Town indemnifies and holds harmless the potential donor and further authorizes the Supervisor to execute such letter agreement on behalf of the Town. The Supervisor and the Attorney to the Town are further authorized and directed to take whatever steps are reasonable and necessary to implement the provisions of this Resolution. Board Items Parks Supervisor Frazier noted that a vandal at Rockingham Park has been caught and has been sentenced to town community service. He also talked about converting bleachers from wood to aluminum. He added that while it would be at a considerable cost, it would save money in the long run due to their longevity and reduced maintenance. He suggested a program to obtain sponsors for the bleachers donated by local businesses. Mr. Frazier also spoke about the Beautification signs and the need to coordinate with the new highway superintendent. Councilwoman Czarnecki asked about a tree removal which was confirmed by Mr. Frazier. Councilman Bettina asked about putting cameras at all of the park facilities. Engineer Gray updated the Martz Field Pavilion status informing that the plywood is being installed, the shingles ordered, and the concrete floor will follow. We are currently registering for summer camp, fishing, tennis, and basketball. Most of these programs begin in the first couple of weeks in July and run through the first week in August. We have funding in 2015 for two additional late summer programs, and currently have nothing scheduled in those spots. I am looking for permission to explore the options for filling these two spots with programs that would run in the last part of the summer, into early fall. The first program spot available is line A7140.118 Tai Chi. Last year, the Tai Chi line was created to take the place of our volleyball program. I would like to a — - request that we do- not run the Tai Chi program this yearandinstead revive our volleyball program (A7140.106). At our athletic fields at Martz, we have two beach volleyball courts. Rather than reserve a gym, at one of the district schools, I would like to hold this program at Martz Field. This will save us the cost of having to pay school custodians after hours and will highlight one of our athletic facilities. The second program spot available was previously held by our twirling program (A7140.113). Our twirling instructor Melanie Rottkamp has decided to retire and will not be available for this year. Over the short time that I have been Recreation Director, one of the main concerns that I have heard from residents is that we have no programs targeted to teens. I am proposing starting a teen dance class to take the place of twirling. The class would be open to teens aged 13-17. I would like to request the transfer of $500 from line A7140.188 (Tai Chi) to line A7140.106 (Volleyball). I would also like to request permission for our town Packet Pg. 38 accountant to set up a new budget line for our proposed teen dance class and transfer $1,800 from A7140.113 (twirling) into the new'line. Finally, I would like to request permission to advertise for athletic instructors in our two local newspapers, and on our town website. The proposals will be reviewed by the recreation department. If we cannot find an instructor with an appropriate curriculum whose rate falls within our budgeted amount, we will not run the program. STORY, HALF — A story immediately under a sloping roof where less than 50% of the story's floor area has a height of seven feet or more between the surface of the floor and bottom of the roof beams. 2. The following new definitions shall be added to Section 240-5 in their proper alphabetical order: AS -BUILT SURVEY — A land survey that shows the final horizontal and vertical field location of constructed improvements on a lot including any approved design changes and field changes. This type of survey depicts the location of all improvements on a site including above -ground and below -ground structures such as buildings, parking areas, utilities, storm drainage systems, sewer disposal systems, water supply systems and any other constructed features. COMMERCIAL OR INDUSTRIAL LAUNDRY — An establishment engaged in laundering and/or supplying laundered items, such as uniforms, gowns and coats, table linens, bed linens and clean room apparel on a rental or contract basis to entities such as industrial plants, institutions, retail establishments and hospitality FIELD CHANGE — A change to an approved plan made during the course of site de_velo went work or construction work, required by unforeseen site constraints and/or technical or engineering considerations where the change does not match the plan that was originally approved but is generally consistent with the approved plan. PERSONAL SERVICE BUSINESS — A business enterprise engaged in providing services involving the care of a person or his or her personal goods or apparel, including but not limited to beauty and barber shops, dressmakers, tailor shops, -- — watchiepair clothing and shoe repair,—Laundromats, laundry and dry cleaners not including commercial or industrial laundries), nail salons and tanning salons, and excluding tattoo parlors. A transportation terminal does not include the storage of impounded or towed vehicles. Section 240-16D(2)(a) shall be revised to read as follows: (a) Notwithstanding any contrary provisions in § 240-21F of this chapter, the junkyard shall be entirely surrounded by a fence or screening at least seven feet high, but not higher than 10 feet and evergreen landscaping, both of which shall be approved by the Planning Board as adequate to provide reasonable protection to the value of the adjoining property. Section 240-21 shall be revised to read as follows: § 240-21 Wards and setbacks. A. Yard for every building. No part of a yard or other open space provided about any building or on any lot for the purpose of complying with the provisions of this chapter shall be included as any part of the yard or open space for any other building or any other lot. B. Obstructions in yards. Buildings or structures or any projection from buildings or structures shall not be permitted in a required yard, except as follows: (1) Paved open terraces and patios. (2) Architectural features such as windowsills, door frames, chimneys, eaves or cantilevered roofs may project up to three feet into any (3) The installation of handicap ramps for residential development. C. Yard requirements on multiple frontage lots. A front yard shall be provided on each street. On a corner lot, there shall be provided a front yard on each street. A rear yard shall be provided on each corner lot and the property owner shall elect which yard, other than a front yard, is the rear yard. D. Exception for existing alignment of buildings. If, on one side of the street within 150 feet of any lot, there is pronounced uniformity of alignments of the depths of front yards greater or less than the required minimum depths specified in the Schedule of Dimensional Regulations for Residential 4 9.2.a Packet Pg. 47 f Districts,111 a front yard shall be required in connection with any new building which shall conform as nearly as practicable with those existing on adjacent lots. Associated electrical facilities for pool filters, and electrical outlets must comply with the New York State Uniform Code. F. Fences and walls. (1) The yard requirements of this chapter shall not be deemed to prohibit any accessory retaining wall, nor to prohibit any fence or wall, provided that walls or fences in required yard areas shall not exceed six feet in height. (2) Notwithstanding subsection (1) immediately above, in the zoning districts enumerated in the Schedule of Use Regulations for Nonresidential Districts,E11 the Planning Board may allow a fence of any kind to a height not exceeding 12 feet above adjoining grade, provided the Board deems such fence necessary and appropriate for safety and/or security purposes, and provided further that the fence has been designed by a licensed professional engineer. A building permit shall be required for the construction of such fence and upon completion thereof the issuance of a certificate of compliance shall be required. (3) All walls which are four feet in height or higher shall be designed by a licensed professional engineer. The Planning Board may impose such conditions as it deems necessary to avoid or minimize traffic impacts and the impairment of the use, enjoyment and value of property in the area. 16. Sections 240-59D and A regarding 'Temporary outdoor use and structures in all districts, and, in residential districts, temporary outdoor stands for the sale and display of field and garden crops, shall respectively be revised to read as follows: D. Section 240-29F(2) shall be revised to read as follows: (2) Permanently mounted freestanding signs. (a) Not more than one freestanding sign, mounted in such manner as to constitute a permanent fixed installation, no taller than 10 feet, composed of no more than two back-to-back faces, along each street on which the lot abuts, shall be allowed, provided that the aggregate area of each such sign shall not exceed two square feet for each linear foot of building length facing the street or 25 square feet, whichever is smaller. A freestanding sign shall be located on private property and shall not be located closer than 25 feet from any side or rear lot line, and not closer than 15 feet from the edge of pavement of any roadway. Notwithstanding the above, the Planning Board may allow a freestanding sign in the right-of-way of a state or county road with the permission of the owner of the road, but in no case closer than 15 feet from the edge of pavement of the roadway. In no case shall a freestanding sign be located in a manner which adversely affects sight distance for vehicles. (b) One additional sign, of an equal or lesser dimension, shall be allowed in the case of commercial development consisting_ of two or more structures separated by at least 25 feet and located more than 125 feet from the front lot line. Said signs shall be coordinated with respect to construction and appearance to function as a single sign. 27. Sections 240-97A and B shall be revised to read as follows: A. Except where otherwise modified by other provisions of this chapter, off- street parking spaces shall be provided as follows. Off-street parking spaces in excess of the minimum numbers specified below shall not be permitted. Reasonable and appropriate off-street parking requirements for structures ---— - - and -land uses which do notfall -within the categories- listed -below or within -- --- the special standards of Article VIII shall be determined by the Planning Board. The Planning Board shall consider all factors entering into the parking needs of each such use or reuse of land or buildings and may, in the course of site plan or special permit review, reduce or increase the parking 13 Packet Pg. 56 9.2.a and loading requirements for such uses in an amount which it considers appropriate and in the best interest of the Town. In all cases, the Planning Board shall require appropriate safeguards for the provision of the required parking and loading facilities for uses for which standards exist. B. Notwithstanding Subsection A above, the Planning Board, at its sole discretion, may reduce the cumulative parking requirement in a mixed-use development, where it has been demonstrated to the Board that the proposed amount of parking will be adequate to serve the peak parking requirements of the development. In order to demonstrate this, the applicant shall provide a shared parking study prepared by an appropriate professional in accordance with accepted industry standards, such as that described in the latest edition of the Urban Land Institute's Shared Parking report, the Institute of Transportation Engineers' Shared Parking guidelines, or other approved procedures, which may be supplemented as appropriate by actual experience and studies of, or known to, the professional preparing the report. The study shall consider parking demand variations due to factors such as time of day, weekday versus weekend demand, monthly variations in parking demand, captive markets within the site and modal split, all of which affect when the peak accumulated parking demand would occur. [The remainder of subsection B shall remain intact.] 28. (1) Where a lot is formed hereafter from part of a lot already occupied by a building or structure, such separation shall be effected in such manner as not to impair conformity with any of the requirements of — --- -_---- _ - this chapter with respect to the existing bu-ilding and all -yards and -_--- other required spaces in connection therewith. (2) Except as provided in § 240-56 of this chapter, in the case of a legally non -conforming two-family or multifamily dwelling on a lot 14 Packet Pg. 57 9.2.a in a one -family residence zoning district, no land shall be subdivided from said lot unless the area of the lot on which the non -conforming dwelling remains has an area of at least the number of dwelling units in the building times the minimum lot size of the zoning district in which the property is located. 30. Section 240-96G shall be revised to read as follows: G. Commercial vehicles. Not more than one commercially registered vehicle and one trailer may be parked or stored outdoors on any residentially used or residentially zoned lot at any time. For the purposes of this section, a "commercial vehicle" shall be a vehicle which exceeds 12,000 pounds in gross vehicle weight; examples include tractors, tractor -trailers, semi- trailers, rollers, tractor and truck cranes, power shovels, road -building machines, snowplows, road sweepers, sand spreaders, trailers, excavators, tank trailers and buses, and any other similar vehicle. 31. Section 240-43A(1)(e) regarding Special Permit application requirements shall be revised to read as follows: (e) Full environmental assessment form, except that in the case of a special permit accessory use the approval authority may allow the use of a short environmental assessment form. 32. ACTION -The Town Board is proposing several modifications to the Town's zoning chapter and map. COMMENTS - We have prepared the following technical comments on the proposed changes: The Town should consider retaining the provision that allows porches or balconies to project into any required yard area (§240-21), especially in the front yard. Front yard porches allow for interaction between neighbors, residents to enjoy the neighborhood, and relate homes to the street. The Town is proposing to require certain uses to be located on parcels with frontage on a state or county road with the provision that primary access be from a state or county road. The number of uses proposed to have this requirement are not insignificant. There may be many instances where interconnected streets or rear service roads could provide the access, rather than placing numerous new access points along higher -volume roads. We suggest the requirement that access be provided from a state or county road be restricted to those uses that generate high traffic volumes, or require large truck or delivery access. Further, this requirement would promote linear development along higher -volume roads, rather than depth of development in centers. In addition, we question whether current uses that maintain primary accesses off local roads, will become non -conforming after passage of this local law. The Town is proposing to institute regulations regarding the placement of signs on a lot. Rather than institute a regulation which may have the unintended consequence of requiring an applicant to appear before the Zoning Board of Appeals for a variance, we support the Planning Board's ability to properly locate a freestanding sign. The code could reference design preferences to guide the Planning Board with regard to sign placement. RECOMMENDATION - The Department recommends that the Board rely upon its own study of the facts in the case with due consideration of the above comments.
