2016-145 2016-145 Resolution Authorizing Engineer To Solicit Bids For Carnwath Farms Slope Stabilization Project At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on April 25, 2016. The meeting was called to order by Lori A. WHEREAS, in 1998, the Town acquired property then known as the Greystone Estate and now known as the Carnwath Estate located on Wheeler Hill Road in the Town that abuts Metro North Railroad; and WHEREAS, the property consists of approximately 99.5 acres of land portions of which are improved by a 19th century mansion, a dormitory building, a large chapel, a carriage house and other related buildings and detached structures; and WHEREAS, over the years erosion has begun to occur on the western portion of the property which slopes downward towards the Metro North Railroad tracks; and WHEREAS, the Town Board has determined that stabilization of the slope is appropriate; and WHEREAS, the Engineer to the Town has worked with Douglas Schroeder, P.E., Senior Hydrology Engineer, Track and Structures with Metro North Railroad to develop a plan to diffuse the water run-off and stabilize the slope on the western portion of the property; and WHEREAS, the slope stabilization project will consist mainly of drainage improvements including the installation of water bars, water spreaders and swales; and WHEREAS, the Town Board has determined that it is in the best interest of the Town to undertake the necessary slope stabilization project to address the water run-off, erosion and to stabilize the western portion of the property; and WHEREAS, pursuant to Municipal Law § 103, contract documents and bid specifications must be prepared for the purpose of soliciting competitive bids for the slope stabilization project on the Carnwath property; and WHEREAS, the Engineer to the Town, Morris Associates Engineering & Surveying Consultants, PLLC has prepared bid specifications and contract documents at the request of the Town Board. NOW, THEREFORE, BE IT RESOLVED, as follows: I. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board has determined that the slope stabilization project on the Carnwath property is a Type II Action pursuant to 6 NYCRR § 617.5(c)(1) and § 617.5(c)(6) and is exempt from environmental review pursuant to the New York State Environmental Quality Review Act (SEQRA) and Local Law No. 6 of 1992. 3. The Town Board hereby approves the bid specifications and contract documents prepared by the Engineer to the Town, Morris Associates Engineering & Surveying Consultants, PLLC. 4. The Engineer to the Town, Morris Associates Engineering & Surveying Consultants, PLLC, is authorized to promptly advertise the same for competitive bidding pursuant to General Municipal Law § 103, and the codes, rules and regulations of the Town of Wappinger, and to report to the Town Board the results of such bidding. 5. All sealed bids shall be submitted to the Town Clerk in accordance with the bidding instructions and shall be publicly opened by the Town Clerk and read aloud at the time set forth in the notice to bidders. 6. After receipt of the bids the Town Board shall award the contract for the project in accordance with General Municipal Law § 103 reserving the right to reject any and all bids in accordance with applicable law. If all bids are rejected, the Town Board may re-advertise for new bids if, in their opinion, it is determined to be in the best interest of the Town.
