BOX 324 WAPPINGERS FALLS, NY 12590-0324 In order to ensure a safe working environment for all employees and provide the most effective delivery of services to residents of the Town of Wappinger, it is the policy of the Town of Wappinger that no employee may manufacture, distribute, dispeiise, use, sell, purchase, possess or be under the influence of alcohol or other illegal/controlled chemical substance, except prescription medication, during scheduled business hours or while on or using Town owned property. The Town recognizes that alcohol and chemical substance abuse are progressive, potentially fatal diseases which may affect employees' lives and relationships with families and/or co-workers, quality of life and job performance. The Town encourages and supports employees who seek voluntary treatment. Employees must abide by the terms of this policy statement as a condition of employment and failure to do so may result in disciplinary proceedings. However, nothing herein is intended to diminish the rights of an employee under the collective bargaining agreement or the law. Effective January 1, 1996, the Town of Wappinger will institute a drug free policy in compliance with 49 CFR Part 382.605. CDL & safety sensitive personnel, in accordance with 49 CFR, will be randomly tested. It will include testing for Cocaine, Amphetamines, PCP, Marijuana, and Opiates. In addition to the above drugs, we will also test for alcohol. The test schedule will include pre-employment, random, post -accident, for cause, and bi-annual testing. Definition: Safety sensitive --Anyone having use of a Town vehicle and mechanic. Guidelines 1. Using, selling, manufacturing, distributing, dispensing being under the. influence of or impaired by or possessing alcohol (unless in a sealed container) or any illegal/controlled chemical substance on Town of Wappinger premises is prohibited. 2 When there is probable cause to believe that an employee has violated this policy, the infraction shall be reported to the department head or his designee or where that is not appropriate, to the Supervisor or Highway Superintendent (hereafter, any of these individuals will be referred to as the investigating official), who will be responsible for investigating the incident in an appropriate manner.
