Resolution Introducing Local Law No. 5 Of The Year 2018, Establishing Stop Intersections In The Fleetwood Subdivision At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on April 9, 2018. WHEREAS, residents have alerted Town officials to potentially hazardous traffic situations at uncontrolled intersections in the Fleetwood Subdivision; and WHEREAS, the Engineer to the Town has investigated these locations and has recommended, based on its engineering judgment that the installation of stop signs in seven locations is appropriate to control the traffic in the Fleetwood Subdivision; and WHEREAS, the Town Superintendent of Highways has concurred in this recommendation; and WHEREAS, the Town Board reviewed the recommendations of the Engineer to the Town and the Highway Superintendent, and examined the facts and circumstances; and WHEREAS, the Town Board has determined that it is in the best interest of the citizens of the Town of Wappinger to revise the Town's Vehicles and Traffic Code to create seven new stop intersections in the Fleetwood Subdivision; and WHEREAS, the Town Board has determined that the proposed Local Law is a Type II Action under SEQRA pursuant to 6 NYCRR 617.5(c)(16); NOW, THEREFORE, BE IT RESOLVED: 1. The Town Board hereby introduces for consideration of its adoption proposed Local Law No. 5 of the Year 2018 "Establishing Stop Intersections in the Fleetwood Subdivision" in the form annexed hereto; except as specifically modified by the amendments contained therein, Chapter 230 as adopted and amended from time to time thereafter is to remain in full force and effect and is otherwise to be ratified, readopted and confirmed. 2. The Town Board hereby determines that the enactment of the aforementioned Local Law is a Type II action pursuant to 6 NYCRR 617.5(c)(16) and, accordingly, the Town Board hereby expressly determines that this action is not an action that requires review pursuant to the provisions of New York State Environmental Quality Review Act (SEQRA). The Town Board hereby schedules a Public Hearing regarding the proposed adoption of the annexed Local Law No. 5 of 2018 for 7:30 P.M., on the 14th day of May 2018, to be held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, and the Town Clerk is directed to post a Notice of Public Hearing in the form annexed hereto in the Town's official newspapers, the Southern Dutchess News and Poughkeepsie Journal, not less than ten (10) days prior to said public hearing date and to post the notice of said public hearing on the sign board of the Town.
