RESOLUTION TO AUTHORIZE THE NAAUNG OF ROADS ON SHAMROCK HILLS
SUBDIVISION
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall,20 Middlebush Road, Wappingers Falls,New York, on the 23rd
day of May, 2005, at 7:30 P.M
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:
PRESENT: Supervisor - Joseph Ruggiero

The following Resolution was introduced by Ms. McCarthy and seconded by

WHEREAS,Mark Liebermann, Fire Inspector to the Town of Wappinger, has requested
that the roads in Shamrock Hills Subdivision(Tax Grid No. 6257.04.502465)be named to
Shamrock ffi1Ls Drive,Doorm Court, and Kinsale Court by written request dated May 18, 2005
to the Town Supervisor Joseph Ruggiero.
NOW, THEREFORE,BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.

Consulting Engineers and Surveyors, dated.Pune 14, 1999, and as may have been revised from

WHEREAS;the Town of Wappinger Planning Board granted final conditional
subdivision approval, by Resolution dated.January 5, 1995, subject to, and conditioned upon,
fulfillment of the conditions set forth in the aforementioned.Resolution, and subject to certain
improvements being made and constructed as set forth in the aforesaid Subdivision Map and
related Contract drawings, including dedication of the roads for Evergreen Subdivision, Section
1, all in accordance with the Town of Wappinger Subdivision Regulations,Zoning;Code,

WHEREAS, the Town of Wappinger Planning Board granted final conditional

fulfillment of the conditions set forth in the aforementioned Resolution, and subject to certain
improvements being made and constructed as set forth in the aforesaid Subdivision Map and

WHEREAS, Town Law §277 requires a developer of a subdivision to guarantee the
construction,installation, and dedication of the improvements required by the Resolution of

WHEREAS, all of the improvements required by the Resolutions of Subdivision
Approval for both Evergreen Subdivision, Sections I and 11 have been completed; and
WHEREAS, subsequent to the time the Offer of Cession and Dedication was granted to
the Town of Wappinger it was determined that the proposed Road "B" (sometimes referred to as
Abigail Lane) would no longer be needed or necessary as a Town road; and
WHEREAS, the Town of Boai-d has determined it is in the best interest of the citizens of
the Town of Wappinger, and the residents of the Evergreen Subdivision, Sections I and if, that
Evergreen Drive, together with Easements and other public improvements, made,and constructed
in connection with Evergreen Subdivision, Sections I and 11, be accepted by the Town of
Wappinger as a public road and for municipal purposes and that the Deed of Conveyance
tendered with the Offer of Cession and Dedication be amended to specifically exclude Road "B"
(sometimes referred to as Abigail Lane) and that said Deed of Conveyance be amended
excepting Road "B" from said description in accordance with a legal description prepared by
Maggi? Martin &Del Bene, LLP dated December 2, 2003, and in accordance with letter from
Joseph E. Paggi, Jr., P.E., Engineer to the Town dated December 3, 2003, copies of which are
affixed hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
I. The recitations above set forth are incorporated in this Resolution as, if fully set
forth and adopted herein.
2. The Town Board hereby determines that it is in the best interest ofthe residents of
the Town of Wappinger, particularly the residents of the Evergreen Subdivision, Sections I and
fl, to accept the roads, easements, utilities and other related improvements nude and constructed
in connection with said Subdivision.

Dear Al,
As you recall, Andy Metzger was going to provide a dead description for Abigail
Lane or Road "B" that he wishes to retain. As you are aware, the deed description
and the present Offer of Cession includes both Road "A" (Evergreen Drive) and
proposed Road "B" (Abigail Lane). With the development of the Zammie.lo property
just to the east of Evergreen Estates, the construction of Abigail Lane became a
moot point.
Obviously, the Town is desirous to take this road over. To that end, Andy has not
supplied the easement description for this road or set the four (4) concrete
monuments that were promised. Roger Hummeston has advised me that he has
spoken to Bob Oswald, Surveyor for the project, and he would install the
monuments and Roger would take care of it with Oswald.
I have taken the liberty of preparing a deed description for Abigail Land (copy of
which is enclosed). It would be my recommendation that this description be
attached to the Offer of Cession and be noted as the description of the Abigail Lane
or Road "B", and that this deed description will be excepted and reserved from the
original.

RESOLUTION NAMING PRIVATE ROADWAYS LOCATED AT
9 OLD ROUTE 9, DRIVEWAY TO TOWN HIGHWAY GARAGE,
AND 4—6 OLD STATE ROAD
The following Resolution was introduced by Mr. Colsey and seconded by
Mr. Valdati
WHEREAS,in order to comply with the Dutchess County Enhanced 911 Response
Program, the Town must name all public and private roads within the Town-5 and
WHEREAS,Fire Inspector to the Town of Wappinger, Mark Liebermann, recommends
that the unnamed private roadwaylocated at 9 Old Route 9 be named ASPER LANE; and

WHEREAS,Fire Inspector to the Town of Wappinger, Mark Liebermann, recommends
that the unnamed roadway used as the driveway to the Town of Wappinger Highway Department
Garage be named HIGHWAY DRIVE; and
WHEREAS,Fire Inspector to the Town of Wappinger, Mark Liebermann, recommends
that the unnamed private roadway located at 4-6 Old State Road be named DUSTY TRAIL; and
WHEREAS,the owners of the properties adjoining said unnamed roadways concur with
said naming of private roadways, and
WHEREAS, Superintendent of Highways to the Town of Wappinger, Graham Foster,
concurs with said naming of private roadways-, and
WHEREAS, James Tompkins, Dutchess County 911 Addressing Unit, concurs with said
naming of private roadways.
NOW, THEREFORE, BE IT RESOLVED, as follows:
I The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.

WHEREAS, Dutchess County is preparing to implement E-911 services
throughout the County; and,
WHEREAS, in order,to enable appropriate responses from emergency
personnel, E-911 Project Coordinators have requested each
municipality to name private roads in each Town; and,
WHEREAS, the names of private roads will enable E-911 to input
appropriate information into their response system; and,
WHEREAS, the Town has conceptually agreed with E-911 for the names
of private roads, which are annexed hereto as Schedule "A„;
NOW THEREFORE, BE IT RESOLVED, that the Town of Wappinger hereby
adopts the names on the attached Schedule as private road names in said Town;
and be it further
RESOLVED, that the adoption of the private road names shall in no way be
construed to impose any liability or maintenance obligations on the Town with
respect to these private roads; and be it further
RESOLVED, that the Town Board specifically states that these roads are not being
named and are not being accepted for dedication as public roads in and for the
Town of Wappinger, but only to provide a means of identifying private roads for
emergency response purposes; and be it further
RESOLVED, that the Town Clerk forward a copy of this Resolution. to the E-911
Coordinator.

WHEREAS, in order to comply with the Dutchess County Enhanced 9-1-1 Response
Program, the Town must name public and private roads within the Town, and
WHEREAS, Robert and Barbara Haimelin, Matthew and Lisa Talaber, and Donald and
Loretta Denardo are the owners of the three (3)properties sharing access to Smithtown Road
over an unnamed private roadway located at 188 Smithtown Road; and
WHEREAS, said owners have requested that the unnamed private roadway be named
Maple Path, and
WHEREAS, Fire Inspector to the Town of Wappinger, Mark.Liebermann, concurs that
the unnamed private roadway located at 1.88 Smithtown Road should be renamed Maple Path.

I am responding to your Feb. 5 2002 memo regarding the proposed street name due to the
Enhanced 911 system for Dutchess County. By your recommendation on 12 April 2002, I
have spoken to Mr. Jim Tomkins of the addressing unit and have had the following street
name cleared for use. I have reviewed the street name with my neighbors and we have
selected the name listed below.
Please name the current road that provides access to our residences, "Maple Path".

3ames Tompkins from the Dutchess County E-911 addressing unit has
contacted me in reference to the private road located in the Hilltop Business
Center.
The road for this parcel has been designated BILL HOR ON�WAY. I believe
the Town Board has approved this name as has Dutchess
11.
The problem is that a Town Board resolution was never passed naming the
road.
Dutchess E-911 can not assign addresses until they have a copy of the Town
Board resolution.
I have checked with the Town Clerk's Office and there is no record of this
resolution being passed.
I am asking that a resolution be passed ASAP so the 911 unit may issued
addresses to the building permit applicants.

On January 15, 2002,1 forwarded to your office my request for a name change with a copy of my
neighbor's,which I delivered by hand. 1 am in receipt of yours of February 6,2002 and I have attempted
to contact my neighbor in the interim, however,there is no listing in the phone book for a personal
residence and the office number yields an answering machine that does not accept messages.
My request for a name is`Barrister's Row." I consider the name unique and fanciful and the three
separate law offices, and five lawyers in this building account for approximately 95% of the street traffic.
One last item, several months ago,there was a motor vehicle accident which took out the"MacFarlane
Road"sign. I will make a second call to the New York State Department of Transportation. I would
appreciate anything you can do on your end to remedy this condition.

TOWN BOARD RESOLUTION
WHEREAS, Dutchess County is preparing to implement E-911 services
throughout the County; and,
WHEREAS, in order to enable appropriate responses from emergency
personnel, E-911 Project Coordinators have requested each.
municipality to name private roads in each Town.; and,
WHEREAS, the names of private roads will enable E-911 to input
appropriate information into their response system; and,
WHEREAS, the Town has conceptually agreed with E-911 for the names
of private roads, which are annexed hereto as Schedule"A";
NOW THEREFORE, BE IT RESOLVED, that the Town of Wappinger hereby adopts the
names on the attached Schedule as private road names in said Town; and be it further
RESOLVED, that the adoption of the private road names shall in no way be construed to impose
any liability or maintenance obligations on the Town with respect to these private roads; and be it
further
RESOLVED, that the Town Board specifically states that these roads are not being named and
are not being accepted for dedication as public roads in and for the Town of Wappinger, but only
to provide a means of identifying private roads for emergency response purposes; and be it further
RESOLVED, that the Town. Clerk forward a copy of this Resolution to the E-911 Coordinator.

that it must be named to comply with the National Emergency Numbering ;
Association regulations.
I would appreciate it if you could call me with a possible name for your
driveway.
If I do not hear from you by February 25, I will assume you do not with to
name the driveway yourself, and it will remain as 911 has assigned it. 911
has named all the unnamed areas as Private Drive # Street signs will
be erected stating the name of the driveway.

Attached herewith please find foryour review a memo from John Murphy regarding the 911 Project.
In doing a field inspection there were numerous problem areas with the road within the Town of Wappinger
relating to the 911 criteria.
I would suggest a workshop meeting due to the fact that some road names may have to be changed to be in
compliance with the 911 project.
Please advise me of the date that we may meet and I will notify Mr. Murphy of this date.

First, I want to apologize for getting this to you late. The days are not long enough.
Enclose with this note is the following:
1 - A list of 911 Addressing standards.
2 - A list of Street Suffix codes.
3 -A list of accepted street names within the Town of Wappinger. These streets
include town, county, state as well as private roads. We need to make
certain that the names are spelt correctly and that the suffixes are correct.
4 -A list of problem areas as we know-them presently before any field work is
started. The Old State Road and Old Route 9 multiple street names is a
major concern. Also the Pine Ridge Dr/Van Voorhis Terr area is another
problem area.
5 -A copy of various drawings from the tax maps that have problems on them
A - 6157-02 these roads need to be reviewed for duplicated names.
B - 6259-04 this area will need a name tagged to it.
C- 625704 the area in circle needs to be reviewed and corrected.
D - 6257-01 & 03 the circle areas need to be reviewed and possibly

E - 6158-04 the tax map as well as tax rolls show a Cedar Ln. A review
of the property owners and the listings in the NYNEX phone book
show the residences using a Pine Hill Dr listing. This needs to be
verified
These are the concerns as I presently know them. Once the field crew begins in the
Town, I am sure additional concerns 1 problems will arise. The one thing that would
really help move the project along is if the Town knows of any possible private roads
that will need to be created (three or more addressable structures on a lane constitutes
a private road) that they be identified as soon as possible.,
will send you as well as Supervisor Smith a hard copy of this fax. Once the
Centerline maps for the Town of Wappinger arrives, I will contact you, the Supervisor
and Mr Bill Parsons o we can review these maps together.

911 ADDRESSING STANDARDS
The Dutchess County E911 committee's addressing standards are as follows:
- To be "City type" addresses.
- Numbering to begin at western or southern end of road/street.
- Numbering will begin at the point of entry for cul-de-sacs/dead end, regardless
of direction.
- Odd numbers on left and even numbers on the right.
- Numbering of a road/street begins with 1; proceed incrementally on the left side
1,3,5,7...and on the right side 2,4,6,8...irrespective of whether or not a
property building exists.
- Incremental odd/even numbering should be across from each other, for
instance 1 across from 2 and 124 across from 125.
- 52.8 feet guide for numbering interval for all land parcels.
- Number all parcels, not only those with homes.
- Private driveways/lanes with three (3) or more addressable structures (locations
that a 911 call could be made from) will need to be named. Naming of
private roads does not imply ownership or maintenance responsibility by the
local government.
- No duplicated street names are allowed in the same venue or zip code delivery
area. It is requested that local governments try to stay away from using
similar sounding street names e.g. Cherry Drive - Cherry Lane.
- Follow established rules for "unique situations", e.g. apartment complexes,
trailer parks, shopping center etc as agreed upon by the County.
- Satisfy NENA (National Emergency Number Association) compliance.

PROBLEM AREAS:
Ardmore Dr/Orchard Dr area (see attached map)
The cul-de-sacs of Orchard Dr and Ardmore Dr are going to cause
problems with numbering.
Pine Hill Dr 1 Cedar Ln area (see attached map)
The tax map and tax rolls show Cedar Ln addresses, but all residents
along the length of Cedar Ln use Pine Hill.Dr addressing according to
the NYNEX phone book.

Pine Ridge Dr 1 Van Voorhis Terr area (see attached map)
Tax map as well as house numbers show Pine Ridge Dr to continue from
the intersection of Van Voorhis Terr to Old Hopewell Rd but, the street
sign shows Pine Ridge Dr to dead end at#320 and Van Voorhis Terr
to travel from the intersection of Pine Ridge Dr to Old Hopewell Rd.
Tax Map 6259-04 Properties 635163, 638178, 642192, 645208 will be
addressed as a private road off Rt 376. A name will be needed for this
road. (See attached map)
Tax Map 6157-02 shows two (2) separate roads tagged as Old Route 9. A
field check shows the smaller section to be posted with a town highway
sign as Old State Rd. On Tax Map 6056-02 it shows a road tagged as
Reeves By-Pass Rd. A field check shows this road to be posted on both
ends off Rt 9D with a town highway sign as Old State Rd. One of these
roads will need to be re-named.
Tax Map 6157-02 has the two separate roads that are tagged as Old Route 9.
Again one of these is posted with an Old State Rd highway sign. Now on
Tax Map 6156-02 we have yet another road tagged as Old State Rd, but
it is posted on the Rt 9 northerly end with a highway sign stating it is
_ Old Route 9. These road names will need to be clarified and there may
be the need for re-naming here.
