Box 324 Wappingers Falls, New York 12591 Reference: Truett Dear Board Members: On August 22, 1994, 1 field inspected the above site during an intense rainstorm in the morning hours. The water was maintaining itself in the curb line and actually draining out of the driveway toward the street. It appeared' at that point in time that Mr. Truett had performed some work on his property which directed the rain waters away from his garage and down toward his back yard. This was the: work we had spoke about during the last number of correspondence. With respect to Mr. Truett's current request to install a curb line in front of his property and his neighbor's property, it would be my recommendation that it not be done because it could potentially trap water in back of the curb line that presently flows from the back of the curb line toward the street. However, if Mr. Truett insists on it being done, the Highway Superintendent, Graham Foster, has indicated, he would do so with the proper release given. The work would include the construction of an asphalt berm along the front of Mr. Truett's property and the next door neighbor to the west. On August 17 I met with you and Jay Paggi at my house to discuss the towns drainage problem, and possibly what could be done. We left it that you would get back to me with your determination. That was two and one half months ago. Two statements you made at the time of your visit, and today, that I must take exception to. 1. "You knew the condition existed when you bought the house" I have enclosed my first letter to Irene Paino dated July 19 1990. I bought my house in 1972 . THATS 18 YEARS LATER! I stated in the letter that it was a minor problem before the town repaved (raised) Alpert Drive twice, and within one month of the last repavement I had a major problem. I have had several major problems since then. Even if the problem DID exist before I bought my house, it is still storm drainage comming off the TOWN road, entering my house, and doing permanent water damage. There is not a "Statute Of Limitations" on the town's resposibilty to home owners, although I'm shure you would like one. 2. "You agreed to cut a swail in your back yard to drain the water away" As I have said before. . . This is the towns problem to fix! Not mine! This was your suggestion. If you would like me to fix the problem, I'd be glad to. It will cost you $10, 000. I Will raise my driveway and my lawn above the level of the road, and have a swail cut to drain the water. For this I would be glad to sign a statement holding the town harmless from any future problems Madam Supervisor, since I have been advised by real estate agents that my home would not even be sellable, my patience is running out. If this drags on any longer Ii will be forced to retain legal counsel, and inform the media of the towns lack of concern for its residents. The choice is yours. . . accept my offer, or have the problem fixed. I will again state for the record the two major problems one .more time. 1. The five foot diameter culvert which carries all the water out of Angel Brook Estates is reduced at the output end. a. It is reduced from a 5 ft. diameter pipe to a 4 ft. diameter. The 4 ft. pipe already carries 50% of the Rockingham Farms drainage. b. At the point of reduction, it also makes a more than 90 degree turn. 2 . The twelve catch basins that drain the water from Alpert Drive are all connected in series by an 18 inch pipe. This means each catch basin dumps into the next downhill basin and finally through the one in front of my house. Twelve catch basins are trying to drain through one 18 inch pipe! In July, the town replaced the 18 inch pipe which connects the last basin to its final outlet. This only relieves the problem for that .last catch basin, the other eleven are still trying to drain through an 18 inch pipe. Although the drainage problems have always been there, I have not been seriously effected by them until June of 1989. In that month, the town repaved Alpert Drive and elevated the road 6 inches higher than my basement floor and driveway. In the past, the road always flooded and the water was carried away. Now the road remains above the water level and my driveway and basement are flooded. I have included pictures taken this past June, which show the entire area flooded, the road above water, and the catch basin not at capacity. IM I believe the town will continue this trial and error approach, when only the complete replacement is the solution. I care not if these problems are corrected as long as my house and property are not jeopardized. I feel my flooding problems have been caused by the town raising Alpert Drive, and in turn, my problem is your problem. I offer you a simple, immediate and inexpensive solution to this problem. The town should raise my driveway and lawn 6 inches or higher. This would keep the water on the town road. I was pleased to hear that my water problem has been acknowledged and a course of action has been established. However, I believe the true cause has not been identified and the course of action is a trial and error approach to solving this problem. I will have to live through another flood with the possibility of major damages. 1. Paggi and Martin identified the problem as a flow restriction. I identify it as a capacity problem. They identify one basin as overflowing, when there were four backing up. 2 . The 60 inch (5 foot) pipe which drains all the water from Angelbrook Estates is reduced into a three foot pipe at a right angle. That three foot pipe also drains 50% of the water from a major part of Rockingham Farms. This is a major restriction. I refer you to page two, paragraph two of their letter which acknowledges the fact that a flood will occur on Alpert Drive whenever this 60 inch (5 foot) pipe backs up. 3 . As you know, our basement was flooded again on June 9 . My driveway and basement were completely under water and the town road was above water. Again, I state the town has compounded the drainage problem by raising the road 6 inches, which forces the water into my house. I do not have a degree in engineering,. but I feel that common sense applied to the facts show that this entire drainage system was designed inadequately and is at fault today. I would like to inform you that I have secured the advice of legal counsel and a complete file is being maintained by him. I would request the town obtain a second opinion in this matter. We believe that the backup of water in the catch basin adjacent to Mr. Truett' s driveway is attributed to the following items : 1 . The pipe out of the catch basin in question is an 18 inch corrugated metal pipe (CMP) . With an 18 inch and 12 inch CMP coming into the catch basin, at capacity flows , water would back up. 2 . The 18 inch CMP that leaves the catch basin at Mr. Truett ' s driveway and discharges into the rectangular vault on the south side of Alpert Drive, has a 90 degree concrete bend in it, whicIT has a smaller area then the 18 inch pipe and it appears to pitch upward before entering the vault. These factors will restrict flow through the pipe . 3 . The invert of tine- 18 inch C PIP in the _vault is only 1 . 33 feet above the invert of the 36" X 58" CMF which crosses under Alpert Drive, and when the depth of flow in the 36" x 58" CMP is 2 feet, it will cause the flow entering the vault from the 18 inch to back up. it appears that the combination of the above situations have caused the water to back up and out of the catch basin in Mr. Truett' s driveway. June 26, 1990 Paige Two Town of Wappinger 20 Middlebush Road Wappingers Falls , New York 12590 Attention: Town Board Reference: Truett Drainage Our recor>uscendation would be to remove the- existing 18 inch CMP from the catch basin to the vault, and replace it with a 24 inch CMP , being laid from the catch basin straight into the vault without a 90 degree bend. The elevation of the inverts of the proposed 24 inch CMP will have to remain the same as the elevations of the existing 18 inch CMP because we have to maintain a minimum slope of 0 . 5%. However, we would like to point out that when the 60" pipe is flowing full and submerged by 1. 2 feet of head, the waters will back out of the catch basin. This situation should happen only in very extreme cases . If the above work is done, the normal rain would not back out of the catch basin. We have discussed this solution with Graham Foster and he agreed that the Town Highway Department could perform the construction required. Also, the proposed pipe location from the catch basin to the vault will remain within theZ road right-of-way. If there are any questions or concerns , please do not hesitate to contact this office. After the 'second letter, I was notified by telephone there would be a work shop scheduled to discuss this problem. This 'is the last I have heard from the town. There has been one development since I spoke with you last fall. The town engineer sent surveyors and it was determined by them that the road is now six (6) inches higher than my basement floor. This lends credibility to my argument, in my first letter dated July 19, 1989, that the town has caused this problem. I would request of you that the original three (3) questions in that letter be answered. Also, an article in last weeks Southern Dutchess News states that the town has approved $2 million dollars for 22 drainage projects. This is to correct and I quote "problems of residential homes and yards being flooded due to drainage problems. I would like to know if my problem is included. If not - why not? The letter itself requested a speedy response. I would think thirty days would be enough time for your organization to acknowledge a letter. It is going on two and a half months and I have not received as much as a phone call from anyone connected with the town. I request this issue to be placed on the next town board meeting agenda. I would at least expect an answer to one of my original question about the towns liability for this damage. The damage came to approximately $3000 and was not covered by insurance. The damage will come to approximately $3,000. 00 and is not covered by insurance. This is the second time this has happened in my sixteen years residing on Alpert Drive. After the first incident, we were told: 1. That it was "impossible" by former highway Superintendent Mr. Horton. 2 . That all drainage engineering is done on a 25 year rainfall basis, which would mean that it would flood no more than once in 25 years. Because there was only slight damage the first time, I dropped the issue and built 4 inch dams across both garage doorway openings and installed a 4 inch drainage pipe in front of them. These dams have saved my basement many times, but on June 26th, my drainage pipe was at capacity and the water was 2 inches over the dams. This means 6 inches of water in my family room and garage. There are two conditions causing this problem. 1. The incorrect engineering of the capacity of the existing drainage system. 2 . The height of the road in respect to the height of my basement floor. Regrading the second cause I have included the original site plan that was done before the house was built. It notes that "the finished basement floor to be higher than the finished road" . The road has been repaved (raised) twice since 1973 . The second repavement was just one month before this flood. In view of this situation as it still exists today, I would like the following questions answered. 1. What department in the town should I send my bills for reimbursement? 2 . What improvements the town will make to insure no further flooding to my home? 3 . Is the road now higher than my basement floor? If so, what the town intends to do to rectify this new problem. After three weeks of unreturned phone calls, I finally met with Mr. Crosier who immediately used phrases like "no liability" and "act of God" . My contention is that once water is within the town drainage system, the town is liable when it exits the drainage system and does property damage. Mrs. Paino, I have already taken expensive precautions to safeguard my home due to a continuing town drainage problem. Now, I feel it is time for some action and expense on the town's part to rectify its own problem. Madam Supervisor: over the past 2 years, it has become quite apparent, due to the .interest in the property known as contrail, that someday, something will be built there. One of the objections of myself and other town residents to the development of this property has been the impact on our down stream drainage. This area borders All Angels Hill Road and drains into Angel Brook. Angel Brook flows through Angel Brooks Estates, joins the drainage system of Rockingham Farms and continues to Sprout Creek. This junction of the two drainage systems takes place on my property. If you will have the Town Engineer review the records, he will .find that the 5 ft. culvert for Angel Brook Estates and Contrail intersects a 3 ft, culvert for Rockingham Farms at a right angle, obviously, this constitutes a situation that will back up the Angel Brook system. This has happened many times in the past, completely flooding the street at Alpert Drive and adjacent properties (which is the opening of the 5 ft. culvert) . I feel that this is a town problem that exists today and should be remedied before any considerations are made to the Contrail properties. This was discussed at a meeting this past spring. Initially, this office and the Town Highway Superintendent, Graham Foster, conducted a field inspection in order to assess the existing conditions. It is apparent that due to the steepness of the surrounding topography and lack of closed storm system, the runoff has no relief except to flow to the West across the cul-de-sac and down a driveway on the West side of Baldwin Drive. In order to reduce the extent of erosion to the residence driveway, we are proposing a series of catch basins, storm pipe, asphalt berm and end sections in order to contain and transport the runoff to an existing stream which flows behind the housing development on Baldwin Drive. The proposed system shall be constructed beginning approximately 200 feet North of the cul--de-sac on Baldwin Drive. Part of this construction will require the acquisition of easements along adjacent properties in order to accommodate a 150 L.F. stretch of outlet pipe along the Northwest side of the cul-de-sac. Enclosed please find a map delineating work areas and the proposed easement location. The problems associated within this area are not only controlling the road runoff, but also the overland runoff flowing onto the cul-de-sac and-down the West side driveway. BOX 324 WAPPINGERS FALI S,N.Y April 4 , 1994 To: Town Board From: Graham Foster Subject : Drainage Baldwin Drive/ Lot #16 Wildwood Drive In reference to Jay Paggi' s letters of 3/29/94 on the above drainage com- plaints , I offer the following: Both complaints are similar in the fact that most if not all of the runoff is generated on private property , runs onto the Town road for a short distance and then back onto private property . Baldwin Dr. The majority of the runoff comes from private property onto the road and down the driveway . There is some runoff which comes down Baldwin Drive ' s east shoulder. The majority of this water crosses the road just before the cul de sac and joins the runoff from the west shoulder. This water then runs southerly to a private drain on the west shoulder of the cul de sac . At one point a sanitory sewer easement was proposed at the beginning of the cul de sac but wasnever implimented. #16 Wildwood Drive - Jay' s comments on the Dana Place runoff . Alternate #1 . The installation of a swale in the cul de sac is unacceptable . The install- ation of a swale would intefere with snow removal . Also there is very minimal grade to work with and it would be very difficult to make the water flow down Dana Place from the area in question. Alternate #2 . Is possible but not practical in my lmind because of the cost which I would estimate in excess of $100 , 000 to handle a very in- significant amount of runoff which is generated on private property. This runoff must travel approximately 233 feet through grass to reach the home which is located at #16 Wildwood Drive . I spoke with Mr. Zito on 4 /4/94 at which time his yard was like a sponge but no water was draining from the cul de sac . I feel Mr. Zito has a severe drainage problem which is caused by the natural drainage of the area but not by drainage from the cul de sac . I would like to see a policy accepted which would put the responsibility of correcting drainage problems on the generator of the problem. CC . This has been a subject of many discussions during the past year and the Town Board felt it should be settled once and for all. My findings are as follows : 1 . The pipe was placed either by the developer and/or the home builder prior to August 1975 and as one homeowner indicated in his letter/prior to the building of the homes . 2 . To the best of my recollection, a discharge on the lands of Sailer was allowed behind Lot 410 until such time as the Town completed its Kent Road Storm Sewer. our records indicated that the tie-in was made around September 1977 when the Kent Road Storm Sewer was com- pleted. 3 . Your lawyer being far too broadminded, requesting a Z:� release of all my property instead of only that which is in the town easement. On the other hand, I must admit my lawyer's release was far too vague. Something in the middle would be more in order. '11,1y understanding of our agreement is that "I am completely satisfied with the town's proposed and existing drainage system on my property. I will not require any further improvements to this system within the boundries of my property." I will release the town from any liabilities past or present within their easements. However, I will not release the town from any liabilities resulting from failure of this system outside the bounds of my property. As you know, the 5 foot culvert on ny property flows into a 4 foot culvert which cannot handle all the drainage during peak periods. Rudy Lapar recommended the replacement of the 4 foot culvert five years ago. I would like to remind you that the extension of the pipe is Mr. Lapar's recommendation to prevent future erosion of my retaining wall and its eventual collapse into your easement. If your attorney would like to draw up a release--releasing the town from further improvement to their drainage easements, and for any liabilities past, present and future, within these easements I would be glad to sign it. If the above is not acceptable, please contact me as to a starting date to complete the job as it stands. In discussing the matter with Mr. Truett, it was his impression that the open part of the pipe would not end next to his foundation. Simply stated, the matter now must be decided by the Town Board. The next step would be to make an appropriate transfer from a source selected by the Town Board and to authorize the engineer to bid the work. Since there appears to be a reluctance on, the part of the Town Board to allocate any money to correct the deteriorating condi- tions , the residents of Angel Brook request that the Town Board: 1 . Investigate and give an accounting of the $105 ,000 bond of the Peerless Insurance Company. 2. Give the reasons why the bond was reduced to $44,000:, which , according to the Southern Dutchess News of September 23, 1971 , required the approval of Attorney Rappleyea. B. If, as reported by the Town Engineer Rudolph LaPar in the above mentioned article , the pipes in the develop- ment were not in accordance with the subdivision plans and not of hydraulically proper construction, why was action not taken by the Town to force compliance by the builder, Mr. Alpert. 4. Why should the residents of Angel Brook now be forced to live with the present conditions when prior action by the Town Board might have corrected the situation six years ago. The residents of Angel Brook will continue to do everything possible with the cooperation of the Town Board to correct any and all unsafe conditions in Angel Brook. It is Mr. Truett's feeling that he is willing to discuss a compromise in which he would make a contribution towards the materials necessary to complete the work in lieu of what -might be long and expensive litigation. In addition to a contribution of two lengths of the four necessary lengths of pipe to be installed, Mr,. Truett would be willing to grant the Town. of Wappinger the easement made necessary by the incorrect placement of the drainage pipe on Mr. Truett's property, It is my feeling and I am sure Mr. Truett concurs, that a meeting with.the appropriate officials of the Town of Wappinger to work out this agreement is necessary. Mr. Horton points out that Mr. Truett piped out a section of the stream, and built up the bank along the stream. The piping of the stream had something to do with increasing the velocity which Mr. Horton feels was Mr. Truett's responsibility. The Town does not believe it has any respon- sibility or liability, and that it is Mr. Truett's responsibility to protect his property if he feels it necessary to do so. Mr. . To date, I have heard nothing, In the time since our appearance before your Board, the situation created by your easement has become increasingly more dangerous. The danger to Mr,, Truett's property has increased considerably, and if the situation is not remedied it may actually become a danger to the foundation of his home. Of course, the danger to the local residents, particularly children, is still in existence despite the installation of some minor protective measures. The purpose of this letter is.- (1) to ask that you consider this matter again and enter into some serious discussions of a solution, and (2) to offically put you on notice that this dangerous condition does exsist, This easement, as presently situate, presents a serious danger to the residents of the area., particularly children, and an immediate danger to Mr, Truett's property, I would appreciate a response.
