Barbara Drive Drainage I PAGGI & MARTIN Consulting Engineers & Land Surveyors 54-56 Main Street Poughkeepsie, New York 12601 914-471-7 898 October 26, 1995 Town Supervisor Town of Wappinger `9 P.O. Box 324 Wappingers Falls, New York 12590 Attention: Constance 0. Smith Reference: 10 Barbara Drive/Derossi Dear Supervisor Smith: As you requested, I went out to the above referenced site to assess a drainage concern of the resident, Irene Derossi. Ms. Derossi concerns have to do with the existing low area that fills up with water in the rear of her property. I field inspected the site and noted that the area is rather large, and appears to have no outlet. The runoff to the "pond" appears to be generated from the general surrounding area and not from any road runoff. Ms. Derossi's request is to have the pond filled in by the Town. I explained to her that if there was not a legal reason that compelled the Town to do the work such as the existence of a drainage easement which requires maintenance and/or the fact that the Town was dumping water on the property, in all likelihood the Town would not get involved. I assured her, however, that I would review the filed map to determine whether or not there exists a drainage easement. have reviewed the filed map, and have enclosed a copy of it for your consideration. As you can see, the map shows no drainage easement, but does show the existence of a pond. Apparently, this pond has been in existence since the early 1960's when the subdivision was created. It is our opinion that the Town has no obligation to perform the work, and therefore, should not do so. Joseph E.Paggi,Jr.,P.E. Ernst Martin,Jr., P.E., L.S. printed on recycled paper I Constance O.
