The problems listed in this letter originate from the Bell Air Lane storm drainage construction project. Without some action on your part, all the burdens of the damage correction cost, will fall on my family. 1 . Flooding of Basement: a) Problem: Foundation drainage pipe buried during construction. This home foundation drainage , pipe has been installed prior the town's storm drainage construction. b) Corrective action re uired: Excavate foundation drainage pipe and redirect foundation drainage. c) Damage claim": Town government can't help" home owner on a timely basis , to drain flood water from basement, therefore home owner paid far corrective action construction cost, 2. Basement.wall and Foundation Cracks a) Problem: Damage to basement wall and foundation during rock and overburden explosion phase of storm drainage sewer construction. b) Corrective Action Required: Excavate basement wall and foundation overburden. . Repear wall and foundation cracks. Refill and landscape. c) Damage claim: Home owner and construction company insurance carriers refused: payment, to date, on .damage claims, 3. Easement. Exchange Between Home Onwer and the Town of Wa2pingers Falls a) Problem: Existing easement, assigned to the Town by home builder for drainage construction, is on the wrong location. Town Engineer and Attorney request., from home owner, easement relocation. b)' Corrective Action Required : Home owner to assign new easement to Town for drainage construction purposes , Town to return existing easement to home owner. -2- Damage Claim: Town board approves easement exchange. Town attorney receives new easement i authorization from home owner. Town attorney doesn't return easement on wrong location to homeowner. To answer the quoted statement I am enclosing a cry of the certified mail received and signed by Ms. Snowden. For your request of damage date, I am enclosing a copy of the latest letter received fromt Ms. Valerie Warburton the local representative of Wausau Insurance Company. The accident date was October 7,1980. For your request of "bills or proof of payment" I aro, enclosing a copy of a paid bill covering the cost of correcting the problem stated in item No. I in my May 12, 1982 letter. For your question "Yawn Attorney does not return easement on wrong location," I am enclosing a copy of a drawing dated 11./7/80 prepared by R.E. Lapar, F.E.D.C. Consulting Engineers, 90 East Main Street, Wappingers Falls, New York. This drawing is the engineers document, of the easement, that is described in my letter. I called this easement "the new easement". Item No. 3, sub- item b.} When construction started in October 1980 on my property I was notified by the engineer that the drainage construction on the "existing easement" is not feasible because the ground is solid boulder. We have agreed to the easement relocation. For your convenience I have illustrated the "existing easement" on an extra copy of the engineers drawing. This easement is registered with the county on a drawing illustrating the Bell-Air construction permit prepared in 1965. I wish to express this problem again. I want the "existing easement" back. I am also enclosing a cost estimate to repair the damages caused by the construction company. Stephen Petvai relative to the proposed easement for drainage. Your attention is addressed to the last paragraph of the letter which requests a certain release and other commitments on the part of the town. I have simultaneously with the writing of this letter requested an engineering opinion from Mr. LaPar' s Office, but would recommend that this matter be placed on the next agenda of the Town Board so that formal action can be taken if the board ' is receptive to the same. Re: Mr.and Mrs. Steven Petvai Proposed Easement for Drainage Dear Jon: Mr. and Mrs. Steven Petvai have consulted with me regarding the proposed- easement for drainage on .their property at 2 B.e1--Aire Lane, .Wappingers Falls, New York Mr. and Mrs Pet•fai feel that the easement as proposed is too large and is also incorrectly located. A fifty foot easement would include within its' boundries. our clients' septic field and one-half their oil tank. As an alternative: we propose. a twenty foot wide easement which would follow the natural line of the creek, which crosses the property and would be more in tune with the ambient physical characteristics in question. A'copy of the pertinent portion of the subdivision map with our proposed: easement sketched thereon is enclosed for your review. As you will note, the centerline of the twenty foot easement starts 34.7 feet from the southeast corner of our clients' property on the easterly line of said property and ends on a point 177 feet from the starting point on the southerly line of said property. Wewould appreciate your reviewing this matter with the. Town Engineer to see if our proposal is acceptable., Our clients arefully willing to cooperate in this, matter, and all they ask is that the easement be limited in size and location as to perform its function without encumbering their property to an unnecessary degree. In addition if this easement is granted, we would like to obtain a release from the Town of the useless twenty foot drainage easement on the filed map which runs along the entire southerly line of our clients' line. Also, our clients are experiencing water problems resulting from runoff from Allandin Court and Bel-Aire Lane. We would like to have .some commitment from the Town to install an additional Catch basin on Allandin Court and Bel-Aire Lane if the new drainage easement does not solve this problem. Lapar, P.E . SUBJECT: Resolution of concerns of Mr. & Mrs . Petvai, 2 Bel-Air Lane & Mr. & Mrs . King, Orange Court DATE: March 5, 1980 On March 5, 1980 Mr. William P. Horton and Rudolph E. Lapar, met with Mr. , & Mrs . Petvai and Mr. King - the results of the meeting are as follows : 1. The Town Highway Department will install. a catch or .inlet basin on A.11ad,in Court between Bel-Air Lane and Losee Road where a natural swale discharges waters across the lands of Petvai. 2 . If required, after the installation of the proposed Bel-Air Lane Storm Sewer Plan, the Town Highway will place a catch or inlet basin at or near the Petvai ' s driveway. 3 . An additional easement will be obtained from the Petvai ' s in order to allow the drainage pipe to re- main in the existing place . 4. The Eiew drainage pipe will be extended an additional 10 feet at the request of Mr. Petvai for valid rea- sons . Also the stream will be cleaned as required from end of pipe past Losee Road. 5 . The area between the last two (2) inlet basins on Orange Court will be stoned and allowed to leach in- to the main storm drain since high ground water and springs have been observed in the area . 6 . An attempt will be made to raise the grade in Orange Court turn circle so that the pocketing of water will MEMO: Town Board, Town of Wappinger March 5, 1980 FROM: Rudolph E . Lapar, P.E . no longer occur. This will be done as part of repavings after the proposed Bel-Air Lane Project is completed. 7. If the regrading of Orange Court does not elimi- nate all problems, possibly additional catch or in-- let basins will be added at a later date. Since the above work does not substantially increase the estimated cost above the proposed total construction estimate, they will easily be incorporated in the project': We believe that this resolves the concerns brought up at the Public Hearing.
