At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held
at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on May 14, 2018.

WHEREAS, on or about September 13, 2005, Boris Shtutman, President of S & Z Developers
Corporation (hereinafter the "Applicant") filed an application for Subdivision Approval under Application
Number 05-5110; and
WHEREAS, total escrow deposits in the amount of Forty -Eight Thousand Eight Hundred Sixty -
Seven 30/100 Dollars ($48,867.30) were received from the Applicant for payment of the fees of the Town's
professionals to review the application; and
WHEREAS, the Applicant has made a request to have the application withdrawn and the unused
escrow balance be refunded; and
WHEREAS, all professional fees incurred during the review of the application have been paid and
there remains a balance of Fifteen Thousand Three Hundred Sixty -Four 70/100 Dollars ($15,364.70) in
escrow account number 05-5110 and Applicant has requested a refund and the Town Accountant has audited
the escrow account and reviewed the amount due.
NOW, THEREFORE, BE IT RESOLVED:
The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby authorizes a refund to S & Z Developers Corporation, in the amount of Fifteen
Thousand Three Hundred Sixty -Four 70/100 Dollars ($15,364.70) from escrow account number 05-5110,
representing the unused escrow balance for the above project.
The foregoing was put to a vote which resulted as follows:
