2018-2302018-230 Resolution Authorizing Refund Of Unused Escrow For Dunkin Donuts Route 9D & Dunkin Donuts Route 9 Site Plans (Accounts 14-3307/16-6052pp & 15-3333) At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on October 9, 2018. WHEREAS, on or about May 12, 2014 under Application Number 14-3307/16-6052PP and July 23, 2015 under Application Number 15-3333, Chen Properties Group, LLC (hereinafter the "Applicant") filed applications for Site Plan Approvals; and WHEREAS, total escrow deposits in the amount of Nineteen Thousand Eight Hundred Nine 00/100 Dollars ($19,809.00) were received from the Applicant for payment of the fees of the Town's professionals to review the applications; and WHEREAS, all professional fees incurred during the review of the applications have been paid and there remains a balance of One Thousand Two Hundred Fifty -Six 00/100 Dollars ($1,256.00) in escrow account numbers 14-3307/16-6052PP and 15-3333 and Applicant has requested a refund and the Town Accountant has audited the escrow account and reviewed the amount due. NOW, THEREFORE, BE IT RESOLVED: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby authorizes a refund to Chen Properties Group, LLC in the amount of One Thousand Two Hundred Fifty -Six 00/100 Dollars ($1,256.00) from escrow account numbers 14-3307/16- 6052PP and 15-3333, representing the unused escrow balance for the above projects.
