At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held
at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on November 13, 2018.

The following Resolution was introduced by Councilman Kuzmicz and seconded by Councilman
Johnston.
WHEREAS, on or about September 18, 2017 under Application Number 17-3372, Durant's, LLC
(hereinafter the "Applicant") filed an application for Amended Site Plan Approval; and
WHEREAS, total escrow deposits in the amount of Three Thousand Seven Hundred Fifty 00/100
Dollars ($3,750.00) were received from the Applicant for payment of the fees of the Town's professionals to
review the applications; and
WHEREAS, all professional fees incurred during the review of the applications have been paid and
there remains a balance of One Thousand Eight Hundred Sixty -Eight 70/100 Dollars ($1,868.70) in escrow
account number 17-3372 and Applicant has requested a refund and the Town Accountant has audited the
escrow account and reviewed the amount due.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby authorizes a refund to Durant's, LLC in the amount of One Thousand Eight
Hundred Sixty -Eight 70/100 Dollars ($1,868.70) from escrow account number 17-3372, representing the
unused escrow balance for the above projects.
The foregoing was put to a vote which resulted as follows:
