I understand that all the funds allocated for this project were not expended during the first phase. I respectfully request that the remainder of the funds be frozen in place and remain allocated to this project so that subsequent phases are funded.The next phase that I hope will get done is the addition of the drainage I ine fi-orn the back of my property to the drain in the cul-de-sac.As you know that water comes from the runoff from the realignment of Widmer Road thru the Berberich pond and thru my yard to the neighbors yards on the way to the storm drains on Wildwood Drive. I hope to speak with you before the 12/14/98 work session and the 12/28/98 Town Board Meeting, I hope the legal formality of the easement,for that portion of my property under which the drainage pipe will run, can be handle expeditiously so that the work can be done before the Spring melt,thaw and rainy season arrive. First, 1 am not against this project or any other project that will help the residents of 'the. Town of Wappinger. I am only against the timing of the project and the lack of a written assurance that my property will be restored in a timely manner. As I indicated in my first letter, drainage work that was done in the front of my property took over two years to be completed and I am just looking for an improved schedule, I agree with Mr. Foster that road work should be done until the weather prohibits it. I think that we are there now. We are entering the winter months and no way can my driveway or the side of my property be restored before the winter. Blacktop can not be applied now and grass will not grow. This means that I will be severely inconvenienced for the next six months. This is not an emergency, the problem existed for the last 33 years, Mr. Foster indicated that the town right of way will be restored, but he did not mention my property. Unless he is going to dig the trench by hand, he has to go on my property with his back hoe. The fence that is along the side of my property and my driveway will be impacted. I do not want my year old driveway patched. Mr. Foster, also, indicated that in the spring he is working on non highway work for ten weeks. Perhaps this work can be moved to a different time: of'the year so the highway department can complete their highway work before the weather prohibits it. I appreciate your help in this matter. Fanuele ' s letter concerning the above project . On several occasions Mr. Fanuele has expressed his objections to the town undertaking this project . The property where the excavation is taking place is on town property and does not belong to Mr. Fanuele . The town right of way will be restored to as is condition as soon as possible including where Mr. Fanuele ' s driveway crosses it . Mr. Fanuele ' s suggestions for timing of the project is a valid concern . However , if the residents of Wappinger insist on our Highway Dept . doing non highway work for ten weeks each Spring we must continue our road projects until winter prohibits any work being done . I have rescheduled our start time for this project to 7 AM Monday 11/17/97 . 1 sincerely hope we will not suffer any further interruptions in this schedule . I went out to see what was going on. I was told for the first time that drainage pipes were going to be put in. They marked my driveway with a line and proceeded to cut it. At first 1 accepted the work, because I was completely court off guard . But I thought about it and I became annoyed that I was never informed about the work or how my property would be restored. I was then told that my year old driveway would be patched. On hearing this I got upset and ask them to get off my property. Their was some discussion of who owns what, but they stopped the work and left. I would also like to mention that a couple of years ago the front of my property was dug up to put in drainage pipes and it took over two years and countless requests to the Highway Department and the Town Board before the work was completed. I do not want to wait that long before the side of my property is completed. I did not have a drainage problem before the front of my property was dug up and I do not have a drainage problem now. I do not mind helping my neighbors but my property should be restored to its original condition in a timely manner. In conclusion, I would like some written assurance that my property will be restored in a timely manner, and that I will get a completely new driveway and not a patched-up one, because that is what I have now. To do the work at this time of the year is preposterous. I would have mud on the entire length of my property and a incomplete driveway all winter. This work s1hould be done in the spring or summer so the restoration work can be completed before the winter and snow comes. Attached is a copy of a letter from Mr. Greg Sarno to former Supervisor Lou Diehl dated 4 /2.6/78 . At that time Mr. Diehl referred the matter to the Town Board. We should look at the Town Boardminutes to see what was decided in 1978 . I first got involved in this project several years ago when several homeowners on Wildwood Drive and Dana Place complained of problems associated with storm runoff. My original investigation convinced me that this was a private matter which. did not involve the Highway Dept . The water came from private property and mainly affected private property . Over the years residents of Wildwood Drive installed pipes to try to channel this flaw to the storm system on Wildwood Drive . 'These we-re=mostly unsuccessful . A good share of the water in question did gather along the southerly shoulder of WildwoodDrive causing ice to form in the winter months and some ponding of water during the remainder of the year . Before paving Wildwood Drive in 1995 I installed a curtain drain along the southerly side of Wildwood Drive to keep the water_ off the road . During the severe winter of 95/96 we experienced little to no ice in this area and any ponding did percolate into the curtain drain after a short period of time . Over the entire period of time I was still convinced that the cause of the problem was a private matter until at the urging of Jay Paggi I did visit the area during periods of high runoff. I witnessed a very small amount of runoff coming from the driveway area of 14 Dana. Place which flowed for a short distance across the cul de sac in front of 13 and ran off onto the lawns at 11 . Since it has been the position of our Town professionals that water exit- ing a town road is our responsibility I felt the only way I could control this water was to install a drain down Dana Place to Wildwood Drive . I estimated this cost at just under $50 , 000 . This pipe was intended to control. the water from the driveway of 14 and would also capture the runoff from Dana Place which currently runs down the street until it reaches the basins on Wildwood Drive . In addition the drain would also be capable of carrying the. water which enters Mr. Sarno ° s yard in the rear. . This would be accomplished by the Town accepting an easement from Mr . Sarna or allowing Mr. Sarno to put in a pipe which would enter our storm drain . - 2 - Since the $50 . 000 I had budgeted for this project was removed from my budget I have made no plans to attempt this job during our 1996 construction season. If the board sees fit to proceed with this job with our Town personnel it would not happen this year. If the board goes with the "open ditch" plan Mr. Lapar and I foresee the following problems, for which we have no answers: 1. How do we keep the ditch clean so it will be fully functional? (Snow plowed off road into ditch line; driveways plowed into ditch line; sand, etc. ) 2 . How do we cross driveways? An open ditch causes a large bump at the driveway, and there would not be enough depth to install a pipe under the driveway, which would result in frost-heave. Additionally, if it were possible to install a pipe under the driveway, who would maintain it? 3. What do we do with the water below the point of discharge? Past experience shows both the north and south corners at the intersection of Dana and Wildwood have drainage difficulties already. 4. The residents claim there is no problem in the summer months when, apparently, water is able to be absorbed into the ground. What happens in the winter when the ground is frozen? Also, the water in the ditch line will not be able to travel the necessary distance without freezing, resulting in the same condition that now exists. Again, I repeat, if the board decides to go with the "open ditch" method, Mr. Lapar and I do not have the answers to these problems. Very truly yours, William P .
