party of the first part, and
TOWN OF WAPPINGER, a municipal corporation, organiz'ed and
existing under the laws of the State of New York, and maintaining an office fdr the
transaction of business at Mill Street (no street number designated), in the Village
of Wappingers Falls, Town of Wappinger, Dutchess County, New York,

Place, Brian Place, Russ Place, Wendy Road, Dennis Place, Gary Place, Beth
Place and Wildwood Drive, on a certain map entitled "Wildwood Forest", which map
was filed in the office of the Clerk of the County of Dutchess on the 15th day of
January, 1964, as Map No. 3176 and which parcels are shown and designated as road 3
on the said map.
EXCEPTING AND RESERVING therefrom title to all water pipes and
water and sewerage equipment and pipes now or hereinafter installed in the bed of
the aforesaid premises.
EXCEPTING AND RESERVING to the parties of the first part, its
successors and assigns the right to enter upon and make repairs to the said pipes,
water, sewerage and related equipment and the right to lease pipes for water and
sewerage and to maintain, operate and remove said pipes and to return and repair
the same, over and on the lands described, upon the condition that upon completion
of any such repairs or installation of any pipes of any description, the party of the
first part shall restore the premises to their original condition.
