Dear Mr. Hoferichter:
Please be advised that I am attorney to Town of Wappinger. I enclose
herewith photocopy of a letter dated August 5 , 1991 , addressed to me
from Mr. Charles R. Del Bene, Jr. of Paggi and Martin, Engineers to
the Town of Wappinger.
Also enclosed please find photocopy of a portion of a map prepared by
Maggi and Martin in connection with the installation of a certain pipe
to be installed to the north of your common property line. As
indicated in Mr. Del Bene ' s letter, as part of the installation, the
Town would like to grade the area as shown on said map, so as to
prevent ponding of storm water on the common property line. In order
to do so, the Town will require written permission from you.
Accordingly, I enclose herewith a Release and Consent to be signed,
notarized and returned to me. If you have any questions, please
contact my office .

RELEASE AND CONSENT FOR TEMPORARY EASEMENT
The undersigned, the sole owners of Parcel No. 1 depicted on the
attached Schedule "A" , hereby grant to the Town of Wappinger, a
municipal corporation with its place of business at 20 Middlebush
Road, Wappingers Falls , NY 12590 , a Temporary Easement and Right of
Way for the sole purposes of grading the undersigned' s real property,
in the area designated "AREA REQUIRES TEMPORARY GRADING EASEMENT" as
set forth on the attached Schedule "A" . This Temporary Easement and
Right of Way is given for the sole purpose of granting to the Town of
Wappinger, its agents , servants , contractors and sub-contractors the
right to grade the undersigned ' s property in the area designated so as
to prevent ponding of surface and storm water.
This Temporary Easement and Right of Way shall terminate on
December 15 , 1991 . Upon conclusion of the grading, the Town of
Wappinger shall have no responsibility whatsoever to maintain the area
so regraded.
