Resolution Authorizing Refund Of Unused Planning Board Escrow Review For M&C Of
Dutchess
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New
York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on January 14, 2019.

The following Resolution was introduced by Councilman Johnston and seconded by Councilman
Kuzmicz.
WHEREAS, on or about July 17, 2018, M & C of Dutchess Inc. (hereinafter the "Applicant")
made a deposit in the amount of Three Thousand Seven Hundred and Fifty Dollars ($3,750.00) to be
held in escrow to reimburse the costs of the Town of Wappinger Planning Board consultants for their
review of the Applicant's Site Plan Application before the Board; and
WHEREAS, the consultants completed their review and the Chairman of the Planning Board
signed the approved Site Plan for the Project; and
WHEREAS, the Applicant has requested that the unused balance of the Road Inspection Escrow
Account be returned; and
WHEREAS, the Town Accountant has audited the escrow account and has verified the amount
due to the Applicant.
NOW, THEREFORE, BE IT RESOLVED:
The Town Board hereby authorizes a return of the unused balance of the Planning Escrow in the amount
of One Thousand Six Hundred and 50/100 Dollars ($1,600.50) to M & C of Dutchess Inc.
The foregoing was put to a vote which resulted as follows
