Fanuele, seconded by Mr . Keller, to waive the sewer and water easement as shown on filed map # 6264 and to accept the change in said easement as approved by Mr., Rudolph E. Lagar, Engineer to the Town and further, a note to this affect shall be placed on the "as-built" plans for lots 5 and 6 reflecting the change on the installation of water lines and sewer lines to serve these lots . Ms. Davis: At their July 20th, . 1981 meeting, the Tovm of 13appinger Planning Board adopted. the following resolution: WHEREAS,. an application for final approval of a subdivision plat entitled "Lands of Regina Davis, Town of Wappinger, Dutchess County, New York" was received by the Town of Wappinger Planning Board on July 6th, 1981 , and VVIIEREAS, ` a final public hearing is waived by the To.im of Wappinger Planning Board, and. i , VjHEREAS, the requirements of the Subdivision Regulations .o f the Tov,'n of Wappinger have been met by said subdivision, plat and application, except as noted below, and WHEREAS, the conditions of the preliminary approval of said subdivision plat, granted by the .Totim of Wappinger Planning Board on July 6th, 19819 have been met, except as noted below. D10W3, THEREFORE, BE IT RESOLVED THAT the application of Regina Davis for approval- of said subdivision plat, prepared by Richard G. Barger, P.E. & L.S. , and dated 4/21/813, rev. 5/18/81 &c 6/24/81 , be approved subject to the following conditions, and that the Chairman be authorized to endorse approval on said "subdivision plat upon compliance frith said conditions by the applicant, which conditional approval shall: expire six (6) months from the date of , this resolution if the applicant. has not complied -vi-ith the conditions set forth. Driveway permits for lots 1 , 2� 3, & 4 shall be ob-ta�.ned from the .Tovm of VTappinger i1ighway Superintendent prior to. the issuance of any building permits. 4. Downstream drainage fee of x$200.00 for each of the newly created building lots shall be paid prior to the signing of the plat. . ($1 .,200.00) 5. A nate shall be placed on the. plat shoNri,ng, that water can drain across the lands of others until it reaches a Town road. 6. No grading will be done or other action taken that .will alter the natural drainage patterns that now exist, 7. The storage tanks on the property must be removed from- the premises prior to the start of any construction. 8. No structure is to be built where the lowest opening (vrindows, doors,. garage doors, crawl spaces, etc.) are lower than two f eet above the finished road surface unless _approved by the.- Highway Superintendent and/or the Engineer to. the To7m. All footing drains and roof leaders, if specified by the Building Inspector, shall be piped into the storm drainage system. 10. Prior to the sale of either of lots 5 or .6, the existing old foundation shall be removed. 11.
