2019-532019-53 Resolution Authorizing Attorney To The Town To Bring Actions In The Name Of The Town At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on February 11, 2019. Beale Voter 2 ❑ ❑ ❑ ❑ Tabled Angela Bettina Seconder Q ❑ ❑ ❑ ❑ Withdrawn Christopher Phillips Voter Q ❑ ❑ ❑ Michael Kuzmicz Mover Q ❑ ❑ ❑ WHEREAS, New York Town Law §65 authorizes the Town Board to authorize officers of the Town to bring civil actions on behalf of the Town; and WHEREAS, County Law §700 permits the District Attorney to authorize others to prosecute criminal offenses within the County; and WHEREAS, the Town Board wishes to authorize the Attorney to the Town to prosecute violations of the Town of Wappinger Code, the NYS Uniform Code, the Vehicle and Traffic Law, and other violations under the Penal Law, with the exception of violations that involve incidents of Domestic Violence and those that occur on school property; NOW, THEREFORE, BE IT RESOLVED 1. The Town Board hereby authorizes the Attorneys to the Town, Wallace & Wallace, LLP to bring civil actions for the enforcements of the Town Code and the NYS Uniform Code. 2. The Town Board hereby authorizes James P. Horan, Esq.; Paul Ackerman, Esq. and Lisa Cobb, Esq. to act as Prosecutors of violations of the Town of Wappinger Code, the NYS Uniform Code, the Vehicle and Traffic Law, and other violations under the Penal Law, with the exception of violations that involve incidents of Domestic Violence and those that occur on school property, subject to proper authorization received from the Dutchess County District Attorney. The Town Clerk is hereby directed to provide a certified copy of this resolution to the Dutchess County District Attorney.
