RE: FLYING ARROW RESOLUTION OF SPECIAL USE PERMIT
APPROVAL
At a regular meeting of the Planning Board of the Town of Wappinger; Dutchess
.County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York
on the�day of 1 ; L.2008 at 7:30 PM.
The meeting was called to order by Chairmaan Victor Fanuele and upon roll being
called; the following were:

WHEREAS, the Town of Wappinger Planning Board received an application from
Airport Drive Properties, LLC (the "Applicant") and Scott A. Neave (the "Owner") for
Special Use Permit Approval to modify 4,875 square feet of interior space (Suites # 103,
104 and 105) for use as the Flying Arrow Sports Corporation indoor archery range;
reception area, regional headquarters office, and regional distribution and storage center in
an existing 9-suite building (the "Project" or."Proposed Action"); and
WHEREAS, the±4.25-acre site is located at 80 Airport Drive in the Airport Industry
(AI) zoning district and is identified as Tax Lot 6259-04-68645.0 on the. Town of
Wappinger Tax Maps (the "Site" or "Subject Property"); and
WHEREAS, the Applicant has submitted an Application for Special Use Permit,
dated January 11, 2008; a statement of use, dated January 11, 2008; an Owners Consent
Form, dated January 11, 2008; a Short Environmental Assessment Form; dated January 11,
2008; P1: Plumbing Plan for Airport Drive Properties, prepared by Sloan Architects,.PC,
dated May 25, 2004, with latest revisions dated August 1.8, 2004; and "Flying Arrow Sports

February 8, 2009; and
WHEREAS, the Planning Board originally granted. Site Development Plan Approval
by resolution dated March 1, 2004; and
WHEREAS, the Planning Board is 'is with the Site and all aspects of the
Project and has been satisfied that the Project will comply with the Special Permit standards
of Article VII and Section 240-72, the Performance Standards of Article XI of the Zoning
Law, as well as other applicable laws and regulations subject to the conditions below,
except as otherwise noted; and
WHEREAS, the Planning Board determined that the Proposed Action is an ,
Unlisted action in accordance with the State Environmental Quality Review Law:
(SEQRA) and the' Wappinger Environmental Quality Review Law (WEAR):
NOW, THEREFORE, BE 1T RESOLVED AS FOLLOWS:
1. The Planning Board hereby adopts and incorporates the recitations and statements
set forth above as if fully set forth and resolved herein.
2. Pursuant to State Environmental Quality Review regulations, the Planning Board:
hereby adopts a Negative Declaration on the grounds that the.proposed.action will
not result in any significant environmental impacts or any land disturbance.
3. The Planning Board hereby makes the following findings in accordance with Section .
240-44,.General Standards, of the.Zoning Law:
a. The-location and size of the use; the nature and intensity of the operations
involved in or conducted in connection with it, the size of the site in relation
to it and the location of the site with respect to streets giving access to it, are
such that.it will be in harmony with the appropriate and orderly development
of the district in which it is located.
b. The location, nature and height of buildings, walls, fences and the nature and
extent of.existing or proposed plantings on the site are such that the use will
not hinder.or discourage the appropriate development and use of adjacent
land and buildings.

C. Operations in connection with any special permit use will not be, marc
objectionable to nearby properties by reason of noise, fumes, vibration,
illumination or other characteristics, than would be the operations of any
permitted use not requiring a special permit.
d. Parking areas will be of adequate size for the particular use, will be properly
located and suitably screened from adjoining residential uses and the entrance
and exit drives shall be laid out so as to achieve maximum safety.
C. The location, size of use, nature and intensity of operations, and size of the
site are appropriate.
4. The. Planning Board hereby finds that the proposed use will conform with the
special requirements of Section 240-72 of-the Zoning Law.
5. The Planning Board hereby grants Special Permit Approval to the Project; involving
the modification of 4,875 square feet of interior space (Suites # 1.03, 104 and. 1.05)
for use as the Flying Arrow Sports Corporation indoor archery range, reception
area, regional headquarters office, and regional distribution and storage center in
an existing 9-.suite building, in accordance with the provisions of the Special Permit
standards of Article VII and Section 240-72, the Performance Standards of Article
XI of the.Zoning Law, as well as other applicable laws and regulations subject to
the conditions below.
6. Prior to a Building Permit being issued to the Project the Owner/Applicant shall:
a. Pay all applicable fees.
b. Endorse a copy of this Resolution and shall submit same to. the Zoning
Administrator for filing, and
c: Revise thedrawing specified above entitled "Flying. Arrow Sports Corp.
Special Use Permit Review" .so as to show .compliance with the parking
requirements of the Zoning Law.
d. Satisfy the.Building Inspector relative to the internal layout of the Project
from a safety perspective, and also in terms of all rules and regulations
pertaining to the proposed use being properly enforced.

7 In accordance with the Town's Schedule of Fees, the Applicant: shall. be responsible
for the payment of all application review fees incurred by the Planning Board in the
review of this Project which are in excess of the application review fees paid by the
Applicant to-date. Such fees shall be paid within thirty (30) days of the notification
to the Applicant that such fees are due. If such fees are not paid within this thirty
(30) day period and an extension therefore has not been granted by the Planning
Board, this. Resolution shall be rendered null and void, Refunds of any.re,maining.
funds within the escrow account for the applications will not be made until six (6)
months after the issuance of the Building Permit:for the Project.
8. In accordance with Section 240-46 of the Zoning Law, unless otherwise extended
by the Planning Board for good cause shown, this Special Permit Approval shall
expire and become void one .(11) ,year from the date of the adoption of this
Resolution if work on this Project is not initiated pursuant hereto, ox if the..
proposed uses shall cease for more than one (1.) year for any reason, or if all ,such
required improvements are'not maintained and all.conditions and standards are not
complied with throughout the duration of the subject use.
9. The Planning.Board Chairman shall endorse a copy of this resolution certifying its
correctness. The Applicant and. Owner shall also sign a copy .of this resolution
after it has been initially endorsed by the Planning Board Chairman acknowledging :
his receipt of a copy of the resolution. When all. of the conditions set forth:above
have been satisfied the Planning Board Chairman shall endorse this resolution in.
the space provided below, certifying that the applicant has complied with the
above conditions of approval.
10. The Applicant must return for approval from the Planning Board if any changes to
this resolution of approval are subsequently desired.
I L The Resolution of Site Development Plan Approval adopted by°the Planning Board
on March 1, 2004 shall remain in full force and effect except as modified herein.
