DiNonno Boardmembers - Guy Gagne - Rick Harrison - Bill Kickham - Regina Pace - Ronald Roberts - Al Weitlich The foil yvi g Tesojution was moved by and seconded by WHEREAS, the Town of Wappinger Planning Board received an application from Patrick Gigliotti (the "Applicant") on behalf of Patrick Gigliotti, Joseph Gigliotti, Paul Gigliotti and Stephanie Gigliotti (the "Owner(s)") for amended subdivision plat approval for the construction of a common driveway to serve Lots 2A and 213 of the Gigliotti Subdivision previously approved by the Town of Wappinger Planning Board on March 1, 2004 (the "Project" or "Proposed Action"); and WHEREAS, the properties are known as Tax Lot 19-6359-03-038047 (Lot 2A) and Tax Lot 19-6359-01-112963 (Lot 2B) on the Town of Wappinger Tax Assessment Maps and are located near the intersection of Diddell Road and Route 376 in the R-40 zoning district in the Town of Wappinger (the "Site" or"Propert(ies)"); and WHEREAS, the Applicant has submitted a Short Environmental Assessment Form dated May 25, 2006 and the following two sheets of plans prepared by Michael Gillespie, Hopewell Junction, New York: I. Sheet 1 of 2, "Shared Driveway Plan for Gigliotti," dated 05/24/0,6, GIGLIOTTI COMMON DRIVEWAY RESOLUTION OF AMENDED SUBDIVISION PLAT APPROVAL 2. Sheet 2 of 2, "Proposed Shared Driveway Plan for Gigliotti," dated 05/24/06 and last revised 07/27/06; and WHEREAS, the Project is an Unlisted Action with respect to SEQR and WEQR; and WHEREAS, the Planning Board is familiar with the Subject Property and its surroundings, and has reviewed the project in accordance with the recommendations of the Town Comprehensive Plan, the standards for approval contained in the Zoning Law and the Land Subdivision Regulations; and WHEREAS, a duly advertised public hearing on the amended subdivision application was held on July 17, 2006 in the Wappinger Town Hail, 20 Middlebush Road, Wappingers Falls, New York, at which time all those wishing to be heard were given the opportunity to be heard, and the public hearing was subsequently closed on that date; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The Planning Board hereby adopts and incorporates as findings and determinations the recitations and statements set forth above as if fully set forth and resolved herein. 2. The Planning Board hereby grants Amended Subdivision Plat Approval to the Project for the construction of a common driveway to serve Lots 2A and 2B of the Gigliotti Subdivision previously approved by the Town of Wappinger Planning Board on March 1, 2004 subject to the following conditions and modifications: a. The Property Owner and Applicant shall endorse and submit a copy of this Resolution to the Zoning Administrator for filing. b. The Applicant shall submit a statement signed by the Town's Tax Collector that all taxes due on the Subject Properties have been paid in full. C. The Applicant shall respond to all comments contained in the Town Engineer's 08/08/06 memorandum and/or any other subsequent memoranda, and revise the plans as necessary, to the satisfaction of the Town Engineer. d. The Applicant shall respond to all comments contained in the NYSDOT letter, dated July 14, 2006, and revise the plans necessary, to the satisfaction of the NYSDOT and the Town Engineer. 2of5 GIGLIOTTI COMMON DRIVEWAY RESOLUTION OF AMENDED SUBDIVISION PLAT APPROVAL The Applicant shall prepare an amended subdivision plat in accordance with Appendix A, Section. A-5 of the Town of Wappinger Land Subdivision Regulations. f. The Applicant shall provide driveway easements and maintenance agreements to the satisfaction of the Town Attorney. 3. Temporary and permanent stormwater facilities shall be repaired as needed to ensure that they function properly throughout the duration of the construction process. 4. The Owner's professional representative shall be required to remedy promptly, as reasonably required by the Town Building Inspector, Town Engineer, Town Highway Superintendent, or other authorized agent of the Town of Wappinger, any material failure of erosion control measures or stormwater facilities before additional site area may be exposed. 5. The Town Building Inspector, Town Engineer, Town Highway Superintendent, or other authorized agent of the Town of Wappinger will have the authority to require and the Applicant reserves the right to place additional erosion control measures on an as-needed basis. 6. In accordance with the Town's Schedule of Fees, the Applicant shall be responsible for the payment of all application review fees incurred by the Planning Board in review of this Project which are in excess of the application review fees paid by the Applicant to-date. Such fees shall be paid within thirty(30) days of the notification to the Applicant that such fees are due. If such fees are not paid within this thirty (30) day period and an extension therefore has not been granted by the Planning Board, this resolution shall be rendered null and void_ Refunds of any remaining funds within the escrow account for the applications will not be made until six (6) months after the filing of the subdivision plat. 7. Conditional approval of the amended subdivision plat shall expire one hundred eighty (180) days from the date of this resolution unless all requirements have been certified as completed or unless a written request for an extension of Amended Subdivision Plat Approval (not to exceed two (2) ninety (90) day periods) is granted. 8. The Planning Board Chairman shall endorse a copy of this resolution certifying its correctness. The Applicants shall also sign a copy of this resolution after it has been initially endorsed by the Chairman acknowledging his receipt of a copy of the resolution. (the "Applicant" and "Property Owner") for the subdivision of one 87.1 acre parcel of land into four (4) lots, 12.21 acres (Lot 1), 59.19 acres (Lot 2), 8.16 acres (Lot 3), and 7.53 acres (Lot 4) in size (the"Project" or"Subdivision"); and WHEREAS, the subject property is located on the west side of NYS Route 376 approximately 2,000 feet north of the intersection formed by Route 376 and Myers Comers Road; and. The Owner shall endorse a copy of this resolution.and submit it to the Planning Board for its Files. db. The Applicant shall prepare a Final Subdivision Plat in accordance with Section A-5 of the Town of Wappinger Land Subdivision Regulations. Said Final Subdivision Plat shall correctly reference the subdivision as a four (4) lot subdivision. \,c. The Applicant shall submit the final plat to the Dutchess County Department of Health for its review, approval, and signature for the sanitary sewage disposal system and the water supply system. \d. The Applicant shall submit a statement signed by the Town's Tax Collector that all taxes due on the subject parcel have been paid. \\e. The final plat shall be signed and sealed by a licensed land surveyor. 1 The revised plat shall indicate the sight distances at the curb cuts and shall also indicate any improvements which may be needed to achieve sight distances meeting the Town standards. \19. The plat shall be revised so that the overflow from the sedimentation basin to proposed Lot 3 shall be diverted easterly toward the roadway and not in the direction of the existing residential lots, or other appropriate measures shall be taken to the satisfaction of the Town Engineer. h. The plat shall be revised so that the stormwater diversion swale on the north side of Lot 2 is extended along the westerly side of the sewage disposal system for Lot 1 to the holding pond which is shown on the plat, and the holding pond shall be redesigned to include appropriate overflows to the satisfaction of the Town Engineer. 3 GIGLIOTTI SUBDIVISION RESOLUTION OF FINAL PLAT APPROVAL �. The Applicant shall resolve, to the satisfaction of the Town Engineer, an g � y discrepancies between the Highway Work Permit issued by the New York State Department of Transportation and the subdivision as proposed. In particular, the NYSDOT Highway Work Permit is for three (3) shared driveway curb cuts, whereas only two (2) shared driveway curb cuts are proposed for the four (4) lot subdivision.The Applicant shall revise the plat to include a note referencing the Highway Work Permit and reiterating any conditions of said permit, such as the condition that any future subdivision will not be able to use curb cuts unless approved by both the NYSDOT and the Planning Board. �j. The plat shall be revised to show a construction phasing schedule for each of the proposed lots to the satisfaction of the Town Engineer. The phasing schedule shall indicate that erosion and sedimentation measures and stormwater management measures shall be installed first. k. The Applicant shall pay all applicable fees. Conditional approval of the final plat shall expire one hundred eighty (1$0) days from the date of this resolution unless all requirements have been certified as completed or unless a written request for an extension of Final Subdivision Plat Approval(not to exceed two(2)ninety(90)day periods)is granted. 5. No Certificate of Occupancy will be issued until the lot bounds are staked out and a possession survey of premises is filed with the Building Inspector containing a note that stakes have been set as shown thereon. 6. The model shall be revised to include a swale and stone lining as shown ort the plata. . (b) The driveway detail appears to show no or little cover on the „ 12" culvert. At least one foot of cover shall be provided. (c) The PSE notes shall be moved or leadered in to better show the contour lines and edge.of driveway. The Applicant-shall.prepare the necessary legal documents to,the satisfaction of the Town Attorney, including;but not limited to easements for the use of the common driveway areas and maintenance agreements therefor. 5. Conditional approval of the final plat shall expire one hundred eighty (180) days -from the date of this resolution unless all requirements have been 'certified as completed or unless a written request for an extension of Amended Final Subdivision Plat Approval (not to exceed two (2) ninety (90) day periods) is granted. 6. In accordance with the Town's Schedule of Fees,the Owners shall be responsible for the payment of all application review fees incurred by'the Planning Board in review of this Project which are in excess of the application review fees paid by the Owners to=date. Such fees shall be paid within thirty (30) days of,the notification to the. Owners that such fees are due.
