revision. In the center of the surety bond , there is a blank space. The following language should be
inserted in that space: Morris Associates by letter dated July 23, 2009 as incorporated in a performance
agreement dated.September 1, 2009 between the Widmer Inn Restaurant Corp and the Town of
Wappinger.
Additionally,the Obligee for the bond is the Town of Wappinger, not the Town of Wappingers Falls.

Dear Board Members :
At your request we have analyzed the reduction of the downstream
drainage fees for the proposed Villa Borghese Site Plan.
They are proposing 6, 134 square f000t of building addition and
approximately 27 , 000 square foot of additional paving. At 15�
a square foot, this equals a downstream drainage fee of $4, 970 .
This conceivably could be reduced by $195. as there is a 1300
square foot existing patio. This would result in the fee of
$4, 775. At the request of Ken Croshier, Highway Superintendent
and this office, the developers of the above site plan are piping
their storm water runoff to an existing stream approximately
600 feet due north of the subject property. This closed storm
drain system will run parallel to existing Widmer Road. This
closed storm drain systei-a will not only convey the site generated
runoff but will also capture the street runoff and direct it to
the existing water course. This is a definite improvement and
benefit to the residents of the Town of Wappinger. The approximate
construction value of this 600 foot of pipe with associated
drainage structures could be valued at $30, 000 . It could be
argued that the Town is not receiving full benefit of this value,
however, it is my opinion they are receiving substantially more
than half of this projected construction value. This would place
it far over the anticipated fee that would be realized from a
project of this size.

At the February 8th, 1988 meeting of the Town of Wappinger Planning Board, a
motion was made by Mr. Mills, seconded by Mr. Keller to adopt the following resolution:
BE IT RESOLVED THAT THE PLANNING BOARD OF THE TOWN OF WAPPINGER HEREBY GRANTS FINAL
AMENDED SITE PLAN APPROVAL to the Villa Borghese for a site plan entitled, "Proposed
New Addition to Villa Borghese Caterers, Widmer Road, Wappinger Falls, New York",
dated 6/19/86, and revised 11/30/87, 12/21/87, 1/22/88, prepared by Frank Pannone, P.E. ,
and subject to the following conditions:
1. Approval of the Dutchess Co. Dept. of Health on water supply and sewage disposal
shall be obtained prior to final approval.
2. Approval of the Town of Wappinger Highway Superintendent shall be obtained on entrance
and exit prior to final approval.
3. Downstream drainage fee of $ . 15 a square foot for newly constructed roofed areas
and areas covered with impervious material shall be paid prior to the issuance of a
building permit.
4. An erosion control plan shall be approved by the Engineer to the Town and the
Conservation Advisory Council prior to final approval in accordance with the requirements
of the Town of Wappinger Soil Erosion & Sediment Control Ordinance.
5. An application shall be made to the Zoning Administrator for a grading permit which
shall meet the Soil Erosion & Sediment Control Ordinance requirements, including
submission of a plan showing design and materials. A month by month schedule shall be
submitted to the Zoning Administrator prior to final approval.
6. A drainage plan shall be approved by the Engineer to the Town prior to final approval.
The Conservation Advisory Council shall be given an opportunity to review the plan.

7. A copy of the building plans shall be supplied to the Fire Prevention Bureau for
their review prior to the issuance of a building permit.
8. The Fire Prevention Bureau shall inspect the premises prior to the issuance of a
Certificate of Occupancy.
9. Any signs to be located on the premises and/or building shall comply with the
requirements of the Town of Wappinger Zoning Ordinance.
10. Adequate screening shall be required for the refuse enclosure as determined by the
Planning Board.
11. site lighting shall be submitted and reviewed by the Zoning Administrator prior to
final approval to insure that there will be no glare onto roadways and/or adjacent
residential areas.
12. Landscaping shall be required as determined by the Planning Board.
13. A certified, as built plan shall be submitted and approved by the Planning Board
prior to the issuance of a Certificate of Occupancy.
14. Upon completion of all requirements set forth in the action approving the site plan
6 copies of the site plan shall be submitted for the Planning Board Chairman's
signature.
15. The parking shall be reviewed after one year to determine whether itis adequate.
16. Approval if subject to the letter from the Engineer to the Town dated January 28th,
1988.
17. The deed for the highway taking shall be accepted by the Attorney to the Town and
the Engineer to the Town prior to the signing of the plat.

BE IT RESOLVED THAT THE PLANNING; BOARD OF THE TOWN OF
WAPPINGER HEREBY GRANTS AMENDED SITE PLAN APPROVAL to Stanley
and Gino Porco, for site plan entitled "Proposed Addition to
Villa Borghese Restaurant, Widmer Road, Wappingers Falls, N.Y. ",
prepared by Louis Battoglia, Registered Architect, dated September
30th, 1981, revised 10/16/81, subject to the following conditions:
1. Parking spaces and entrance/exit shall be clearly
delineated to the satisfaction of the Building Inspector.
2. Buffering shall be provided along the residential properties
as required by the Building Inspector. I
3 . Landscaping and lighting plan shall be approved by the
Building Inspector prior to the issuance of a building permit.
4. Five additional parking spaces are required to be shown
and a $30.00 fee for the parking spaces shall be paid prior
to the issuance of a building permit.
5. Downstream drainage fee of $ .15 a square foot for newly
covered roofed areas and new areas covered by impervious material
,. shall be paid prior to the issuance of a building permit.

6. A copy of the building plans shall be given to the
Fire Prevention Bureau.-,for their review and approval of the
site plan.

7. If there is to.be any additional paving, a permit would
have to be obtained and additional downstream drainage fee
would have to be obtained prior to the paving.
8. The Building Inspector shall contact the Health
Department and obtain their approval if .required prior
to the issuance of a building permit.

At their March 17th, 1980 meeting, the Planning Board of
the Town of Wappinger, adopted the following resolution:
BE IT RESOLVED, THAT THE PLANNINGIBOARD OF THE TOWN OF
WAPPINGER HEREBY GRANTS final site plan approval to, Mr . Stanley Porco
for site plan entitled "Villa Borghese, Town of Wappinger, Dutchess
County, New York", dated 11/24/79 and revised 1/5/80, 1/18/80 and
2/11/80, prepared by Richard G. Barger, P.E . & L.S . , and subject
to, the following conditions;
1. Approval of the Dutchess County Department of Health,
if required by said department, shall be obtained prior
to the issuance of a building permit.
2 . Parking spaces shall be clearly delineated by means of
bumpers, plantings, etc. , to assure proper traffic flow on
the site.
3 . Any further expansion of the building would require
an Environmental impact Statement pursuant to the local
S.E.Q.R. law.
4. A copy of the bililding plans shall be supplied to the
New Hackensack Fire Company for their approval prior to the
issuance of a building permit.
5 . Applicant shall comply with recommendations I thru 5
of the New Hackensack Fire company' s letter dated January 31st,
1.980 pursuant to their letter dated February 28th, 1980.

Gentlemen:
In regard to the above site plan, the New Hackensack Fire
Department has the following recommendations :
1} The Lounge expansion and Banquet Room be limited
to an occupant load of 15 square feet per person,
as recommended by 1976 .Life Safety Code, Section -
- -
2) All areas of public assembly shall have at least
two means of egress, as recommended by 1976 .Lite
Safety Code, Section 8-2 . 4 . 3.
3) All exits designated as such shall be equipped with
panic hardware and shall be identified by a continuous--.
ly illuminated exit sign (s) , as recommended by 1976
Life Safety Code, Sections 8-2. 8 . 1 and 8-2. 11 respect-
fully
4) Emergency lighting shall be provided to provide
illumination of the exit access and the exit, -as
recommended by 1976 Life Safety Code, Section 8--2.10 .
5) Smoke and/or Fire detectors (U..L. approved) shall be
installed in all areas of assembly and storage. Such
detectors shall be wired in series .

6}. The proposed parking as shown on the site plan does
not provide access for emergency apparatus and
restricts the area of the exit discharge from the
building. Therefore we recommend that a minimum area
of fifty (50) feet wide on each side of the building
be designated as a no parking zone. Such areas should
be located directly in front of or as close as possible
to any areas of exit discharge..
