A shelter should indeed be provided within the shopping center rather than on Route 9 for the convenience of those needing this service. Barger, P.E .. & L.So , and dated October l6th, 1978 and subject to the following .conditions: 1 . Approval of the DutchessCounty Department of Health shall be obtained for water supply and sewage disposal. 2 . Approval of the New York State Department of Transportation shall be obtained and a work permit shall be obtained prior to the issuance of a building permit. 3 . All refuse shall be stored in an enclosed. area in a neat. and orderly fashion. Storage of refuse shall be reviewed by the Zoning Administrator and if itis felt that garbage compactors are needed said Zoning Administrator is authorized by the Planning Board to require that they be installed. 7. All utilities shall be placed underground. 8. Downstream drainage fee of $ .15 a square foot for newly constructed roofed areas or areas covered by impervious material shall be paid prior to the issuance of any_build.ing permits.. 9. Size and location of any signs to be placed on the property must be in accordance with the requirements of the Town of Wappinger Zoning Ordinance unless a variance is obtained from the Zoning Board of Appeals. 10.. The owner of the site shall be responsible for the maintenance and upkeep of all curbing, sidewalks, parking areas, roadways, entrances, exits and snow removal. 11. Compliance with building plans and site plans shall be certified by a New York State licended Engineer or Architect. 12 . Not having received a negative reply, I assumed these re- quests were granted, and the items would be included in the building construction. While checking the building on June 8, 1981, I noticed that the water sprinkler system in the storeroom was completely changed to a dry powder system. The requested CO 2system in the hoods was also a dry powder system - neither. of these changes were with my knowledge or approval . Item #5 was omitted com- pletely and is still required by this department . I feel that if changes to building plans are going to be permitted after the Planning Board grants requests , the indi- vidual permitting such changes should write a Letter to the Planning Board and the Chief of the fire department concerned, informing them that changes are being made and why they are being made . I feel that the requests I made on January 23, 1981 , were valid and with merit and do strongly protest the changes that were permitted, the method in which they were made; and I do not approve of them at all. Because there was concern on the part of the Town Board and Planning Board, I called for a meeting and submitted a punch list (attached) to all concerned. This was reviewed and all items were addressed to my satisfaction, I am expecting a timetable from Mr. Cascio, addressing the various items on the list, and will not be issuing ,any .permits or C.O, 's until that arrives. As to Roy Rogers,, I intend to issue a temporary C.O. for their Monday, June 8th planned opening. All improvements resulting from said easement shall be done at the expense of the contiguous property owner. . It is. the opinion of the Board that it would be preferable to have the bus enter the site and pick up and discharge passengers at the proposed bus shelter in a manner similar to what is done at the imperial Shopping Center Plaza. The Planning Board feels that by doing this a hazard would not be created on Route 9 which could result if the shelter was relocated, elderly persons would not have such a great distance to walk and inconvenience in inclement weather would be lessened. It would be appreciated if you would advise the Planning Board of the outcome of reconsideration of this matter-. Thank you for your consideration. I think it' s a definite improvement over the original submission. After receiving the plan, one of the planners in our Transporta- tion Division reviewed the design in order to determine whether the size of the Center would justify having a County LOOP bus enter the Center in order to pick up and discharge passengers. He informs me that an internal stop is not justified and that County Buses would stop along Route 9 in close proximity to the site's major access point. May I, therefore, suggest that -the developers, with your approval , relocate the bus shelter to a point about 50 feet north of the exit lane of the Center's main access to Route 9.
