Walden Subd. RESOLUTION 4/21/97 TOWN OF WAPPINGER PLANNING BOARD RE: WALDEN SUBDIVISION - RESOLUTION OF FINAL SUBDIVISION PLAT APPROVAL At a regular meeting of the Planning Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the 7th day of April 1997, at 7:30 P.M. The meeting was called to order by Chairman William Parsons and upon roll being called, the following were: PRESENT: Chairman William Parsons Vice Chairman Chris Simonetty Boardmembers Philip J. Dinonno (absent) Michael P. Franzese George Grimshaw (Ab, Hugo Musto Robert Walker The following resolution was moved by Mr. Wal ker and seconded by Mr. Musto WHEREAS, the Town of Wappinger Planning Board received the application of Ronald Walden and Claire Walden (the "Applicants,") for Final Plat Approval involving the subdivision of one (1) 1.17-acre parcel into two (2) lots 0.61-acres (Lot 7A) and 0.56-acres (Lot 7B) in size ; and WHEREAS, the subject property is located within the R-201 Residence District at the west side of Carlen Drive and is bounded by Edgehill Drive to the south and Peel Lane to the north, and is known as Tax Lot 19-6258-04-670082 on the Town of Wappinger Tax Maps (the "Subject Property"); and WHEREAS, the Applicant has submitted the following one (1) sheet of plans: 1. "Preliminary Map," drawn at a scale of I" = 50', dated 6/4/91 and last revised 10/4/96, and prepared by Raymond V. Kihlmire, L.L.S.; and WHEREAS, the Planning Board is familiar with the site and all aspects, of the proposed action and has been satisfied that the proposed subdivision will conform to the requirements of the Zoning Law; and WHEREAS, the Planning Board found that the proposed 2-lot subdivision would result in the creation of one (1) new building lot; and ORIGINAL WALDEN SUBDIVISION RESOLUTION OF FINAL APPROVAL WHEREAS,the subdivision was granted preliminary approval on March 2, 1992; and WHEREAS, the 6-month time period for applying for Final Plat approval has since expired; and WHEREAS, the Planning Board has determined to accept the application for Final . Plat approval and has determined that the final plat is substantially similar to the approved preliminary plat; and WHEREAS, a duly advertised public hearing for Final Plat approval was held on April 7, 1997 at the Wappinger Town Hall, 20 Middlebush Road, Wappingers Falls, New York at which time all those wishing to be heard were given the opportunity to be heard and the public hearing was closed on that date; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The Planning Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein. 2. Pursuant to local and State Environmental Quality Review regulations, the Planning Board hereby adopts a Negative Declaration on the grounds that the proposed action will not result in any significant environmental impacts as only minor temporary land disturbances associated with the construction of a single house will occur. 3. The Planning Board hereby finds that, pursuant to Section 5.514 of the Land Subdivision Regulations, a proper case does not exist for requiring that additional parklands be suitably located for playground and other recreational purposes within the Town of Wappinger as less than six (6) new building lots would be created, and that neither the dedication of land nor a fee in lieu of land will be required. 4. The Planning Board hereby grants Final Subdivision Plat Approval subject to the following conditions and modifications: a. The following shall be fulfilled prior to the signing of the final plat by the Chairman of the Planning Board: (1) The Applicant shall prepare a final subdivision plat in accordance with Section A-5 of the Town of Wappinger Land Subdivision Regulations. ✓(2) The Owner shall endorse a copy of this resolution and submit it to the Planning Board for its files. 2 WALDEN SUBDIVISION RESOLUTION OF FINAL APPROVAL (3) The Applicant shall submit the revised plat to the Dutchess County Department of Health for its review and approval and signature. "'(4) The Applicants shall submit a statement signed by the Town's Tax Collector that all taxes due on the subject parcels have been paid. ✓(5) The plat shall be revised to be labeled "Final Plat". ,(6) The plat shall be revised to consolidate the notes in one area of the sheet. /(7) Special Note 2 shall be revised to clarify that the initial 25 feet of driveway from Edgehill Drive shall be paved with blacktop. 48) No fill shall be placed along the northern property line that would result in backup of drainage or ponding of water on lots to the west. A note to this effect shall be placed on the Final Plat. Conditional approval of the final plat shall expire one hundred eighty (180) days from the date of this resolution unless all requirements have been certified as completed or unless a written request for an extension of Final Subdivision Plat Approval (not to exceed two (2) ninety (90) day periods) is granted. b. The following conditions shall be satisfied prior to the issuance of a Certificate of Occupancy for Lot 713: (1) The builder of Lot 7B shall construct a swale from the northwest corner of said lot providing positive drainage towards Carlen Drive to the satisfaction of the Town Engineer. 5. In accordance with the Town's Schedule of Fees, the Applicants shall be responsible for the payment of any application review fees incurred by the Planning Board in review of this Project which are in excess of the application review fees paid by the Applicants to-date. Such fees shall be paid within thirty (30) days of the notification to the Applicants that such fees are due. If such fees are not paid within this thirty (30) day period and an extension therefor has not been granted by the Planning Board, this resolution shall be rendered null and void. 3 WALDEN SUBDIVISION RESOLUTION OF FINAL APPROVAL The question of adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: William Parsons, Chairman Voting: Aye.
