OF TRANSPORTATION (STATE ROAD) RESOLUTION TOWN OF WAPPINGER PLANNING BOARD RE: WALLACE SUBDIVISION- RESOLUTION OF FINAL SUBDIVISION PLAT APPROVAL At a regular meeting of the Planning Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the 29th day of September 1998, at 7:30 P.M. The meeting was called to order by Chairman DiNonno and upon roll being called, the following were: PRESENT: Chairman - Philip J. DiNonno Boardmembers - Michael P. Franzese George Grimshaw Hugo Musto - William Parsons June Visconti Robert Walker The following resolution was moved by and seconded by 7 ci WHEREAS, the Town of Wappinger Planning Board received an application for Final Subdivision Plat approval from Thomas Wallace (the "Applicant") for the subdivision of one 4.68 acre parcel of land into two lots, 2.267 acres (Lot 1) and 2.414 (Lot 2) in size; and WHEREAS, the subdivision was granted preliminary approval on October 20, 1997; and WHEREAS, the subject property is located on the south side of New Hackensack Road approximately 700 feet east of the intersection formed by New Hackensack Road and Wildwood Drive; and WHEREAS, the subject property contains an existing residence and driveway, and is known as Tax Lot 6158-02-930778 on the Town of Wappinger Tax Map (the "Property"); and WALLACE SUBDIVISION RESOLUTION OF FINAL PLAT APPROVAL WHEREAS, the Applicant has submitted the following one (1) sheet of plans: Sheet 1 of 1, "Subdivision Plat to be Known as Wallace Subdivision", dated 4/15/97, last revised 9/4/98 and prepared by Gray Engineering, P.C., Poughkeepsie,NY; and WHEREAS, the Planning Board is familiar with the site and all aspects of the proposed action and has been satisfied that the proposed subdivision will conform to the requirements of the Zoning Law, except where noted; and WHEREAS, the Dutchess County Health Department has approved the proposed subdivision on July 27, 1998, as stated in an Individual Lot Notification of Approval dated August 3, 1998; and WHEREAS, the Planning Board found that the proposed 2-lot subdivision would result in the creation of one (1)new building lot; and WHEREAS, the Planning Board has determined to accept the application for Final Plat approval and has determined that the final plat is substantively unchanged from the approved preliminary plat and therefore a Public Hearing for final plat approval is not warranted, NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The Planning Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein. 2. The Planning Board hereby finds that, pursuant to Section 5.514 of the Land Subdivision Regulations, a proper case does not exist for requiring that additional parklands be suitably located for playground and other recreational purposes within the Town of Wappinger as less than six (6) new building lots would be created, and that neither the dedication of land nor a fee in lieu of land will be required. 3. The Planning Board hereby grants Final Subdivision Plat Approval subject to the following conditions and modifications which shall be fulfilled prior to the signing of the final plat by the Chairman of the Planning Board: a. The Owner shall endorse a copy of this resolution and submit it to the Planning Board for its files. 2 WALLACE SUBDIVISION RESOLUTION OF FINAL PLAT APPROVAL b. The Applicant shall prepare a Final Subdivision Plat in accordance with Section A-5 of the Town of Wappinger Land Subdivision Regulations. C. The Applicant shall submit a statement signed by the Town's Tax Collector that all taxes due on the subject parcels have been paid. d. The plat and references to it on any accompanying plans shall be revised to be labeled "Final Plat." e. The plat shall be revised to include columns for each of the proposed building lots in the Zoning Data Chart. f. Approval for the proposed shared driveway must be obtained from the Dutchess County Department of Public Works. Of specific concern is the general safety of the shared drive and the sight distances at the end of the drive. .g. The plat shall be revised so that the retention area, driveway, garage floor elevations, and related items are designed, located and graded to the satisfaction of the Town Engineer. h. The signature of the Dutchess County Department of Health for the water supply system and sanitary sewage system must be obtained. Conditional approval of the final plat shall expire one hundred eighty (180) days from the date of this resolution unless all requirements have been certified as completed or unless a written request for an extension of Final Subdivision Plat Approval (not to exceed two (2)ninety (90) day periods) is granted. 4. In accordance with the Town's Schedule of Fees, the Applicants shall be responsible for the payment of any application review fees incurred by the Planning Board in review of this Project.which are in excess of the application review fees paid by the Applicants to-date. Such fees shall be paid within thirty (30) days of the notification to the Applicants that such fees are due. If such fees are not paid within this thirty (30) day period and an extension therefore has not been granted by the Planning Board, this resolution shall be rendered null and void. Refunds of any remaining 3 WALLACE SUBDIVISION RESOLUTION OF FINAL PLAT APPROVAL funds within the escrow account for the application will not be made until six (6) months after the filing of the subdivision plat. The question of adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: /7 Philip J. The Dutchess County Health Department shall sign the map for both sanitary sewage systems and water supply systems. I have also reviewed the revised map as it compares to our September 15', 1998 review letter. Comments No. 2 and No. 3 in our review letter have been satisfied.
