Barger, At the October 22nd, 1984 meeting of the Planning Board, a motion was made by Mr. Fanuele, Seconded by Mr . Parsons, to adopt the following resolution of final approval : WHEREAS, an application for final approval of a subdivision plat entitled "Subdivision Plat for Watersedge - Section I, Town of Wappinger, Dutchess County, New York", was received by the Town of Wappinger Planning Board on June 11th, 1984, and WHEREAS, a final public hearing was held on said subdivision application and plat at the Town Hall, Mill Street, Wappinger Falls, New York, on Tuesday, October 16th, 1984, and WHEREAS, the requirements of the Subdivision Regulations of the Town of Wappinger have been met by said subdivision plat and application, except as noted below, and WHEREAS , the conditions of the preliminary approval of said subdivision plat, granted by the Town of Wappinger Planning Board on June llth, 1984, have been met, except as noted below. NOW, THEREFORE, BE IT RESOLVED THAT the application of Barger, Ritter, Hughes, Larusa, Shokan, and Ferenz, for approval of said subdivision plat, prepared by Richard G. Barger, P.E . , L.S ., and and dated June llth, 1984, be approved subject to the following conditions, and that the chairman be authorized to endorse approval on said subdivision plat upon compliance with said conditions by the applicant, which condition approval shall expire six months from the date of this resolution if the applicant has not complied with the conditions set forth. Upon completion of all requirements set forth in the action approving the Subdivision Plat, the plat shall be properly signed by the appropriate officers of the Planning Board, and shall be filed by the applicant in the office of the County Clerk in accordance with the requirements of Section 278 of the Town Law. Drainage flow patterns shall be indicated on the individual plot plans. For any surface waters that discharge upon properties of other persons, the applicant shall obtain letters from the same permitting such discharge. 3 . No open stream will be permitted unless permission, in writing, is obtained from the Highway Superintendent. 4. Inspection fees for water lines, sewer lines, and storm drainage lines, if required, shall be paid prior to the signing of the plat. 5 . Downstream drainage fee of $200.00 per lot on the final plat shall be paid prior to the signing of the plat. 6 . Recreation fee of X500. 00 per lot on the final plat shall be paid prior to the signing of the plat or a land donation shall be made that is acceptable to the Recreation Commission and the Planning Board. Determination on this shall be made prior to final approval. 7. No structure is to be built where the lowest opening (windows, doors, garage doors, crawl space, etc. ) are lower than two feet above the road surface unless approved by the Highway Superintendent. e . All footing drains and roof leaders, if specified by the Building inspector, shall be piped into the storm drainage system. 9. The developer shall be required to keep the roads .in the subdivision clear from snow and ice and make the roads otherwise passable until such time as the roads have been accepted by the Town. Upon failure to do so, the Town may authorize, after determin- ation that an emergency exists, a private contractor, to clear the roads or make the roads passable and the expense of such work will be assumed by thq developer. 10. Prior to final approval, the Fire Prevention Bureau shall be provided with a copy of the plat indicating the proposed street names to prevent similarity to named current streets in the Town of Wappinger. An erosion control plan shall be submitted to the Conser- vation Advisory Council for their review and then shall be approved by the Engineer to the Town prior to final approval. 12 . Prior to final approval, a determination shall be made with regard to Enviornmental Assessment. 13 . Compliance with the comments of the Engineer to the Town, stated in his letter dated March 12th, 1984, shall be met prior to final approval . 14. A downstream drainage plan shall be submitted and approved by the Engineer to the Town and the Planning Board prior to final approval. 15 . Five copies of the filed map shall be submitted for Planning Boards distribution. Said copies shall be obtained from the County Clerk' s office. 16 . A frontyard definition of not less than 50 ' setback and not less than 125 ' wide for each lot, 17. All filed reaps shall show flood plains before signing of the plat. 18 .
